Drug charges are a very specific issue with USCIS. From what I understand you dont need a conviction to be denied and they can deny you if its suspected you are a drug trafficker. . If any immigration officer "knows or has reason to believe" that a person has been involved in trafficking in controlled substances, that person is inadmissible to the United States. This includes individuals who aid, abet, conspire, or collude with others in illicit drug trafficking. I think its a good sign that you are getting a second interview and I do hope you are successful!

We’ve been in AP since mid July when we had appointment and submitted document requested. After a couple of initials updates there was nothing until the end of October. We’ve had five since then the last of my November 14. Still in administrative processing. I think they’re just passing our document around because nobody knows what to make of it. Its a long file that shows my husband was completely absolved of a crime he was falsely arrested for.

I have noticed that everytime i send an email or i call to ask about my husbands case, the date on CEAC website gets updated. I think its because every call or email they receive they have to open it to check and it gets updated itself.

Congratulations though you need to start preparing your mind for another agonizing wait between NVC and consulate to provide an interview date. The wait won’t be up to the USCIS wait but seem more frustrating. Good luck to us all.

I contacted an attorney to make an inquiry. She has to email twice, then in 30 days with no answer, she can do a request through LegalNet. Then another 30 day wait before they “have to” respond. you might be able to do this LegalNet yourself. Check it out on the internet. I did everything myself before and don’t have the time and patience to figure it out myself.

Sooo happy for you, my fellow islander on this crazy visa journey! I know how absolutely frustrated you sounded in the spring and have been waiting to hear your good news I knew would come- now you’re finally free to go live your lives together! 😘

I've been wanting to write this for SO long!

After 10 and a half months stuck at Nebraska, two months in NVC and almost six months waiting after our CC to get an interview, it finally happened!

My interview appointment was stressful. There even was a point where the supervisor approached the officer and they closed the microphone. I thought I was going to faint. My case was a bit complicated and it looked weird on paper, but after explaining what happened things started to get a little better. Overall it took me 3 hours (two hours waiting and one hour of questioning!) but I fully understood it's their job and they just had to make sure everything was in order. Everyone was very nice and professional, and even being Juarez I've never felt unsafe. I have honestly nothing but nice things to say about the U.S consulate and even though the process is incredibly draining if you play by the rules and follow the requirements it's not that bad.

561 days of documents, tears, long distance, money (oh, the money) the uncertainty. It was incredibly worth it just for this moment! to hug my husband waiting for me outside and dance with my little green paper.

Thank you SO much, everyone, for helping me throughout the process. I couldn't have done it without you, since you helped me not only be prepared for the process but stay sane after it kept taking longer and longer. I am also aware it didn't take as long as others and it wasn't the most complex situation, so I'm counting my blessings and I feel very lucky that overall things went smoothly and I get to drive back with my love to Texas and start our lives together, almost two years after getting married yet so ready to start from scratch as newlyweds.

I wish you all the best on your journey! you deserve to experience the same joy I'm experiencing.
    ❤️ Lorena

Unfortunately this is a long process and it is what it is. It’s a good sign they kept his passport but you won’t know anything until they make a decision. Send everything they asked ASAP so you’re not waiting longer and keep checking ceac.

Don’t be surprised that USCIS had access to that. There is nothing USCIS can’t find. They’ll know before you even know. I hope your husband didn’t lie about it in the forms prior to interview. If he did that will most likely end up with misinterpretation which will make him ineligible for a visa to the US. Drug charge is a pretty big deal with USCIS, regardless if it wasn’t his fault or not. The point of the matter is they charged him. It is my understanding that any drug charge will require a waiver and some kind of temporary ban if disclosed of right. Now again I don’t know if your SO other lied or not on the forms, that will basically be the deciding factor on this. And yes, the questions are there on the forms, before interview. You need to submit what was requested ASAP and let it play out. It will be in AP until they reach a decision and there is no way on knowing how long. Every case is different and you can’t compare. Try and find out more information about how your SO filled out those forms and you may have an idea of how this will play out.

Yes, I well understand the marrying problems. 11 years ago in Mexico it was very hard for us to get married unless I stayed for two months, which I couldn’t. We opted to go down to Belize and get married. It was made easier in Mexico not long after that, but it was probably a similar situation as you would have experienced trying to marry in Germany. Best of luck!

Responses were in no way an attack to the reason or why you would it. Also if a user on a web forum who is more open minded, has gone through the process, knows the rules etc...Is reacting in a certain way what do you expect from a CBP officer who possibly has never left their state forget country, or visited various countries. Responses like that should seriously help one consider what they planning and how to prepare.

USC doesn’t get questioned on whether they’ve maintained residency when they return, Ive had this happen to me after a 5 month absence, trust me it’s not fun. It’s even more not fun if CBP decides you’ve been doing it too often and refers you to an immigration judge.

OP, it’s not quite as simple as figuring out what the 6 months is. There are two main considerations:
    - as a resident you are expected to spend more time inside the country than out of it. You may want to look up some of the uscis info sheets on LPRs traveling abroad, where they talk about time out and the kind of evidence you need to show you’ve maintained residency. Examples https://www.uscis.gov/green-card/after-green-card-granted/international-travel-permanent-resident   And https://www.uscis.gov/green-card/after-green-card-granted/maintaining-permanent-residence
    - a single absence of longer than 180 days breaks your continuous presence requirements for naturalization and resets your clock to next entry.

Reach out to ATT in the U.S. first, getting clear instructions as to which network, if any, you will need to switch to in Juarez. If all else fails, as soon as you arrive you can try getting assistance from a ATT Mexico Customer Center manager in Juarez.

They are legally two different carriers, but should be able to assist you.

I have ATT Mexico and had to switch networks when leaving Tijuana for Mexicali which are both in Baja California.
