Add copy of both you and spouse's drivers license (proof you live in the same address).  Also, they want to see "Tax transcript" (it shows your taxes were actually filed vs. just a copy of what you are stating were filed).  Go to: https://www.irs.gov/individuals/get-transcript and create a userid and then download tax transcript for immigration.

Do you have joint credit cards or is one of you authorized user on the primary card holder's credit card?  If so, include that.  Lastly if you have rental insurance and joint AAA, Costco, Amazon membership, it does not hurt to include those.

    Good luck.

He doesn’t have a drivers license, so we don’t have that or car insurance together. We have no joint credit cards either. It was something we planned on doing and then Covid hit and we never got around to it.

  2. Hello all!

My husband is eligible to send his I-751 tomorrow!!! I just put the entire packet together. We have:

    Cover letter

    check for $680

    g-1145 form

    i751 form

copy of GC (front and back)

    copy of marriage certificate

    copy of church marriage record

copy of our first rental lease

copy of our second rental lease

    copy of current rental lease

    copy of 2019 joint taxes

    copy of 2020 joint taxes

copy of 6 months’ worth of bank statements from joint checking account

copy of authorization to release health information

    copy of health insurance cards

Tons of pictures. Like, almost one for every month we have been married. (Including pictures from trips we have taken since being married)

should I include 24 months worth of bank statements? 6 months seemed good to me but now I’m doubting myself. I feel like we are sending enough evidence…but it always feels like it is never enough.

I tend to agree, and this is probably what I would do.  In fact if Aeroflot is the airline, they might get a nonsensical answer (I remember someone asked them about traveling to the US with an EAD/AP, and they said it was not possible).  Since the mistake is very minor, and the name is spelled correctly in the passport, and the pictures are the same, I think it would be no real issue.

I was more worried about the people at passport control than Aeroflot. But yes, we have had some greeeeat experiences with Aeroflot haha

  4. Hi all,

My husband is from Russia. His mom got a tourist visa last year right before everything shut down due to covid. However, we realized that her name is spelled “Irinia” in her visa, and not “Irina.”

    1. Will she have to get a new visa/fix the spelling? Or will she be able to travel here with that visa?

The biggest problem is that everything in Russia shut down…and then the consulates closed. The embassy in Moscow is running on a VERY limited basis. I don’t think they’ll fix the spelling error.

if anybody has any advice or experience with something like this, please advise!

  5. So our marriage certificate took 2 months to come... and we decided to send in the packet before the 90 days ended just to be safe. We had a customer copy of our marriage certificate without the county clerk’s signature, so we sent in a copy of that + a certificate from the church we were married in + a receipt showing we purchased official copies + a letter explaining why we didn’t have an official marriage certificate. Our interview was just scheduled two days ago. :) so that’s always an option that seemed to work for us.

  6. Hello everybody!

We sent our papers in September 3 and it was delivered September 4. The check cleared today. :)

The only thing that worries me is that we didn’t have a certified copy of our marriage certificate yet. (LA has a wait time of around 2 months!) We sent in a “customer” copy, a copy of church records, and a receipt showing we purchased certified copies. I hope that they accept that and the worst thing that will happen is getting an RFE for that.

    Anyway, good luck to everybody!

Your I-485 needs a cover letter that explains each document.  On that cover letter for the marriage document explain why unavailable: write about your discussion with someone in the appropriate government department, get their name, title and confirm phone number and ask about estimated timeframe.  Also, you have that other non-official document to send in and explain in your cover letter. And maybe repeat that USCIS information you just found as your basis for submitting without actual offical marriage certificate.

Personally, I think that this will be good enough for submission to be accepted ... and later get an RFE.  But important to get that I-485 NOA1 to establish continued legal status as you are already thinking.

Thank you for your input! The problem is, there is no specific person. I just called the county clerk’s office and they told me that our marriage certificate won’t be available for two months from the day we got married. I guess I could ask for their name but the phone number isn’t a direct line to them. It’s to the county clerk office and whoever works that day in the call center/help center picks it up. Like I said, we have a copy that just says “customer copy” with original signatures + the name and date and we got a pretty little “marriage certificate” from the church we got married in AND I have a receipt showing I purchased copies (so I was going to scan that and send it in with the explanation)... I’m really hoping between the cover letter explanation and all of that, they’ll accept it. I’m sending it at the end of this week... so I’ll keep everyone updated. But really, thank you for your help!

