It can be helpful to provide the last 12 months of bank statements to show the income amount that is deposited each month when trying to prove non-taxable income. Along with the SSA-1099, also provide the benefits letter/statements from the SSA. You need to provide as much as you can to prove non-taxable income. And never assume they will pay attention and notice the line on the taxes that lists the income. Make sure you point it out to them when adding the documents to prove it.

I realize this thread is old, ancient in fact, but it documents an issue I am currently having, which is what to put in the line 24a of part 6 on the i864.  AGI for social security if looked at that would not make the cut however the actual income received is well above guidelines.  Including all proof including a years worth of bank statements but curious to see how others in this situation made out.

Did you send an I-864 with your application?

my total income (adjusted gross income on IRS form 1040EZ) as reported on my federal income tax returns for the most recent three years was:

They tell you right there that they are asking for your Adjusted Gross Income.  You will find it on the 1040 on the adjusted gross income line.

Tax transcripts typically are sufficient, but err on the side of caution and send your entire tax return with schedules and w2s because they are asking for it, and it wouldn’t hurt to send the transcripts as well.  Did you send tax transcripts with your application?

Yes of course I did.  For petitioner and joint sponsor.  Who knows why they sent RFIE....it was very generic what they said, nothing about not meeting guidelines or anything...and when I called to ask they were zero help, including the tier 2 guy.

Joint sponsor collects pension and social security retirement benefits and is WELL over poverty guidelines.  The AGI thing tho (the pt 6 line 24a) threw me tho the AGI on ss benefits is the taxable portion if I am understanding correctly, which obviously isn't enough.  But total and current income is.  So see where the worry comes in?  One chance to get it right!

Any CPA's?  Accountants?  Immigration Lawyers?  Lawyers?  People smarter then me?  LOL  i.e. HELP!!!

  3. This is what they wrote.

"submit a completed and signed form i864 afidavit of support for the petioning sponsor listed on form i130 or form i129f. Also, provide copies of the petitioning sponsor's most recent federal income tax returns and all supporting tax documents (w2s, 1099, for 2555, and tax schedules)

I thought tax return transcripts were sufficient?

Also, I am so confused about what to put on lines 24.a. (b. and c.)

"my total income (adjusted gross income on IRS fir 1040EZ) as reported on my federal income tax returns for the most recent three years was:

Do they want total income or "adjusted gross income"?  Aren't these two different things?  Also where do you find the correct number amount to put here?

Like I said its for an RFIE so don't want to mess it up again!

If someone could break this down for me, I wish there was a book called "Applying for Green Card for Dummies"  lol

Thanks for your help!  I hope!

  4. Ok. So confused.  Joint sponsor makes enough over poverty guidelines through Social Security Retirement Benefits.  Line 7 in part 6 shows current individual income as $34,000.  However line 24.a shows 14,000 (AGI) because that I guess is what is taxable with Social Security?  I got these numbers off the tax return transcript.  Of course I am sending rewards letter and 1099 showing actual income received, but is this going to confuse USCIS?  Or do they realize that the agi is NOT what the sponsor actually receives as income?

Has anyone been in a similar situation?

Please Please somebody help us!  And sorry if I didn't explain correctly but we are beyond confused!

You must submit the required documents for each application. What they "have on file" from a previous application doesnt matter.

If you are talking about the beneficiary's BC that would have been provided for the embassy interview (and not provided to USCIS), the person adjudicating your application this time may require you to follow the specific reciprocal format as outlined on the visa reciprocity website.

So sorry...disregard my above question concerning the website....I see you provided a link in a previous post.  Me=duh.

Well yes we did send a copy of the same bc we used for the embassy interview which is the long version (listing parents) so with all due respect, can you clarify the above sentence?  (specifically what is the visa reciprocity website)

I guess I really need to hear from other Turkish members who sucessfully navigated the process as it seems that country specifically has a higher then average problem with birth certificates....

Is your birth certificate late registered? I got the exact same RFIE too

Ugh what do you mean "late registered"  The one we sent was not the original it was from the Turkish embassy when he was living in Rome.  It has an official seal and does list the parents.  But again, it is new, not the one created at his birth. Is this a problem?  (our RFIE was generic and said the same exact thing as the one someone previously posted here)

just don’t forget in case of Turkey extract of vital records taken from embassy is valid for 3 months and taken from e-decker valid for a month. As long as you send it within the month there is no problem though.

