I have only seen one return after filing a WOM but they knew it was  to be returned anyway.  They do not return because background checks are incomplete... that is a myth.  I have not seen one returned for that reason.  They must make a decision the day of the interview the ds5535 is given when they don't feel ready to make the final decision.   Its a temporary denial but I have rarely seen anyone who gets one get a full denial later.  It almost always produces a visa sometimes weeks sometimes years.  You file the WOM when you are ready and it feels right.

Hi, I had my interview at the Montreal consulate in October 2018 for CR1. I was told I was approved passport kept and given a welcome to US paper, but after leaving the consulate same day I was sent an email for form DS 5335. I was put into administrative processing. After checking with a friend of mine who worked for Uscis he advised me that if you are born in certain countries ex. Pakistan, male between the ages of 18-65 there is a high chance of being placed in administrative processing. Even though I’m a Canadian and only have a Canadian passport. He advised back then that I should file a writ but I was hopeful that it would be resolved. March 2020 we filed a writ but due covid-19 happened and the Montreal embassy was closed. Finally when the embassy opened in August I was able to get to get the case moving.
Finally after all the nightmare I was able to come to the US in November 2020 on an IR-1.
My suggestion is that if you are in administrative processing for over 1 year please file a writ. I used kuck Baxter law firm. They are on the high end but for some money maybe an issue. For me too it was the same but I figured it’s a small price to have peace of mind and I don’t regret it. I paid 5000 USD total.

Yes, he got the visa in August 2019 and arrived here in October 2019! Best part about it is that he has his 10 year green card so we are doing great!
Thanks for looking at our timeline!

I have been told they would send my passport back without the visa and the process will continue since there's not a clear end date, I guess this is not a good sign?

You might be able to have NVC reopen the DS260 if you call and explain to them why you need it reopened, it’s a hassle to get through though so keep calling until you hear a ring for a second at the beginning, and then stay on the line to go through the robot menu before you can be put on hold to an agent

    Thanks for responding H&T.
You are right however my immigrant visa process has been a little different. We had applied in 2013, had an interview (scheduled by them) in Nov 2014. The interview started off well and everything seemed okay but at the end I was told I had to do an i601 waiver (due to my previous stay in the US). The waiver was approved last summer and then I was asked to update our DS-260, get new police certificates, pictures and medical (since it had been over an year). We submitted everything by mid December 2018. After being in AP  for around 7 weeks, they said they had reviewed the file and in order to continue, I would need to schedule my biometric oath (re-oath). This time around, for my 2nd interview they need me to schedule my own interview date through the ais (green) site that I have been getting their communications from. This seems similar to the K-1 applicants.
Hope someone can enlighten on my booking issue...

Hello all! Our case is no longer in AP and our visa status is now issued.
My fiancé is based out of Kabul and I am very thankful that the AP process went by quickly. I pray for the best for everyone else! Patience is key

For anyone who may still be following this: VISA HAS BEEN ISSUED! CEAC finally changed to issued this morning and my fiancé got his email for tracking as well. He had his interview back on July 3, 2019. Was told he was approved but then received DS-5535 within a few hours and we have been waiting ever since!

Yes, you will be allowed to accompany the beneficiary if you are a USC, but not if you are a PR. That's what the lady at the counter said when entering the consulate. I imagine the beneficiaries that were allowed in would have shown their US pp.
This is important info for those of you who will be flying in for your appointments with your beneficiaries. Save $$ if they aren't USC.
Ofcourse, you can always contact the consulate to verify before booking flights.

My CAEC tracker finally updated today.  I sent in P3 immediately rather than waiting a day, and about 2.5 hours later received my P4.
    Interview May 15, 07:30am! YAY!!

Had my medical done in Montreal yesterday and walked over to the Consulate (just to see exactly where it is so I'll know for interview). Felt so surreal!
Hope the next 6 weeks go by fast 😂

So I was able to talk to someone at the appointment centre (Thanks F+S for the  contact) and they verified that IV slots aren't open as of yet and that K-1 slots are separate times assigned only for k-1.Sharing that here in case anyone is wondering.
PS:  IV appointment dates are assigned by Montreal however,  you book your own if called in for a 2nd interview

    Will keep checking...

    Hi there,
I am an IR-1 actually and this will be my 2nd interview (after my i601 was approved). I was asked to schedule an appointment by Montreal as well and have been diligently checking for 3 weeks now but haven't found anything
Have been seeing the same words in red...No appointments available...try again later. I imagine the K-1 and IR-1 slots are the same (if someone can verify?) hence am assuming am in the same boat...looking for an appointment.
I tried calling the local number provided (for Winnipeg) but it would hang up after reaching the immigrant visa option hence I was wondering what number people are calling to check on appointments?
Was hoping to get something for April but I guess those are all full.
Just thought I would message here since I havent been getting a  response when I posted as a new topic on this (sorry)

I asked if I could book for May now lol she said no.
