Quick backstory, 1-485 accepted, i-765 rejected, had to be resubmitted.  Biometrics  for AOS was 1/23. 2 days later we get a letter scheduling a second biometrics appointment in February.  This is right after we got a NO1 for the resubmitted i-765.  I will call tomarrow to see if this is a mistake on their part, or if because in their eyes the two applications were filed separate we must go a second time.  But has anyone else have this happen?

    I'm so sorry you are having this issue.  As you can see by this thread several of us are/were.  It took us the entire 30 days to receive our NO1 for the AOS, and when the hard copy came it has his name spelled wrong 😕   We also have to resubmit the i765 cuz we stupidly left the last 3 pages off but of course we can't even do that until they send us the correctly NO1 with his name spelled right.   Have hope!  It's comin!  (hopefully in the next few days!

    I guess a bit of both.  If you read I clearly owned up to the mistake of omitting the last 3 pages.  My vent/question was why would they say there was improper filing fee when the fee was included in the i-485.

    They finally texted us and cashed our check....a full 30 days after they received it....for our i-485.  Wonderful holiday gift, right?

    not so fast....yestarday in the mail they sent us back our application for i-765 because the last 3 pages were left out (the ones about did you use a lawyer, did you use an interpreter, blah blah blah) which were irrelevent and would have been left blank anyway.  Ok fair but not fair, I get it, story of my life.

     

    But there was also another paragraph stating "improper or missing filing fee"  ####### they cashed our check plus its all included in the low price of $1225!  Called USCIS and pretty much they were no help so today a level too will call me back in ...  wait for it ... 512 minutes.  Yes folks you heard correct 512 minutes.  Which I doubt anyone will be there it being NYE..

     

    I know this is a simple fix but its soooo frustrating especially since we already waited 30 days for the i-485 package to be accepted!  Anyone else have this happen and if so how was it handled?

    And I get that.  I really do.  But the line about missing or incomplete payment threw me for a loop.  I'm guessing it was an error on their part, but I want to make sure that they won't double charge us which is why I am waiting 512 minutes for a level two agent to call me back!

    The person who signs for accepting the mail is not the Adjudicator....because the same mail room employee accepts 2 cases does not mean they are handled by the same adjudicator.......The requests are generally handled in the order they are received.  Cases are different and adjudicators are different......just as different grocery checkers work at different rates, so do adjudicators.

    Actually, much like the initial 129-F petition, I was under the impression that once the package is received it is looked at to make sure payment is correct and no GLARING omissions.  Then it is shipped along to an office where THEN it is given to an adjudicator.  I thought the purpose of the NO1 (again we realize this is not a decision just a receipt) is to let you know your package is received and until said decision is made you have lawful presence in this country.  Some people have k-1s that thanks to lockbox are overstaying their visas thru no fault of their own.

    And I honestly don't see why we should be seeing such a difference with timelines, we submit to the same place and send the same payment, petitions should be reviewed in the order they were received. It's the easiest system.

    It says on that case inquiry page that receiving a notification back from a lockbox takes 10 days. Not 30. I was told on the phone 15, on email 30 and on the inquiry page 10. Which is true?? 

    Seriously losing it.

    That is the response I got when I attempted to fill out a form on the USCIS website.  I wonder if they are "thinking" 129-F 😕 altho I specifically said i-485😭

    You should NEVER, NEVER, NEVER did I happen to say NEVER compare yourself to others. No two applications are the same, two embassies are the same and NO TWO CO's are the same. Every application has a process and some take longer than others. Stop worrying. You will very likely hear from them very soon and then you will think you are a fool for getting so worked up. Oy Vey!

    and to add to the frustration they won't even let us send an inquiry til 30 days are up! 😭

     

     

    The following error(s) need to be corrected:

    • Do not submit a request if you have just recently been approved, allow approximately 30 days to receive your new notice.

    We did apply with a request to expedite so I'm hoping maybe the request was sent to an officer for review 🤷‍♀️

    I feel ya.  We mailed on Nov.29, signiture confirmation of receipt Dec.2.  So far no NO1, no check cashed.  We called the USCIS # last night and they have no record of our package in the system.  I feel like STORY OF MY LIFE ya know?  Any and all suggestions or stories from others in similar situations would be appreciated as moral is becoming low.....

     

    That being said, congratulations to everyone for whom this process is going smoothly :)

    If I remember correctly what I’ve read it would be date received. But I could be wrong

    I sure as heck hope so as they RECEIVED ours Dec.2 but still no NO1 nor has the check been cashed!  Stupidly in our haste did not sign up for emails texts and altho we filed within proper time frames now the k1 is expired! 😬

    Congratulations....We technically filed in November but they "received" our package Dec.2 (signiture confirmation) in our haste we didn't add the form for text.  They STILL didn't cash our check so I'm starting to get a tad nervous!  Your post gives me hope?  lol
