AOS from non-immigrant visas unfortunately is abused by many. And with that I mean that the couple/individual already knew that they were going to adjust status once they were let into the US. And for others, the circumstances genuinely changed and they have every right to adjust status .

For the people who abuse the system, I feel a lot of comfort knowing that the adjustment of status process is not fun at all. As much as these people think that it is awesome that they managed to stay in the US, they will soon realize that not being able to work or leave the US isn't that much fun after all. And then we see posts like "how can I expedite?", "I need to expedite because we have financial hardship" or " I need to expedite my AP because I need to attend XYX in my home country" .

As much as I tell people that AOS is not the best invention since sliced bread, they won't listen and underestimate how challenging the process is. I wouldn't want to trade places with them.

Better to be crucified by folks on the forum than by Immigration Officer during stokes interview!

She could come to study, she just cannot be 100% sure she will be marrying and staying in the US.

While I see your point, I do not agree with you fully.
    - AOS and CR1 take about the same time nowadays.
    - If AOS is from B1/B2 the beneficiary cannot work legally in the US for a while, and fully depends on the US spouse. At least the beneficiary usually can work back in their country while waiting for CR1 visa.
    - Beneficiary going through AOS usually cannot travel anywhere outside of the US for some time, even for emergency. Beneficiary waiting for CR1 visa can take trips anywhere other than US (and sometimes to US) freely.
    - AFAIK consular interviews are much shorter than AOS interviews at USCIS local field office.
    - CR1 applicants do not have to worry about immigrant intent, whereas some AOS applicants go through increased scrutiny and have to prove they did not plan to adjust.

Of course, there's many downsides to CR1. But to suggest AOS is walk in the park and doesn't have any downside would be unfair.

You guys!! So I had my n400 interview yesterday, the appointment was at 10.55 am and we got there at 10.12am and by the time we were allowed in and through security it was about 10.30 ish, they called me about 5-10 ish minutes after 10:55, it was pretty light very few people, after the officer sworn me in he asked me to produce my dl, passport, social and gc, verified my info and then we did the civics test, passed, we did the reading and writing and he told me I passed, we did did the yes and no then he asked for the taxes, trips and marriage certificate just because my passport still has maiden name and said that he sees that all the time and I agreed my country makes it really hard to change your name, he actually looked through my i751 packet that was sitting on his desk (all my colored folders were in a huge folder lol), I told him my husband was out there waiting in case we needed another interview for the i751 and he said that he was approving my n400 but he didn’t process i751 so he was going to fwd to his coworker to look at it and approve it but he did want to meet my husband when we were done, he verified the info that is going to appear on my certificate, explained the oath ceremony and said that I was going to be notified as to when the oath ceremony was going to be and where, he walked me out and I called my husband over, coincidentally they grew up in the same neighborhood 🤣 and they had a little chat, shook hands we thanked him for his time and left. About 1/2 hr after we left i751, later that day the n400 went from ‘interview scheduled’ to ‘we recommend for approval’ to ‘we placed you in line for oath’ and this morning it was finally scheduled, I checked online and is in a couple weeks 🎉🎉 this road is finally closed and I’m hysterically happy 🎉🎉 I will come back to update y’all on how everything goes after citizenship and document updates like ssn, dl and finally passport 🤗 I wish you all the best of luck and a speedy process and next 4th of July we can all celebrate this great nation like true Americans 🇺🇸🇺🇸🇺🇸

We did it at 2.9.  We're hoping to see some movement on our case in the March-April timeframe but who knows?  We have our eyes on Boston filers who have filed as far back as August.  Nobody has reported an interview date yet but maybe we will start seeing a pattern in the first couple of months of 2023.

But when you see others are getting their interview notices it’s hard not to!! 😄 The waiting is the worst part right now.. if I had the interview date, even if it was 10 months out, I wouldn’t mind! It’s just the not knowing that is killing me lol! It would just be nice to know so you can plan and get situated/ready for the thing!