I have heard that LA is a pain for getting marriage certificates.  Others may know more, but in my opinion you need the actual certified certificate to file the AOS.  I think you would risk a rejection if you sent in the file before getting it.

    Good Luck!

There are two scenarios that are likely:

    1. They will accept your package and will likely send you a RFE asking for an original or a certified copy.

    2. Your package will be rejected from the get go without the original.

Overstays are forgiven for spouses of US citizens so it’s not a big issue there, but I totally understand your concerns. If you’ve got everything ready to go you could take the chance and just send your package out now so the EAD /AP timeline gets going. If you do decide to go this route though, make sure to make copies of everything so it’ll be as painless as possible to send out a second package.

Thank you both! I just looked and it said if a marriage certificate is unavailable, to send in documentation of it not being available and any other evidence of the marriage we might have? We don’t have documentation exactly of it not being available except that it’s not here yet... 😕

  9. Hi all,

So we made the mistake of getting married in Los Angeles 😐. We got married July 12 and still have not received a copy of our marriage certificate. I just called the courthouse and they said that they don’t even have an image of it yet and that it takes TWO MONTHS now before they will have the image and then send it out. She said if I went to the courthouse today, they’d just mail them to me when they got the image.

Obviously this is a huge problem. My husband’s 90 days are up in September. We can’t file for AOS without the marriage certificate.

Here’s my question: we received a “customer’s copy” of our marriage license and certificate. It has all of the names, signatures, and info, just with “customer copy” written across the paper. ** Would we be able to send a copy of that in + a letter explaining the situation and then as soon as we get the certified copies, send those in to add to our file?

Or is that pointless and we will just get rejected/sent back to us immediately? **

    Thanks guys.

Hello all-- I am trying to schedule my Fiancee's interview and when I choose Moscow NIV it does not list an option for the K1 Fiancee VISA next to all the others; I thought maybe it would be under "Other VISAs" but when I go to the next page it's not there. What does this mean? We did specify Moscow on the I-129F as the place to interview. What are we missing here? I have attached a screenshot. Thank you for your help!

You need to choose immigrant visa, not non immigrant. After that you should see the K1 option. Then you fill out the info, put in the payment info, and wait for the embassy to email you saying that you can sign up for an interview spot. That means the calendar is open to them, not that there are spots.

Did it solve your issue?  If not, here are more tips you can try out:

    • Use your browser's private or incognito mode.
    • Disable browser plugins.
    • Use only 1 tab when filling out the form.  Do NOT have the form open on multiple tabs.
    • Press "SAVE" every time you finish a page of the form.
    • If the session times out again:
    1. Clear browser cookies and cache.
    2. Close the browser (not just the tab), wait a minute, re-open browser.
    3. Retrieve application and continue filling out the form.

Please let us know if any of these works to help you get around the time out issue.

I’ll try all of that, thank you!

And kind of a desperate move - if it works for your petitioner, have them fill out. Then use a screen sharing / video conferencing / remote control app so that you can click the final submit button even though it's on their computer.

I’m in Russia right now and I’m honestly wondering if it’s because of that that we* can not access it 😐

  12. Hi all,

So my fiancé and I wanted to start filling out the DS160 form to get it ready for when our papers will reach the embassy. However, after filling out the first page of info (i.e. name, birthday, etc.) it sent us to a "session timed out" page. I tried to retrieve the application with no luck. When I input the information, it said that the surname and birth year were incorrect. After that, I got frustrated and tried to start a new application. I got the new application number, and then it sent me back to the "session timed out" page. I tried to retrieve THAT application and the same thing happened where it said that the surname and birth year were incorrect.

Am I missing something obvious here? Does anybody else have experience with this?

Thanks for all of the help.

Lol, what about us lucky women who married Russian men? :content: We're in the minority I know but we're also quite lucky to have men who still believe in chivalry towards ladies and buying flowers on all occasions...unfortunately no 24 hour flower shops here like there are in Russia, though. Such a pity.

I’m engaged to a russian man and he’s the sweetest. :) I consider myself very lucky.
