  1. Another road bump. I've just got a letter from my health insurance company saying they need an SSN / ITIN as part of the changes to the ACA or they may have to cancel my insurance.

     

    SSA has now rejected my request for an SSN because my I-94 expires in less than 14 days, even though we provided it earlier, and because the A Number on my I-797C doesn't match the one in my passport.

     

    The IRS says I can't apply for an ITIN because I'm eligible for an SSN, but the SSA says I'm not eligible for an SSN. Am I just stuck in a bureaucratic catch-22?

  2. As a follow up, we got a response today to our request to expedite based on a USCIS error, and were told we should get a decision or further notice of other action within 120 days!

     

    Given both my bank and health insurance provider are now telling me I need to provide them with an SSN / ITIN soon, I'm glad there's a much shorter time boundary on it. I can't afford to lose these...

  3. As an update, here's the excerpt from the USCIS website:

     

    ALERT: Judges before U.S. District Courts for the Southern District of New York (PDF (PDF)), Northern District of California (PDF (PDF)), Eastern District of Washington (PDF (PDF)), Northern District of Illinois (PDF (PDF)), and District of Maryland  (PDF) (PDF) have ordered that DHS cannot implement and enforce the final rule on the public charge ground of inadmissibility under section 212(a)(4) of the Immigration and Nationality Act. The court orders also postpone the effective date of the final rule until there is final resolution in the cases. Most of the injunctions are nationwide, and prevent USCIS from implementing the rule anywhere in the United States. Until final decisions in these cases are issued or the injunctions are lifted, USCIS will only accept the version of this form that is available on this landing page. We will reject any other version of this form and will notify you to submit your benefit request on the correct form. If we reject your benefit request, you will not keep your filing date.

  4. Another update: Got confirmation from USCIS in San Antonio to confirm my status and that the issues won't cause me any imminent problems while they're processing the AOS. They've said to wait for the receipt letter and request an expedite to avoid any further complications.

    Yeah, we already sent it off via USPS and it arrived the Saturday just past, expect to hear back in a week or two though!

    USCIS have now confirmed the A Number on the I-797 is correct and there's been a typographical error on my visa, and that the incorrect A Number was the reason for the delay and rejection. I'm going to re-file tomorrow :)

I've entered the US and begun the AOS process, filing the petition with the Chicago lockbox PO Box, but it's been over 15 days without a response from the lockbox, an e-notification, or payment being taken from my credit card. I contacted the USCIS Support Center but they can't find any information on my case and said I needed to email the Lockbox Support email which I've now done. However, their automated response email says that a reply from them can take up to 30 business days, of which I only have 35 before my K-1 visa admission period expires.

     

    Is there anything I can or should do to avoid any issues? Since the petition was sent via USPS tracked and was signed for by someone, is this USCIS' fault?

    Yeah. I just checked again and it's now showing "Administrative Processing": Your visa case is currently undergoing necessary administrative processing. This processing can take several weeks. Please follow any instructions provided by the Consular Officer at the time of your interview. If further information is needed, you will be contacted. If your visa application is approved, it will be processed and mailed/available within two business days. 

     

    Just gotta play the waiting game and hope nothing else comes up! :P

    So you didn't "crash & doom" at your interview. I fathom you used the I-864 and not the I-134, right? You were fortunate to have a good CO that thought outside the box. Most go by the "letter of the law" and they would have issued a 221(g) further delaying you.

     

    Well Congratulations and safe travels.

    Our co-sponsor filed the I-134, but the embassy staff said that co-sponsors needed to complete I-864 instead. Thankfully, yeah, she was extremely nice and took into account my field and the availability of jobs. 😀
