    Yeah, we have been waiting for so long and quite a bit discouraged.  I have been extremely busy at work and I figure I take a break and take it one day at time. I tried hard to be optimistic and go with the illusion that it would only be three months more and it has not been such. Deep in my heart based on the research done I knew it would be the time frame given on uscis processing timeline but I still had hope. I still do but not for the near future. I can’t belive it has been six months since his consul visits that shows you time passes by quickly or at least that what I try to tell myself to mAke this a bit easier to swallow. Lol

    In in a nutshell this is what happened and what is happening to us: We were approved 2 after a long wait and and RFE but when Atti has his interview consul denied visa due to overstay of 12 days 25 years ago. Consul said he can apply for pardon I60a and I212 about $900 plus a piece, and he told Atti it will take like 3 more months to get that approved, which By now I feel is not likely (we filed  in June for that) based on processing timeline for USCI it’s about a 13-18 months wait for that. So we are patiently waiting. That’s all we can do. We have worked so hard on this so we might as well just patiently wait. We didn’t get an attorney because it is the time that it takes and filing for those two things was very expensive too. My understanding is that you cannot file for this unless consul at interview tells you you qualify for pardon. I found this on uscis website. I can pass on the info to you tomorrow as well.

Atti didn’t get the visa, He was missing 3 documents the consul said. Police certificate needed to be a particular one specifically for immigrants , which I had told him to get cause I had read that on VJ forum and he still got the the wrong one. Same thing for military record.  We also need to apply for a I-601 and an I-212 each $930.     Yes, USCIS should have caught it and issued an RFE.  That doesn't matter now.  It is on me because i didn't completely read the application when I sent it.  This is my fault.  I did this to us so know I will fix it.

    There is no way to know John, honestly! They scrutinize everything, every damn bit. I know that when we were doing the DS160 I must have beaten Atti hard and steady on how he needed to be conscise on the times, dates and explanations on the questions they asked pertaining to his visas to USA. Typical guy responses are, sorry for the generalization :( “yeah, I don’t think it’s necesasry or important”, “I forgot about it” we fought like cats and dogs about this and I was screaming on the top of my Lungs how important accuracy and transparency was for this, but he didn’t get it. I hope he gave me the absolute truth about this. Not that I believe it is his intention to omit, it’s just the nature of the beast. All we can do is learn from our mistakes and move forward. I will know soon enough when our interview comes May 9th. I’m in agony thinking we missed something too. I’m sorry for what you are going through... there is no real way to knowing what to expect especially when they have gone so far in the damn process. ☹️

    The refusal was because I failed to disclose information on the petition.  It was an expunged arrest from 1990 that I forgot about.  It is my fault.  I didn't read that expunged arrests mattered when I filed.  I was not convicted.  It was for battery.

     

    Now we need to see if another K-1 or CR-1 is the better route.  I feel like an a$$....

    Ohhh wow! But that was what you why you though your NOA2 took so long! 

    In my line of work I’m a costumed to see this pop out and even if you think expunged means erased it is not. I know that’s not what you want to hear but full disclosure is always better. Atti and I are dealing with a similar situation. His was an overstay (2 months) with probably forged greencard (scam by a Canadian attorney) and a refusal of entry about 20 years ago. I’m still hoping for the best though. That’s all I can do. He was young and naive... still naive ... that has not changed. What I’m trying to say is that we are all here on the same boat and for whatever is worth you have us. We love you and I know I speak for many here! Hang strong brother!

    Try not to worry sweetie!  All you can do is see it through and see what happens. I know it's impossible but please do try not to stress. We are with you, we are all cheering for you.

     

    @KBA and @LydiaP   Words don't suffice.  I'm just holding onto hope for you both.

     

     

    Oh my! Thank you so much, so much! I’m just an emotional ball right now but I’m holding on! I have sent Atti the longest letter ever even though he’s sound asleep. My baby is so peaceful while I’m in turnmoil lol 😂 that’s why he is my better half 😍

    I have not stopped crying! I’m afraid too. And as strong as a woman as I considered myself to be I’m shattered. I have lots to worry about. Atti had a deportation about 20 yrs ago. I don’t know how this will pan out. I just sent him a lengthy letter even though he is asleep right now. I just feel helpless to have our relationship be at the mercy of someone else’s interpretation of it. Sorry to be a doommer right now but this news of John has shattered me in my core.

    Maybe if you supply that! Did you have the opportunity to supply them with that?
