DRKALEMAR got a reaction from Meg101 in DENIED! USCIS never received RFE I-693 [merged threads]
Just wanted to say that we finally received our GREEN CARD and it's valid for 10 years.
BASICALLY, we were falsely denied our case because of an error on the USCIS part.

I found an excellent lawyer who appealed our case, still no respond, then we sent a mandamus basically threatening to file a lawsuit. In the interim, coincidentally I heard back (after a few months) from our congresswoman Caroline Maloney. She sent a letter along with 29 pages of evidence that we did indeed send appropriate documentation on time (early actually) to our house of congress.

Within 2+ weeks, we received an NOA and approval, and by 48 hours, the green card was in our mailbox.
Lesson learned here is to take pictures of everything, never give up and definitely get yourself a lawyer who hand delivers your appeals or paperwork. AND get your politicians involved.

I have no way of knowing. The website has shown "we received your fingerprints on December 11, 2016". It's been stuck on that status for years. Since then, we had an interview and RFE. Also since my lawyer and I are both supposed to obtain the same notice, one of us would have received something prior to this recent notice.
I was shocked they only gave us a month to submit our I-693. It cost me $500 to expedite and haul a$$.

I'm having a new lawyer drop off an appeal in person first thing tomorrow. Crossing my fingers.

Hello, appreciate your advice. It actually assures me a bit that this is a common error. Also, to answer your question, the RFE was dated 12/31/2018 but I didn't receive it until January 11th. My lawyer received his copy sooner and that is why I was able to take action sooner. As a matter of fact, my husband sent his I-693 the day we received our own hard RFE copy! Although I paid $15 to expedite the letter's arrival w/signature, they still didn't receive our documents until 1/17th.
So between the awful usps turn around and uscis, they just rushed us and denied us. Oddly enough, the denial letter we received ON TIME (same day as my lawyer).

Now I will say, my husband and I had a wonderful experience during our interview and neither of us have a criminal record whatsoever. I genuinely believe this is simply careless handling.

Thank you for clarifying biometrics and vaccines. I should have led with I-693 rather than the word biometrics.

DRKALEMAR got a reaction from lyra14 in 1 Year Since Our AOS Interview
I've written this forum a handful of times and I'm still in disbelief to say we are still waiting my husband's AOS approval.

We interviewed July 2017 and our status hasn't changed since.

Since then, I have made appointments to the USCIS office, called their offices, asked my lawyer to get involved and finally wrote my senator (in NY).
Thankfully my Senator was able to expedite his EAD renewal but said he was still not outside of the "standard" processing timeline. This was back in June.

I just really can't believe we're still waiting....

This is always a challenge I think. It's just the nature of someone not having been to the US before (or any other country, for that matter). Some see the US as very rosy because of all the movies showing us living in huge houses, while others watch too much news and they think it's the wild west with guns blazing everywhere.

Be as realistic as you can. Share things with your spouse that you like about the USA, and share things that you don't like. If there are things about their country that you've come to appreciate more, share that with them. What you're aiming for is a balanced perspective. The rest they'll just have to learn once they get to the US.

Also, we of course share our own image of the USA based on our own lives and perspectives (and this is only natural). Experiencing something and being told about something is always a big leap.

Even better news, Senator Gillibrand is having our EAD expedited! Unfortunately, our I-485 is still considered within normal waiting period.
That's is wild to know we still need to wait this out but at least it's one more assurance that nothing funky is happening to our case.

    THANKS For the advise!

I am sorry to hear about the denial. But the above in bold is the mistake you made. Perception of your relationship makes up a large percentage of the decision of an officer. Meeting criteria doesn't tell the whole story. I speak to my coworker everyday so I can say we talk all the time. It does not mean we are best friends.

You say you only met once... how long was it for? How long ago was it?

It may be time to invest in more time to visit her. It will be beneficial for the both of you in the long run. She also has a child so that is even more reason to have more in person meetings. Especially since are very protective of how minors who are are about to immigrate. You say you love her child, but it is best to be sure that her child has some sort of feelings for you also. You can then decide what path you would like to take. You can reapply for a K1 or you can eventually get married and file for a CR1.

You can travel within the US.
Just make sure you check your case status online or have someone check your mail in case you get RFE or interview invite or any communication from USCiS.

I hear you on that! My husband and I have been going a bit stir crazy as well. We haven't had to remain in one place for a long time! But as far as I know, we can travel around while it is pending. Basically if he doesn't have to show a passport and it is domestic, he is good to go! We are considering traveling in the next few months around the US too.

DRKALEMAR got a reaction from Coco8 in Bringing My Stepdaughter+Son to US to VISIT - While we wait on Adjustment
Ok thanks for clarifying. I'm super confused by all the abbreviations and USC is something I always see on our notifications.

I'm a native New Yorker and my experience with my husband receiving his K1 was very frustrating. Everything is just overall slower in the Dominican Republic. We've had papers lost and returned to us and we waited almost 7 months for his k1 visa. That's what I mean about the the infrastructure. Folks in his family do not easily has access to the basics like a printer. So having go through the visa process over again for the kids would mean, they mother will need to bring them to the consulate, take them to do their biometrics. All we want to do with see our kids for the summer. I guess that's my frustration. I clearly lack knowledge in the process and i'm spoiled with just being able to pick up and leave to visit another country.

Thank you for your advice! I really appreciate any little bit of insight I can get.
