  1. As far as I know the ex-husband father was a US citizen when the child was conceived and born, and the father was the one who processed the mothers IR1 visa. The father did not register the childs citizenship with the US embassy in Manila, paternity testing would be required and possibly court ordered if the father is not cooperative. 

  2. I'm asking for a friend. My friend is from Philippines and a US permanent resident, her US citizen ex-husband is the father of her child, her child is still in the Philippines while she lives in the US remarried to another US citizen. She was told by RapidVisa that she herself should file for her childs IR2 visa as a permanent resident, and not her new US citizen husband to avoid visa denial due to her ex-husband being a US citizen and that shes remarried to another US citizen. To me this does not make sense, as filing an immediate relative visa petition as a permanent resident could take 3-10 years as far as I know, when the new husband could simply file as Stepfather and process the IR2 petition in 10-12 months. Shouldn't her new US citizen husband file the IR2 petition as the child is now a Stepchild (I myself recently brought my 2 stepchildren to the US using IR2 visa)? Or better yet, since the childs biological father is a US citizen this should automatically make the child a US citizen, how can she go about registering the child's US citizenship and obtaining a passport for the child? Her goal obviously is to be united with her child by bringing the child to the US to live with her and her new husband.

I called them to ask why they sent me two conflicting emails, the rep said we don't need anything from you at this time. Your case is complete and line to be scheduled for an interview. In any case I'm CC now but since I don't trust the reps too much I have ask my spouse to go collect a certified birth certificate as I don't want any surprises interview time @ USEM Ghana.

     

    All documents were submitted 03/07 and Case Complete[Documentarily Qualified] today, 3/13 - so just about week.

    Congrats thats very fast! My daughters took 12 days and my sons took 16 days to become Documentarily Qualified

    Wow that is very unusual for Manila embassy! We received the "Case Documentarily Qualified" email from NVC on Dec 27, then 12 days later we received the "Immigrant Visa Interview Appointment scheduled" email from NVC on Jan 08 with the interview date scheduled for Feb 04

  5. Finished this long process and arrived in the US with my 2 kids Aleah and Armie last week Wednesday, posting our timeline for others to estimate processing times. I am the US petitioner, my Filipino wife stayed in the US while I went to Philippines to escort my kids to their embassy interview and bring them to the US. We got a 221g RFE requesting IRS tax transcripts, despite the fact we brought past 4 years W2's including 2018, past 3 years 1040's, past 6 months pay-stubs, and letter from employer stating hire date job title and annual salary, causing me to stay in Philippines 5 weeks to complete the embassy phase of processing. I also was harassed at Manila airport 20 minutes and Los Angeles airport 1.5 hours by immigration officers asking repeatedly why the mother was not traveling with the kids even after I made clear my wife stayed in the US with our 10 month old baby girl and despite the fact I had presented all required travel and consent documents and Philippine embassy power of attorney, and that their mother was waiting at Los Angeles LAX terminal for our arrival.

    If I remember correctly, you are not even given the option to fill the DS-260 or upload documents until AFTER you pay the fees AND the status changes to PAID

    We submitted W2's and 1040EZ forms for past 3 years, past 6 months pay-stubs, and letter from employer. We did not submit tax transcripts. All of our documents were accepted, and our embassy interview date is scheduled for next Monday Feb 4.

    However I do not know if that only applies to IR2 Cases. But once the fees have been paid, I would give them a call to make sure it also applies to you. You probably can change it after then!

    I'm just waiting on this case now.

    We have two IR2 child cases also, wife has been in the US 2.5 years now while kids are in Philippines due to strict birth certificate rules not allowing us to apply for their passports till errors fixed on birth certificates via court order (illegitimate children cannot share the fathers last name!?). From my observance and personal experience I think all I-130 Immediate Relative petitions are processed the same regardless if they are for a spouse or child. We were delayed for my stepsons petition after we submitted all documents then NVC asked for my divorce decree from my prior marriage (RFE), which I thought was odd since I am currently married to the mother and why would they need my prior divorce decree for a child petition? I had a feeling they would ask for my divorce decree for my step daughter as well so I quickly uploaded the decree to her petition within the hour of notice for my stepson, her petition was CC the following day, while my stepsons petition took an additional 16 days to be reviewed again then CC.

     

    For those inquiring, I believe "Choice of Agent" is only used if you are using a lawyer or 3rd party to assist with your petition process, if you are processing your own petition then you do not chose an agent since there isn't one.

    The DS-260 does not ask for passport pictures, instead in the section where you upload your IV CIVIL DOCUMENTS there is a PHOTOGRAPHS document type where you should upload the 2" x 2" passport photo

I've heard that if you're married 2 years at the time of the interview, they give you an unconditional GC. I'll be married 2 years as of March 6th (a couple of weeks after my interview) - Is there any way they would remove the conditions anyway? 

    From what I understand from previous years of research the conditional / unconditional green card is based on the date the visa is issued not the date of interview, they wont give an unconditional green card based on you will be 2 years married after the date visa issued. If your interview date is scheduled for 2 weeks before your 2 year married date, it might be a good idea to call the embassy to ask if you can reschedule your interview date for a day or more after your 2 years married date, so you can get the 10 year green card. Of course, do not mention that as your reason for rescheduling, if they ask just say some other reason.

    Its possible but I dont know for sure, I haven't seen anyone make the payment with someone else's bank account. Is there a reason why your spouse cant open a new bank account, maybe at a different bank, to at least pay your NVC fees? This is possibly going to be a problem if your spouse cant maintain an open bank account, it doesn't look good to immigration officials if financially unstable.

    We had a request for document also, on 2018-12-11, they approved the document and CC on 2018-12-27, it took 16 days till NVC reviewed the uploaded document.

    The NVC fee payments can ONLY be made online, they REQUIRE a bank account-routing number, they do not accept debit cards and there are NO other options for payment.

    No you cannot upload in 1 file, you will see on the upload page there are specific individual preset files they request. You should save your files in adobe PDF format, then compress the file using the optimize utility in acrobat (File> Save as Other> Optimized PDF) to reduce the file size to smaller than 2mb.

    Oh wow ok now I understand, yes middle east takes very long. It would have been wise choice if you went back to Philippines to process your petition at US embassy Manila, much much faster and easier!

    NVC phone reps say it should not take longer than 3 weeks (21 days) to review documents, only call to ask for supervisor if it has been longer than 3 weeks and be very polite do not stress do not show negativity, as they say you get better results with sugar than with salt and vinegar. We did not ask for supervisor since my sons documents were finally accepted after 16 days but we were prepared to call and ask for supervisor if we reach day 22 without review. On day 16 we received the NVC email saying documents were accepted and they will contact the embassy to schedule an interview date.

    and yes my husband used to call at nvc but the representative always says your case is being reviewed and will notify you if anything is there.

    We are petitioning my step kids IR2 child visa, Aleah is my stepdaughter her documents took 12 days to review, Armie is my stepson his documents took 16 days to review after we had RFE request for my divorce decree. After you submit documents it takes 10-20 days to review, if you get a RFE request for additional or replacement documents they remove you from the review queue then when you submit the documents again you start over at the end of the review queue line and takes another 2 weeks to review. NVC rep will always tell you much longer than it actually takes, they do this to deter or discourage you from calling again, I do suggest you call NVC if it has been longer than 21 days since you submit your documents and ask for a supervisor.