What does this mean?  Does this mean his birth certificate that he used for K-1 is no longer good?  (sorry this whole process has our heads spinning)

It also doesn't hurt to call USCIS directly and ask them to clarify what the root cause of the RFE is.....whether it's an insufficient translation or incorrect birth certificate submission. Knowing that alone will clarify things greatly. If they end up saying you sent in the wrong birth certificate document then the whole subject of "how to translate" becomes moot.

We have this same problem and I called USCIS to get clarification not surprisingly the first call was useless.  Asked to be called back by a tier two agent and they weren't much better.  Bottom line they said that if I believe what we sent was sufficient then to resend it.  Could not look into our case which is what I though tier two agents were able to do unless I just happened to get one that was dumber then a bag of rocks.

    Hey Yall,

i filed last month and an wondering if I were to get an RFE for the I864 (affidavit of support), would I have to include the I944 (form of self sufficiency)? I would guess no bc I filed my packet before 2/24 but the rfe would come after that date. I dont think I will get an RFE but just want to know what I’m in for because that form looks like a hot mess

Great question!  We are actually in that situation right now, and waiting for a callback from a tier 2 person. (for clarification as we already sent the support forms and the letter did not say insufficient income it just said generically to submit the form) After 2/24 all forms change and not sure if the new i864 form will be different but good to know we won't have to include the 944.  I hope all goes smooth for you and you won't even have to worry about this!!

Many factors influence approvals including  your case being assigned to someone who may take more vacations, on FMLA leave or just lazy.

let’s hope the cases do not involve follow-up questions from a supervisor by the reviewing person or there would be another delay there too.

I am praying we all receive that reviewer who is speedy, organized and again, I mention it, very fast 🙂

We've had someone whos been on vacation since we first filed the k-1 apparently 😕

Did it say you need to submit a specific version of I-864? Because I got an RFIE about that. I initially sent a (not-so) different version of I864 form, it was the one I downloaded from the site at the moment. But turns out they wanted the 03/06/18 version.

Hi.  I downloaded the latest version which is the 03/06/18 version I believe.  They never said specifically anything was wrong, they just asked me to submit it even tho we already did!  I am calling tomarrow to see if they can be more specific as to what exactly they need, but I am freaking out because new forms are coming out that you must use after feb.24 and not sure what they are gonna entail!

    Hi All,

I have a question for those of you who have also received a ASC Biometrics Letter. My husband and I are in the middle of our Adjustment of Status process from K1. We received a letter from USCIS with details for a Biometrics Appointment for my husband but the letter only listed his I 765 (work authorization) even though we applied for his I 485 (adjustment of status), I 765 and I 131(travel permit) together.

The appointment is for tomorrow so my husband is going to obviously go but we are just wondering if we should be expecting another Biometrics letter for his 1 485?

    Thanks a lot.

We had two biometric appointments, one for the i-485 then another for the i-765 but then again our entire journey has followed an unusual course!

  14. Hi I have two questions I hope someone can answer

    1.  Where is a reliable source to have a birth certificate translated?  Has anyone ever used any of these online places?

    2. Do you know if the new forms for affdavits of support are different?  We need to fill out a new one for an RFIE we received, and I understand that after 2/24 you must use the new edition form.

    thanks in advance!

Double check your computer for the forms you filled out. I knew my RFIE was coming because i submitted this form.

Thanks....I wish it were that easy...but definately filled out the i-864.  It doesn't say anything about the joint sponsor having to submit one (and one WAS used) and like I said the wording was so weird and vague, I'm just hoping that someone, even a level II can look into the case and explain further.  Scary since if I can't get an answer quickly I will have to use the new forms that everyone is so afraid of 😭

Had an RFIE for incorrect affidavit of support form. We ended up having to re submit supporting documents so we sent in the federal income tax return for 2018 but this time my husband submitted a version that only have 8 pages. The first time it had 132 pages. I’m mortified now because I don’t know what to expect. We got updated stating they received our response 10 days ago but no further update.

We just got an RFIE, one for birth certificate which we sent, and also asking for i-864 which we also sent!  Doesn't say anything is wrong or that income is insufficent, just a generic "submit a competed and signed form I-864 for the petitioning sponsor listed on Form i-130 or form i-129F.  it also states that "if you have submitted form i-864, the version you submitted is no longer accepted.  (I thought new forms were if postmarked later then feb 24?)

ugh of course i will call, since the instructions were so vague, (and of course frustrating since these were things already sent) but has anyone had this happen or can anyone offer clarification?  thanks!
