  1. They’re going to assume your gf just wants to move to the US. Anything that makes it seem like she is really desperate to get here is a red flag. So, don’t get your hopes up.
  2. Unless you have a good reason to expedite… I wouldn’t try. “Because I want to see my boyfriend” is not a great reason and could greatly increase a denial.

So, if she is coming to the US more to see you then study English it COULD lead to a denial as they will assume she is going the F1 route to circumvent the B1/B2 visa wait times and k1 AND spousal visa wait times. Totally understand WHY you want to go the F1 route. Personally, I visited for several years before agreeing to move to the US but then again I moved to ANOTHER country sight unseen so... you and your partner should assume the visa will be denied and plan either to visit in Colombia and other countries until you are ready to take the next step- be it break up or get engaged/married. If you know you want to get married and be together forever you can start the process now as it will probably take 18-24 months.
  4. Here is the approval rate of F1 applicants out of Colombia. Not quite sure how accurate it is... 65% in 2022. When your girlfriend comes to the US to study where does she intend to stay and how long does she intend to stay for? This will impact her ability to successfully obtain a visa. Has she traveled to the US to visit you/ have you met before? ETA: How good is her English and is her main reason for studying in the US because she wants to be with you OR because she wants to improve her English?
  5. There is a show on American TV right now called "Prison Brides" women from different countries come to the US and marry their US citizen husband. It is not illegal and you will most likely have to organize things before you arrive to get married in prison. You might want to look online for groups of foreign women who are dating men in prison for more guidance on the process.
  6. Here is a case out of UK where someone had a similar issue. Your partner needs to start documenting their sobriety and remain sober for at least one year. IF they are already sober get evidence of when the sobriety started. ETA You might want to consider getting married and starting the CR1/IR1 visa process if you know they will have to continue living in the UK for another 1+ year. But. speak to his doctors and start documenting he no longer has an issue with alcohol.

  8. Sorry! Autocorrect- it was supposed to say PARTNER! The K1 takes about 12 months but might take more. So, maybe try to have them visit you in Slovakia.
  9. 3 months is a lot of time! The K1 process can take over a year though so you might want to see your letter again before your interview. Additionally, depending on the consulate 2 weeks together in person is sometimes sufficient for the K1 to be issued although other consulates require a lot more face time. Where are you from?
  10. When was your first entry to the US? January 2019 or 3 months later? I’m confused if you entered the U.S. and then went back home for three months or if something else happened. Although I assume your 5 year anniversary is January 2024 and you are filing for the N400 a few months after the resident since date? Can you confirm? @Verrou is right though. You use the dates where you physically resided after activating the immigrant visa not the address you used for GC… Where did you stay when you first landed? ETA You answered my question while I was typing. I would personally apply on the day I arrived to LIVE in the US not 89 days before… but I’m fairly cautious (this way you don’t have to list the foreign address)

  12. It sounds like you’re doing everything right. And I just want to clarify you might not have 6 months AFTER the interview to prepare for your move. The visa validity date is based on the date of your medical. So, you will have 6 months from the medical to enter the U.S. After the I129F is approved you will wait for your case number/ for the case to reach the consulate. Then you can schedule your interview and medical appointment. You generally have 4 months from NOA2 to schedule the appointment. I believe you don’t have to worry of the interview is scheduled after the 4 months have passed- as long as you take some action on the approved petition (eg scheduling the interview or reaching out to the consulate if you cannot schedule the interview for various reasons). Generally, the petition is auto extended for another 4 months…
  13. Speak to your partner about setting you up with a good understanding of where you will live. Do they agree you don’t need a car to get around in your area? Do they think you don’t need to work for potentially 12 months/ you both can live off savings and one salary for a year? … You might want to cut costs and not pay all the filing fees BUT think about the potential of being able to work and travel while waiting for your GC. This is what you should be doing with your time. Thinking about the various scenarios when you move to the US. COL, occupying your time while he is at work… can you study with no EAD? Good luck! Moving to the US can be a struggle but with a supportive partner and realistic expectations you’ll be able to manage.

  15. When my documents have been to big, I rescanned all the documents at 150DPI. Also look at resizing all your photos. maybe 2-3 photos per A4 page and then compress the photos(lower the quality). It can be done and if you want to move to the US on the K1 you have no choice but to resize the photos so you can submit.
  16. It can be incredibly difficult to move the K1 visa to a different embassy but it can be done. Currently K1 timelines for Australia can be found here: A member who filed February 2022 had their interview in November 2023… Another member filed in April 2022 and had their interview in November 2023. Latest timeline December 2022 filing and interview February 2024. Add another 4 months to the process if trying to move the interview location- although it can take longer. Process for moving K1 visa here: If you are requesting a transfer for a K Visa, the receiving Embassy or Consulate has the discretion to approve or deny the acceptance of a K visa application from an applicant outside the consular district. Contact the potential gaining U.S. embassy or consulate in writing to request a transfer of your case and include the reason for the transfer request. If you paid the MRV fee at the original post and the transfer request to a new post is subsequently approved, a new visa fee will be required.

  19. You need to think of USCIS NVC and the Consulate as three different entities. With three different timelines and all three timelines are constantly changing. I believe only Sydney deals with immigrant visas but I could be incorrect @Lil bear can you advise? And you have to keep an eye on the timelines for NVC here: https://www.visajourney.com/forums/forum/83-national-visa-center-dept-of-state/ You could definitely start the NVC process while in Australia. You might not want to complete it before you leave OR you might not have a choice. I don't know enough about your planned stay in Australia or where you will be based but research all steps of the immigration process to the US to make the decision that is best for you and your relationship.
  20. I-130 takes about 1 year to approve. Then you will move to NVC which can take 2-3 weeks to 3 months (more if NVC requests additional documentation). But, if you want to move the interview from London to Sydney that would extend your time at NVC. Once documents are accepted you will wait for interview. In London, interviews happen about a month or two after DQ... Sydney... see this post You might be waiting an additional 5 months... So, plan on the process taking 2 years or more. Be aware, you can keep the interview location in London and just "pause" the process at the NVC stage. One of our members has put his move to the US on pause for various reasons. The great thing about the CR1/IR1 visa is that you can "slow down" the process if you want...
  21. Yes. It should not matter that you’ve been married for 5 years. Especially if your state is one that allows name change with marriage certificate even if the new name is not on the marriage certificate. Which state do you live in? Also, your wife will just need to travel with passport, green card and marriage certificate when leaving and entering the U.S. Many AOS applicants deal with this issue every day.
