So this is all the fault of the employer?  I agree, employers that hire illegal aliens should be prosecuted.

The murder is the fault of the murderer, he took someone's life.

However, I'm inclined to believe that the accused would not have been there if not for being offered work and employment. I'm just wondering why there's no focus here. People seem to have escalated the blame game, so now, rather than fault being with the individual who decided to take someone's life due to being rejected, the focus is now again on illegal immigration, but quite clearly, this guy was not surviving off of free bread and water; am I correct? He was able to survive in America through being "employed"? I think if people are using this even to bring up immigration, then you need to also bring up the fact that US citizens are "employing" the undocumented workers, and that this is not an accident.

It would appear that the idea a woman should be punished for refusing advances, is more than a problem with immigration. This is global. So, should this be a separate conversation, or do we actually get to the root cause of why USC's have an issue with their current immigration policy? Where does the accountability sit with this issue?

In the UK if you are found to be employing someone without the correct right to work documents, it only carry's a fine of £20,000. Is there something similar in the US? Would more severe punishments effect the economy maybe, is there fear around shutting the whole thing down, despite the media campaigns focusing on illegal immigrants? I definitely feel like perhaps your government is voicing one opinion, while not making many attempts to solve the real problem. Or perhaps, just doing a little bit to appease the masses. What do you think? Does more than one entity share the blame for this issue?

From an outsider looking in, I believe your government is aware of the working patterns and trends of undocumented workers, and their whereabouts. So why aren't employers being held accountable for encouraging this? Maybe they are, but it's not in the media, so who knows. Perhaps someone here is able to shed any light on this?

I'm not naive enough to think that the media shares the whole truth, but again, as the outsider, I see a lot of time, resources, and money, being spent "capturing" and "holding" illegal immigrants crossing the boarder, and not much into cracking down on what, and who allows them to remain. One could even go as close to saying that, a lot of rich people benefit from these illegal immigrants / undocumented workers, and no one wants to hold them accountable.

I'm not sure where I was really going with this, it just triggered some thoughts. :)

I see this is a copy and paste... I'm rather asking for other people about what had they done for NOA 2.

I'm the petitioner. The interview is several more months away as far I'm aware, or does the interview come before NOA2?

you the petitioner don't need to do anything further except for the affidavit. you get your approval notice (noa2) before the interview. however you may need to get tax returns to prep for your fiances interview as I don't know how long that takes, or which consulate the interview will be at so may not be required.

My case status on CEAC is NVC, but the text below it mentions 6 steps I need to follow.

I followed the link (https://travel.state.gov/content/travel/en/us-visas/immigrate/the-immigrant-visa-process/after-petition-approved/begin-nat-visa-center.html) to the instructions of the 6 steps and it has the following:

Is this normal, and do we need to actually do these? The first stage mentioned DS-261 but we need DS-160 right?

If you are K1 You don't need to do this, it's just a general message. just keep checking your status for when it changes to in transit. Once it is, you can do the DS160. And if you've got your case number already you can book your medical.

EDIT: http://www.visajourney.com/forums/forum/99-united-kingdom/ - UK forum as lots of this info is over there already :)

My fiance had an MMR done today and a Tetanus. His medical is scheduled for the 13th of September at Knightsbridge. The clinic said he has to come back on the 21st of September for his 2nd dose of the MMR. Is it worth it for him to go back and have the second does since it is after his knightsbridge medical? Will this affect him in the future when we apply for permanent residency?

He will need the second dose, try to reschedule the medical.

Edit: sorry should give more info, while knightsbridge may say this okay, they won't be able to sign off the vaccination sheet they give to you which you need for AOS, and this has caused problems for people when filing for AOS if they haven't had it. without it the medical may not be seen as not 100% and he may need to redo the medical which delays things and costs a lot more. @Wuozopo will probably know more though!

I been asking the same question after being ignored so many times. I taught we were a support group. So my fiancee went for her interview on July 25th..The C.O asked few questions kept all of her official documents(copies not original), returned her passport and told her she will be contacted in the next 60 days. So far she been in Administrative Processing. Each time i emailed the Embassy i am been told that i will be contacted or she will be soon. This whole process has been crazy and stressful, i don't know if anyone had some almost same experience to share with me. i just need to know where we are standing in the process...

Have you tried the regional specific forum? http://www.visajourney.com/forums/forum/89-africa-sub-saharan/ the AP times are different at each consulate I'm afraid :( I hope you find what you are looking for!

Hello, we've submitted the I-129 form a few weeks ago and got the NOA 1 and I'm waiting for the mail piece.

I'm interested to know what are the other - NOA 2 - things that I should be able to prepare?

I appreciate any feedback. While I do understand most cases are different, I just hope things go smoothly without having to wait until the last min to rush it all.

Are you the petitioner? If so, where will the beneficiary have their interview? Different consulates require different things.

  7. Hello,

I have read recently that sometimes these delays occur, as at USCIS they do the initial background checks. The response time is dependent on the country of the beneficiary. Try to keep it mind it may not be that there is something wrong, it may be that there hasn't been a response from your home country with regards to the background check, or they have been able to complete this part right now. This may take a bit more time than other countries. I hope you get an answer soon.

    Roel and Greenhaum,

Thank you very much for your comments.

I understand that USCIS is just checking if required documents are included and scanning them.

I read many comments saying that people sent many pictures with I-129f and this made me really concerned.

