Yeah definitely not right, here's what I printed and brought into my Accountant for him to know what to do: https://www.irs.gov/individuals/international-taxpayers/nonresident-alien-spouse There it says that all world wide income must be referenced if MFJ, but that the income can be exempted on an amendment with the 1040X. So, an extra step but I'm okay with that. I will be included my letter as well within that amendment of how I want my husband to be considered for tax purposes.

Seriously some of these Accountants I came across are clueless or just extra conservative and don't know what to do.. the ones you find that will do it and listen to you are few and far between just because it isn't something they might have seen ever or just in general not that common. Stand your ground, print off those instructions and give it to them. My guy literally commented "you know more about this than I do then" and it is true!! With all the research us VJ users do, we are programmed to find every loop hole and exception haha 😎

Exactly what he will be doing. Ammending the return with the 1040X form referencing the 255EZ. As well, the IRS instructions online referenced that workaround will be sufficient for the MFJ filers. So I'm okay with it, and yes his income was under that amount.

Likewise! I at least have a social security number for my spouse which is nice and we were able to get his tax forms from his home country in order to reflect his worldwide income from prior to when he arrived here. At this point, I'm just basically wanting to get this filing over with and if they do it right or somewhat right I'm okay with it after witnessing not a lot of people have run across this and just accepting the fact that there's the "gray" area in the accountant's mind. I have the 2555EZ form too that I believe we need to fill out so we will see!

On a more troublesome note, we are going to the 3rd Tax Accountant tonight in hopes that they know what to do with a MFJ case! Hoping that 3rd times a charm haha, just want to get these OVER WITH!

Yeah, typically, the written Test in my opinion is a bit more complicated than the actual physical Test but it all depends on the instructor you get that day in my mind. I was wanting to have him ask as well if he could just transfer his foreign license to a license here but with only needing to do one more step we will probably just continue with the protocol. At least we don't have to wait for the Green Card.
I actually didn't have to parallel park during my test 14 years ago! So you may not have to do that! You never know.

I know that Ghana has been notated as a high fraud country but personally I don't think you have to worry. Honestly, Visajourney sometimes gave me more anxiety than I needed to have. I know my husband did not come from a high fraud country so I cannot relate on that aspect, but at the same time the CO wants to see pictures with family to show you have a true relationship so i don't think that's bad evidence to send.

That is great to hear thank you for sharing! My husband, the beneficiary may take his chances and go there prior! His appointment is next week anyways so I guess I'll see what he wants to do, it's a decent 45 minutes away. I was going to take off of work but if it's not needed and he can go by himself that's great!

Funny you say that! We received the letter the same day as you!! We have our fingerprint appointment 12/19 so exactly since we mailed out our package. Are you the USC, if so, will you be going with?

I had that happen with a few of the fields, I ended up just typing what I could and then entering the remaining values with black pen, as that is acceptable as well.

Hi All
I thought I would start the November AOS 2018 Filers group in order for us to be able to collaborate on time frames and questions! I originally thought I was going to get my AOS file in the mail in October but there is just too many documents to make sure are accurately aligned! I'm looking to get my application finalized this weekend and sent next week!
Hope this forum will bring help and encouragement to others!

Sending out AOS today via USPS! We are as well utilizing the Credit Card option with my husband's credit card from Spain, any other fellow international card payers? I know online it states that when paying via check/money order funds must be withdrawn from a US institution, but nothing referencing credit card payments. We are right in WI so it should arrive to IL tomorrow or by Wednesday.
Anybody else pay with a foreign card?

I personally feel like I'm experiencing deja vu with the I-129F. I have spent probably a good week so far gathering the appropriate documents, necessary copies, and reading through all of the differently worded questions within the applications.
I would start it as soon as you can! I think my application will at least be 100 pages combined 😤 I hope to have it sent this week and we are 2 months after POE.

Correct. One copy of the G-1450 and attach to very front of the I485 package (as that's the one you are paying for). By submitting the I765 and I131 together with the I485, USCIS will know it's free.
