Common law marriage generally means you do not purchase a marriage license or receive a marriage certificate though… where (which state) are you planning this “informal marriage” … are you going through the county/ city hall or?? And make sure you have enough for about 12 months of no working… although some adjustments are fairly quick (2-3 months) other members have had bad luck adjusting from a tourist visa/ ESTA and unable to drive or work for 12+ months…
  2. @sonnyboy0323 K1 vs Spousal is a personal choice. But, be aware after April 1 fees are going to increase. You should also educate yourself on what will happen after you file the K1. I believe processing times have sped up for K1 (which is a positive). But once your fiancé arrives in the US you will have 90 days to marry and file adjustment. The cost for the green card will be $1540. If you want your partner to have the ability to work (and in some states drive) or leave the country while waiting for the green card (which can take up to a year or even longer) you will have to pay a separate fee: $260 and $630. But, some people receive the green card before they receive work permission or ability to travel while AOS is pending so you will have to once again deal with USCIS and their inconsistent and capricious processing times. If you don’t have any plans to see your fiancée in the next couple of months though I would personally file K1… just prepare yourself for every step of the process and it can be exhausting and very expensive.
  3. What do you mean by informal marriage? Many K1s will have a small court ceremony (sign paperwork) and then file for adjustment. My husband and I went down to city hall and got married without any friends or family in attendance. We didn't go the AOS route but the type of wedding we had never came up during my visa interview. You entered the US on ESTA so one would hope you didn't plan a massive wedding before AOS because that would be a display of immigrant intent/ a plan before entering you planned to get married and adjust. As long as your marriage is recognized by the state and you have a marriage license/certificate you should be good to go for USCIS.
  4. US might consider the second entry as the same trip. So you might not be allowed to re-enter the US (how long is this going to take more than 6 months?) I personally would not go to Jamaica with the family after spending a few months in the US after getting married. I would get married then go back home.

  6. Job offer should be sufficient for proof of domicile.especially if the USC will be moving back to the US after DCF is accepted and before beneficiary has their final interview.
  7. Have your future spouse to be investigate what is needed from the county you’re getting married in… marriage is governed by states it isn’t federal. For Michigan, all I needed was my passport. once you have your marriage certificate you can file the I130 and I130a… ETA if you both live in Canada why California? Why not get married in Canada?
  8. I believe you need to finalize the adoption before your husband can sponsor your sister/ daughter. Additionally, your sister cannot be added to your interview/ petition. She will have to be petitioned with her own I130. @Family do you have anything to add? i would also look into hiring a lawyer to help you with this if you are having issues understanding the requirements to sponsor the sister you plan to adopt.
  9. If you live there for more than 6 months you might have to produce a police certificate. If you are living in Mexico you will need to list that address on the DS260. But, you can still interview in London/ you will be automatically assigned to UK and you don’t have to inform USCIS while the I130 is pending.
  10. 7 weeks is a lot of time. If you have the chance to see her again before her interview, I would visit her and have her take that evidence to her interview. Good luck with your journey.

  12. You should expect the interviewer to ask your current wife about your past wife. This might be a red flag. No one can say for certain though. You should tell your wife everything about the marriage that ended in divorce and if any of the same “flags” with first marriage are also in the second marriage I would be worried…
  13. Is your ex wife from the same country as your new wife? Did you petition your wife for adjustment of status (inside the US) or for an immigrant visa (consulate interview)? Interviewing the petitioner is highly unusual when the beneficiary is overseas… even more so is separating spouses at a consulate interview. You might want to consult with a lawyer to figure out how to get the records of the old petition because the consulate might ask your new wife about the old wife and any uncertainties could impact this new case.
  14. Once the I130 is approved your case will go to the NVC. At that stage you can inform them you want to change the interview location from Nigeria to UK. You don’t have to do anything to while the I130 is pending. Instructions here If your petition is being processed at the National Visa Center (NVC), contact the NVC to request the transfer. NVC will transfer cases to another IV processing post if parties provide a written request along with the address in the requested country and the proof of eligibility (citizenship/legal residency in the requested country or other documentation). This can be provided at https://nvc.state.gov/inquiry. In limited circumstances, NVC may need to contact you for additional eligibility requirements. Note that transferring your case might not result in immediate processing as cases are processed in order based on the date the case became documentarily qualified.
  15. We got married 3 days after I entered the U.S. We applied for and I received my immigrant visa a few years later with no issue.
  16. Financial support and the I864 approval is up to the discretion of the consulate. You can reply to the 221g with the rule you posted and see if that will work. But, consulate might not believe the income from the two shops is reliable. Was the $75000 the salary the beneficiary was paying herself or was it profit? And where are the shops based and is there proof you will be able to maintain ownership and control of the two shops after the move to the US? You need to build a strong case indicating this income is reliable.

  18. This is a tricky time for applicants. it appears as if some consulates want the updated taxes when the interview is around April/June and others don’t. I would read reviews of interviews done last year in London around this time to see what others did. For our case, we filed taxes and submitted them to NVC as we wanted the consulate to have the most up to date information and head off any 221g after interview.

  20. You’ll need to check if the consulate out of Slovakia or the consulate that serves Slovakia processes DCF. Not all do. If you cannot file direct through the consulate you will have to file two separate I130s one for your child and one for your spouse. Adopting a child does not automatically confer US citizenship on a child. @Family might have some tips for you regarding sponsoring an adopted child. When it comes to domicile and adequate financial resources you have about 1 year from filing I130to completing/requiring that documentation. How long has the child been in your custody?

  22. For France, UK and Ireland? What is the common travel area? And please show the link that indicates if a Filipina applies for an Irish visa they do not have to obtain a UK visa... I can see the link indicating the opposite is true for traveling to Ireland after going to the UK...