    Had my interview today.
It was one of the first ones of the day, so we didn't end up waiting too long. The IO was really nice and personable. He conducted the I-751 interview first with my spouse. Asked us a few questions about how we met etc. Then asked me a few questions about her family. He approved it and we gave a few updated bank statements etc. as updated support. He then moved on to the N-400 interview, my spouse was able to stay in the office. He asked me 6 civic questions (got them all right) and then I had to write out one sentence. He asked a few questions from the Yes/No list and then had me confirm the spelling of my name etc. He said I've been approved, but he has to approve the I-751 in the system first before he can approve the N-400 so I will see the status change online and will be mailed a letter for my oath ceremony.
Can't believe this journey is (almost) over.

If you really live in NYC/NY she didn’t have to leave. You can’t just kick someone out, you have to go to housing court. I wish she would come On visa journey so we can advise her. You clearly are abusive.

You have no "leverage". In New York, it's illegal to evict your spouse. She did nothing wrong in refusing to leave. Breaking a mirror with a baseball bat is a form of domestic violence. Now, you're gaslighting and bullying her. It's not disparaging if it's true. The best thing you can do is divorce her and let her get on with her life.

many have been in your situation. Cheating does not mean immigration fraud. A few things below...

    1) it is in your best interest that she is financially stable so you don't get sued over I-864 or alimony
    2) it is in your best interest that she becomes a citizen so you are off the hook for I-864
    3) You are salty now. Take the high road, get divorced amicably and seek happiness. Let her handle the immigration stuff.
    4) You already provided a boat load of evidence of the good faith marriage. You can't change the narrative unless you have evidence where she admits to marrying you for immigration purposes. Even then you will have a tough road proving it.

Very excited to share an update on my case (Milwaukee WI) - interview has been scheduled!
    Timeline:
    - Elegible to submit N400 application: Aug 18, 2022
    - Submitted N400 application online: Sept 15, 2022
    -  Interview was scheduled notice: Nov 11, 2022
    - Interview date: December 20, 2022
    * no updates on my I-751 in over 12 months, not sure what to expect on that.
Wishing everyone else good luck! It seems unbelievable that this could take around 3 months after how long everything else has taken.

    Hi Sellamalola,

My apologies I didn't get back to this thread when I completed my N-400 interview.

So that N-400 interview happened as scheduled, I brought my husband to the appointment but the IO declined to accommodate a combo interview on the pending I-751.

I passed the N-400 interview and was given Form N-652 Naturalization Interview Results.

I got checked for passing the English test and the U.S. history and government test, and Congratulations! Your application has been recommended for approval (At this time it appears you have established your eligibility for naturalization, if final approval is granted, you will be notified of when and where to report for your naturalization ceremony).

After the N-400 interview the IO told me that she will look into the I-751 A-file and if everything is in order, there should be no need for another interview, and I should look out for the oath-taking invitation in the mail.

Interview consisted of confirming N-400 information, then the naturalization test, 5 civics questions, a one-time English writing exercise on an iPad (write what the IO says), then the declaration part with Yes and No answers. Altogether the interview took less than 15 minutes in and out the door.

It is now roughly 2 weeks since the N-400 interview, and my online account still shows unchanged status of I-751 and N-400 applications.

Its not unreasonable to expect that there is going to be some more waiting time, after all my GC extension letter doesn't expire until October 2023.

But it would've been nice if all this is behind me so life can move forward to intended goals, like more meaningful and fulfilling work.

    Cheers,
    G&A

I travelled abroad on an expired GC with original copies of the extension letters.

No issue at return check in counter, airlines know about this.

No issue at US port of entry as well.

    Go ahead make that trip.

My I-751 status has not changed 488 days now and is still at "Case Received". My documents are in LIN.

I went for an N-400 interview two weeks ago, and while the IO said I passed the interview, I will have to wait for the an invitation to take the oath because my I-751 still needs to be reviewed.

So, if you are eligible for naturalization, it's all online, and you have 30 days to finish an application from starting the process. You can upload as many evidences as you wish including unsolicited ones.

    Hope this helps.

    Cheers,
