    Have your spouse filed 2019 taxes jointly with you (considering you got married last year)? If so, you are already considered a resident alien.

     

    If not, I would assume you will file jointly for 2020, so you can already fill the form as a resident.

    I entered the US last year as a K1, I have my EAD/AP but still waiting for my green card interview to be scheduled.

     

    I started my US job in March 2020 and so I had to complete the new 2020 W-4 form (hard copy). On it, it didn't ask for my immigration/residential status.

     

    After I got my first paystub I realised I had entered the wrong amount on the 'extra withholding' section. I can change the amount online via the company's ADP (system where you can access paystubs etc.). I started the process but before you can change the amount, it asked whether you are a non-resident alien or a US citizen/resident alien. On the question, it defines non-resident alien as an individual that is not a 'US citizen and do not meet either the green card test or the substancial presence test for the calendar year Jan 1 - Dec 31'.

     

    If I am a non-resident alien, there are special rules when completing W-4 form (ref. IRS Notice 1392 and IRS Pub T-15). Therefore I want to be sure I tick the right box. Also it isn't clear how much tax I will pay based on my salary as a non resident alien. 1) Is there a way to find that out? 

     

    2) Is it correct to say, I am a non-resident alien, although my green card process is on going? 

     

    3) On IRS, it states that you can treat your non resident alien spouse as a US resident. Does that apply in my case?

    Aw, this is amazing! You are one of the lucky ones. Let us know if you get your interview in Seattle or another office. 

     

    109 days since they received my RFE. No update on AOS nor EAD. A painful and long process but your update is giving me hope!

    It could be! I just had a look at Seattle timings, it is now 19-20.5 months, it used to be 11-25 months. Damn :(

    My RFE letter finally got delivered today. So relieved! It looks like the courier tried to forward it twice although we never asked for any letters to be forwarded :huh:

     

    and surprise surprise... RFE is for my (French) birth certificate although I already submitted the long-full version and with translation with my initial application.

    I-485 status got updated 14 days ago to "Request for initial evidence was sent". 
     
    On Thursday (last week), USCIS letter showed up on Informed Delivery, which I assume is the RFE letter. Despite being a week ago, we still haven't received it. I highly suspect it may have been lost, because we have been having problems in the last 3 weeks of mail not being delivered despite the mail showing up on informed delivery. 
     
    We have contacted USPS and waiting for their reply. In the instance they can't find the letter, what is the procedure to get USCIS to resend it? I found this form on USCIS https://egov.uscis.gov/e-request/displayNDNForm.do - could this be it? 
     
    Anyone that has gone through this situation?

    I'm completing the latest form I-131 and this part of the form confuses me: 

     

    At the bottom of Page 2, first half of Part 3, it says: "If you are applying for a NON-DACA related Advanced Parole document, skip to Part 7; DACA recipients must complete Part 4 before skipping to Part 7. 

     

    As I am applying for a "standard" Advance Parole (I came to the US on a K1), I would skip to Part 7 and altogether not reply to the second half of Part 3?! 

     

    Also, I wouldn't need to fill in Part 4 which is "Information About Your Proposed Travel". Is that correct?! I recall K1s replying to this part, unless it was based on the previous edition of the form. 

     

    Any help would be great :)

    On the official instructions (page 6), it says: 

     

    Item Numbers 11.a. - 11.c. Citizenship or Residency. You must provide proof that you are a U.S. citizen, U.S. national, or lawful permanent resident for joint and substitute sponsors and for relatives of employment-based immigrants who file Form I-864. Petitioning relatives who have already filed proof of their citizenship or immigration status with Form I-129F, Form I-130, Form I-600, or Form I-600A do not need to submit proof of their status with this affidavit.

     

  9. Thank you @K & R and @missileman - I would need to get a new ESTA as I have a new UK passport. My previous passport was going to expire this March. Do you think having a new ESTA is going to be an issue? Or it doesn't matter as long as it is valid? I'm probably overthinking here, I don't want to take any risk. 

     

    @Wuozopo - Good shout re DS-160. 

    My file is already in London. On CEAC, it turned 'Ready' on 02/01/2019. I am not sure if I have received the letter yet, I won't know until Sunday once I am back in UK. Do you know how long it takes to receive the letter?

    A few questions - apologies if there have already been asked before!

     

    1) I am in the process of completing the DS-160 and wondered if I mattered where I completed it? I am currently on holiday in France, can I complete the form here or do I need to wait until I am back in the UK? 

     

    2) For those who have very recently booked interview in London, has there been many availability for end of the month or even early February? 

     

    3) Can I travel to US before the interview but would have already completed DS-160 and booked the interview? I would need to attend a funeral.
