In in a nutshell this is what happened and what is happening to us: We were approved 2 after a long wait and and RFE but when Atti has his interview consul denied visa due to overstay of 12 days 25 years ago. Consul said he can apply for pardon I60a and I212 about $900 plus a piece, and he told Atti it will take like 3 more months to get that approved, which By now I feel is not likely (we filed in June for that) based on processing timeline for USCI it’s about a 13-18 months wait for that. So we are patiently waiting. That’s all we can do. We have worked so hard on this so we might as well just patiently wait. We didn’t get an attorney because it is the time that it takes and filing for those two things was very expensive too. My understanding is that you cannot file for this unless consul at interview tells you you qualify for pardon. I found this on uscis website. I can pass on the info to you tomorrow as well.

We have a difficult one... re entry waiver due to over stay and refusal of entry 20+ years ago...

Police certificate needed to be a particular one specifically for immigrants , which I had told him to get cause I had read that on VJ forum and he still got the the wrong one. Same thing for military record. We also need to apply for a I-601 and an I-212 each $930. There is no way to know John, honestly! They scrutinize everything, every damn bit. I know that when we were doing the DS160 I must have beaten Atti hard and steady on how he needed to be conscise on the times, dates and explanations on the questions they asked pertaining to his visas to USA. Typical guy responses are, sorry for the generalization
“yeah, I don’t think it’s necesasry or important”, “I forgot about it” we fought like cats and dogs about this and I was screaming on the top of my Lungs how important accuracy and transparency was for this, but he didn’t get it. I hope he gave me the absolute truth about this. Not that I believe it is his intention to omit, it’s just the nature of the beast. All we can do is learn from our mistakes and move forward. I will know soon enough when our interview comes May 9th. I’m in agony thinking we missed something too. I’m sorry for what you are going through... there is no real way to knowing what to expect especially when they have gone so far in the damn process. ☹️

With all the fuss I wrote my baby the following (not even embarrassed to share which I normally am):
Honey, John and Rose from the visa forum have been denied their visa. I’m in tears right now. There is really no reason for these two people who clearly love each other get denied if their happiness. I know you are sleeping right now, but I’m just so sad and terrified that something like that can happen to us. I know you are always so optimistic and that’s why I love you so much because you are the better one of us. You are always able to see brightness when I see darkness. I wish I can hold your hand now and know that you are with me and know that we won’t be apart for long. This whole time I have tried my best to be objective, calm and collected and I know I have lost it here and there and I want to say I’m sorry for giving you a hard time about our future housing situation and the apartment in Budapest. I hope you understand that I have a million things on my plate. The kids (not always easy), work and it’s ups and downs and the late hours, my grandma’s passing away, the wedding planning and the cost, the three dogs, all the financial aspect of the wait for your visa, plus all the expenses you are having because of the delay. I appreciate all the hard work you do to endure the long hours with your clients in order to make an extra buck for our future expenses, the long hours after your work day you have to endure daily, just to see me on FaceTime until I’m done with my work day, which is usually late because I am a workaholic :(, the time you take to be with me during my car ride home daily, and all the love an d consideration you have for me through all of this. I know we have had our struggles but I just wanted you to know tonight that I am very grateful for all you do to keep this relationship going regardless of the distance that lies between us. I know the sacrifices you are making to be with me and even though I don’t say it often, I am aware of them and I am also very thankful that you chose to be the man that you are toward me. My kids love you because they see the good man that you are and my parents love you for that too. They are excited waiting to hear the good news of your arrival and please know that you are leaving mom behind (shortly, because we will bring her with us) but you are gaining a huge family that is very fond of you. Derek is counting the days until you get here and he wishes you are here for his graduation from pre-k. He has already a plan to go with me to the airport and he will offer you his house with his magnificent internet so you would be able to work with your clients. So let him down slowly please. He keeps on making bets with me and his parents to see who will you choose; to live with Tia Karina or his house! 😂😂😂 he loves you so much! We love you so much Atti and we are waiting for you to come home baby ok... don’t forget that please!

The refusal was because I failed to disclose information on the petition. It was an expunged arrest from 1990 that I forgot about. It is my fault. I didn't read that expunged arrests mattered when I filed. I was not convicted. It was for battery.
Now we need to see if another K-1 or CR-1 is the better route. I feel like an a$$....
Ohhh wow! But that was what you why you though your NOA2 took so long!
In my line of work I’m a costumed to see this pop out and even if you think expunged means erased it is not. I know that’s not what you want to hear but full disclosure is always better. Atti and I are dealing with a similar situation. His was an overstay (2 months) with probably forged greencard (scam by a Canadian attorney) and a refusal of entry about 20 years ago. I’m still hoping for the best though. That’s all I can do. He was young and naive... still naive ... that has not changed. What I’m trying to say is that we are all here on the same boat and for whatever is worth you have us. We love you and I know I speak for many here! Hang strong brother!

Oh my! Thank you so much, so much! I’m just an emotional ball right now but I’m holding on! I have sent Atti the longest letter ever even though he’s sound asleep. My baby is so peaceful while I’m in turnmoil lol 😂 that’s why he is my better half 😍

Absolutely! It’s hard not to be attached to the outcome of all of us who have chosen to share this journey here on VJ. I wish we can all have our happy ever after with our chosen partners. It’s just sad to feel penalized or scrutinized because we chose love on the other side of “our world” though. I wish things were much simpler for us. It is what it is. We are strong united though! Thanks for your support and encouragement!

I have not stopped crying! I’m afraid too. And as strong as a woman as I considered myself to be I’m shattered. I have lots to worry about. Atti had a deportation about 20 yrs ago. I don’t know how this will pan out. I just sent him a lengthy letter even though he is asleep right now. I just feel helpless to have our relationship be at the mercy of someone else’s interpretation of it. Sorry to be a doommer right now but this news of John has shattered me in my core.

I never had a doubt this was fixable. After reading your post I went and did some research and found out this is just their stupid formalities. I know you will be approved soon and will be able to bring your family over once this is all squared out. I have been at other forums and I have not found the quality of kinsmaship we have in the June filers forum. I’m forever grateful I met (although not physically) such a crowd. You each have a place in my heart! And your triumph is mine... I love you all with all my heart and wish all the ones still behind a prompt NOA2. I don’t know what I would have done without posting and reading each and everyone of your posts during this emotional rollercoaster process. Our interview is scheduled for May 9th and Atti already had his physical. We are getting all our paperwork ready but as you well know, our “ready” might not be their “ready”. Let’s pray for each and everyone of us in this process please.

Yeah, we have been waiting for so long and quite a bit discouraged. I have been extremely busy at work and I figure I take a break and take it one day at time. I tried hard to be optimistic and go with the illusion that it would only be three months more and it has not been such. Deep in my heart based on the research done I knew it would be the time frame given on uscis processing timeline but I still had hope. I still do but not for the near future. I can’t belive it has been six months since his consul visits that shows you time passes by quickly or at least that what I try to tell myself to mAke this a bit easier to swallow. Lol
