Katie and Mark reacted to pushbrk in Can you switch from k1 to cr1
We don't know what he SHOULD do, because we don't know his needs and priorities. He has choices. He'll need to make one.

Katie and Mark reacted to tinerich18 in Leaving on a K1 visa? CAN to US
I was also told by a CBP officer when i crossed the border from Blue Water Bridge last December 2018. I am a K1 visa holder too. I asked for a i-94 but the officer didn't give me, and he said the stamp on my passport is same as i-94. Is that true? Now, when i retrieved my records online for my recent i-94, it is not recent. The record shows only the time when i was in the US back April 2018 but my travel history shows my entry last December. Is there anyone has the same case with mine?

Maybe the officer is referring to this? Or maybe I am grasping at straws? Lol

Re-entry to the US is always at the discretion of the CBP officer--the one you spoke with sounds like he/she would allow the back and forth until you are married, but given the laws, some CBP officers may not be so kind, as some are more strict than others. It would be risky to try what you are asking about since you don't know which officer will ask you questions and interpret the law to the letter. The advice here is good, don't risk it, as you could be stuck in Canada with an invalid K-1, unmarried, and have to start the K-1 process all over while you wait in Canada for a year, or get married in Canada, then file for CR-1 and wait more than a year. I have crossed between Canada and the US hundreds of times, and sometimes the CBP officers can be difficult, other times easy. My advice is don't take the risk. Enter the US on the K-1, get married, and file for AOS/EAD/AP, and after 4-6 months in the US, you should get EAD/AP card and be able to travel anywhere after that. Good luck!

Forgot to update this.
For anybody stumbling upon this post, I was admitted, after spending several hours at the border crossing waiting while the super polite and helpful officer was running around to get approval from higher instances. He also called my fiance to check if the wedding was still a go. I had the marriage license with me as well as the print out. They did not care about the print out. After the approval came, my car was thoroughly inspected and I was on my way.

The first CBP guy might be confused because you're Canadian and he thinks you can use the Visa Waiver Program to come back. While that is correct (assuming the CBP allows to you come in the second time), you will no longer be in K-1 status. Hence, you can't AOS, at least not without a I-130 as spouse of US citizen anyway, and there will be all sort of issues. The best course of action is to get married as planned, file AOS along with EAD and AP, wait until AP is approved then you can travel all you want.
People also often get confused about the marriage requirement. All you need is the paperwork, takes a day or two at the local county office. You don't have to have a big wedding, or any wedding at all. Just get legally marriage and file AOS to satisfy the legal requirements and start the clock. The wedding can be later down the road.

I have no idea why ours came up free. We just got the privacy act check from Deer Lake Ave RCMP office in Burnaby BC. So if anyone out there lives in Burnaby, that office is the ticket for free privacy acts! lol

Yes I would still get both the certified criminal record check with fingerprints that states for immigrations purposes and the Privacy Act criminal record check. I got my certified criminal record check through Gambit ID and then I went to the Commissionaires in Toronto to get my Privacy Act check done. (Although you could probably get both through the Commissionaires) The certified check took a couple of weeks to get and the Privacy Act took 9 days to get.

You pay your interview fee and medical but the invoice number is used only once to register and sign onto scheduling your interview at the designated portal that your Embassy uses. After that, never to be used. No payment need for the case to be sent from NVC to your Embassy.
For all things dealing with the US Embassy in Canada head on over to the subforum for Canada where they will answer your questions for the processing of your visa from their personal experience. Link:
http://www.visajourney.com/forums/forum/93-canada/
Get the Canadian K1 P3 letter at http://photos.state.gov/libraries/canada/303578/montreal/Packet3-K1-MTL.pdf as this is your bible needed to complete and receive your visa. The required documents are included and use the P3 as a check list. Once you have completed or gathered the required documents you'll be ready for your interview. If it is not on the Embassy letter, it probably is not needed.
Last but not least, READ the pages on the US Embassy website for you country so that you are up to speed.

You can't hurry it along at all. You have to wait for P3 which takes 2-4 weeks from Ready. Comply with what they ask for in P3 (the actually one they send you) by sending them a copy of the signed P3 checklist, your DS160 confirmation and your Passport Bio. Then they send you P4. Then they tell you to register to schedule and you'll wait some more for interviews to open up, which only happens once a month during the last week of the month for two months ahead UNLESS you are lucky and you scoop up a cancellation. Get your medical appointment first so you can schedule the interview shortly afterwards.

It took about 2 weeks for my packet to arrive at NVC.
One trick that seems to work is to update your e-mail address (even if it didn't actually change) with NVC at this link: https://travel.state.gov/content/travel/en/us-visas/visa-information-resources/ask-nvc.html
Once they receive your packet, they'll usually e-mail you at that address that they received your information, and some people have reported that NVC even e-mailed them their case number that way (though mine didn't, so your mileage may vary).

We just received our NOA2 last night through email notification (action had been taken on our case) and the link was to the new website, I haven’t checked the old yet. But definitely crying tears of joy after waiting for this moment and checking obsessively 20 times a day
We are
NOA1: March 1 (old website)
march 6 (new website)
NOA2: Sept 13
Good luck to everyone !❤️❤️❤️ Maybe we will see tons of approvals today since the last poster wrote of an email notification as well 🤞🏻 My fingers are crossed for all of you!
