    Hopefully you'll be one of the lucky ones.  Ours was received and signed for Dec.2  and no word yet.  I was wondering if any other early December filers got their NO1 yet and so far only one person responded with a yes....Unfortunately I heard it takes up to 30 days.  Our visa expired yestarday 😓

    Yes was married Oct.19.  Sent package on Nov.29.  They signed for it on Dec.2

    nope, in the haste to get it out did not fill out the form for text message :(

    Filing for Adjustment of Status within the 90 days protects your legal status. Your legal status expires after 90 days, married or not. The only way to protect your legal status is to apply for Adjustment of Status, and the only way to maintain continuous legal status is to file for AOS within 90 days or arriving. On the practical side, it is often difficult to arrange for the marriage, and get all the paperwork ready in time to file for AOS within 90 days. Many couples have filed for AOS a few days or weeks after the 90 day limit with no problems. Thus far, many experiences have shown this is not a major issue with local USCIS (INS) offices.

     

    Sorry if this question has been asked.  BUT

    90 days will be up Dec.18.  Got married on Oct.19.  Filed AOS and mailed, was received on Dec.2 (signature confirmation) still no NO1.  

    1.  Is this a normal timeframe?

    2.  If for some reason we don't have the hard copy by Dec.18 should we be carrying around the marriage certificate as proof?  I mean, aren't we here legally as long as we filed even though we don't have the hard copy?

     

    I am sure this has to have happened to someone else at some point but can't find any threads discussing this specifically!

    ugh I tried all the different tricks mentioned on here and still no luck.  I am trying "get human" now where supposedly they wait on hold for you and call you back.   Did you ask to speak to a "tier 2" person or was it just the first person you spoke to that gave you the good news?

    Did you receive 3 separate RFE's or just one asking for 3 different things?  

    The wait is maddening, and I can imagine more so with a child involved.  I am so sorry and hope that you can find answers soon as well as peace of heart and mind as you wait for a hopefully positive outcome!

    We didn't answer a couple questions in the "have you committed crimes" section which had to have been an honest mistake.  No crimes committed btw.  Just got the RFE today.  Did you ever get your answer and how long did it take?  Did you just send back the page they sent you?

    Nope, no crimes, a simple case of not checking the boxes although at the time we thought we were thorough.

NOA1 Feb 15, 2019,  today the RFE came saying we failed to answer questions on the form, specifically Part 3, questions 2b, 2c, and 4.  Which pertain to arrests.  I don't know how this was looked over, however I assume they are talking about the US citizen petitioner?  Its just one page asking us to check yes or no, then sign.  has anyone ever had this happen and if so, how long does it usually take for it to be resolved?  (no crimes committed btw)

    I can't really share advise but certainly can share our experience.  My daughter is in a similar situation, as she too is expecting a baby, early August for her.  We are about to be sending out the forms and evidence for the K-1 visa, and yes we have flip flopped about which visa would be better in the long run, if you'd like to compare notes feel free to message me.  I don't wish to read any more comments about my daughter and future son-in-law should be the ones asking the questions (they have done their own research and its been impressive)  Whatever you decide, best of luck to you 😊