I was not aware that proofs are not essential at this time. Yes, I am going to bring pictures for the interview.  Thank you again!

You have to submit evidence of meeting in person within the last 2 years prior to filing the submission. This is why people send photo's. Unfortunately at this point it sounds like you may have not read the I-129F instructions issued by USCIS in terms of what's required to be sent with the I-129F, and you may receive a RFE. At which point you will then be able to send in further information. As mentioned above, you now just need to wait, but your concern is valid. I hope the process moves quickly for you.

That was my fear, I didn’t want to be waiting unnecessarily and it end up dragging on even more.

Thank you for your reply. I think I will do the form today and go from there. Hopefully it allows me to book 🤞🏼

    Have a great day!

No worries! Something I found out with the DS-160, it asks you to upload your photo at the end, but if you go through the steps and don't upload anything or it says your photo isn't good enough, then it will continue without it :) Have a great day yourself!

  10. You can't book the interview without first completing the DS-160, as you'll need your DS-160 confirmation number to book the interview. Sometimes your case is ready digitally, and sometimes it's not. In my case I was able to book my interview whilst my case was in transit. If it's too early, it simply won't allow you to proceed. :)

I'm glad I didn't wait, otherwise if I did I would probably not leaving until well after Christmas at the rate everything is going!

    Hi :)
    Another question! Haha.

I've seen people specifying that at certain stages you need either US size/specification and UK size/specification passport photos and I wondered if anyone knows at which stage either is needed?

For example - With the initial I129-F I know that you need one of each of you, and I'd assume this is to the US size. Then for my medical or interview do I need a UK size?
Sorry if this is confusing I'll try and clarify if it is :)

    Thanks

US for I-129F and rest of the process. Medical accepts both UK and US :) join us here in the UK forum for UK specific queries: http://www.visajourney.com/forums/forum/99-united-kingdom/

    Hi Everyone,

We're currently between NOA 2 and NVC stage in the K1 visa process and I was wondering, at what point is it best for the beneficiary to hand in their notice at work and leave their job before eventual Point of Entry.

I have to give at least 1 month notice at my current job. I'm stuck on what to do because obviously I want to have as much quality time with friends and family before I leave, but at the same time I don't want to jump the gun and leave too early.

I'm also having trouble finding any information on how this affects the process, does it matter if I've left my job already by the time I have my Embassy interview, no I still need to be in work until after the interview? I really don't like the idea of having to wait yet another month after the interview just because of my notice period.

I'd love to hear other people's experiences of when they finished working before POE.

    Many thanks!

I was approved in the middle of may, London didn't even get my case until beginning of July. I had my interview on August 10th, Just getting my VISA today. Handed in my notice Yesterday for 4 weeks. You can still experience so many delays, so if you know you can support yourself financially until you end up getting a flight out, leave whenever you want.

They wont ask about your job, just when you plan to leave.

Edit: My last day is 21/09, flight out is 28/09

I am wondering if N/A or NONE is required for empty spaces. Instructions for 129F state N/A or NONE is required for empty spaces. I am very confused on this. Any guidance would help!

You can can use either N/A, or NONE, this is what it means. I personally left them blank as it makes the form easier to read, but if you are paranoid, then do as the instructions (which you quoted) actually state. Simply write "N/A" or "None", whichever you prefer.

I did not get an RFE.

    I have a few questions.

    1. What things do I screenshot in our conversations?

    2. How many calls?

    3. How many pictures? Do I get my fiance to sign the back of the picture as well?

I would recommend you read the I-129F Instructions, as it does not request conversations, or evidence of phone calls.

This is a long, and not so cheap process, so I would take care in doing required research before filing anything. For the avoidance of doubt though, here's the main things you are required to submit (other than proof of USC and other personal information that may apply to you):

Evidence for Petitions to Classify a Fiancé(e) as a K-1 Nonimmigrant

In addition to the evidence described above, you must submit evidence of:

    A. Intention to Marry Within 90 Days of Entry. Submit evidence that you and your fiancé(e) intend to marry within 90 days of your fiancé(e)’s entry as a K-1 nonimmigrant. Evidence of your intention to marry may include statements of intent to marry signed by both you and your fiancé(e) or any other evidence that establishes, by a preponderance of the evidence, your mutual intention; and

    B. In-Person Meeting. Submit evidence that you and your fiancé(e) met in person during the 2-year period immediately before you filed this petition. Evidence of this meeting may include, but is not limited to, a written statement from you and/or your fiancé(e) stating the circumstances of your meeting, a copy of airline tickets, passport pages, or other evidence. If you believe you qualify for an exception to the in-person meeting requirement, submit evidence in support of the exception. If you claim that the in-person meeting requirement would result in extreme hardship to you, submit evidence to support your claim. If you claim that the in-person meeting requirement would violate strict and long-established customs of your fiancé(e)’s foreign culture or social practice, include evidence that any and all aspects of the traditional arrangements have been or will be met in accordance with the custom or practice.

In short, submit correct evidence that you have met in person in the last 2 years prior to filing; this is proof of a relationship in itself. You're aim is to convince the adjudicator of your case that you and your partner have met in the last 2 years. Photo's with friends, photo's with family, photo's in different locations, passport stamps, flight itineraries, boarding passes

With regards to the passport photo's you need to submit 1 each, and using a pencil or felt pen, lightly print your name and A-Number (if any) on the back of the photo.

    I hope this helps.
