Minor child of LPR parent is under "Family Preference" visa category, not "Immediate Relative" category.  Different CSPA rules.

what is the CSPA rules for LPR children who is turning 21 years old on dec 2024. suppose if parents will file for the child in April 2024. how long it will take for the child to get the visa.

    thank you

Agree seems a long shot but the sooner you file the better.

I filed for my parents I 130 today. they have to get their immigrant visa and enter US in order to file for their son.

so in order to secure age out once they file I130 before he turns 21 will USCIS  consider him as minor and approve it sooner.

Why not update your Driver's licence, just to have an easy-to-carry ID in your name?

to get real ID  DL I need SS card with my updated name as in my naturalization certificate. went to local social security office they took my old SS card and I was told to wait 2 weeks. once I get my  social security card I need to go to DMV with my naturalization certificate and social security card then they will issue me real ID then only I can apply for passport. I think I need to wait until I receive my social security card.

i agree with other. DL is not needed to apply for passport. ur naturalization certificate is enough

do not mention anything about DL. not everyone has driving license. many many people in NYC has no DL, but they can apply for US passport.

print this and show it to them : https://travel.state.gov/content/travel/en/passports/need-passport/apply-in-person.html

asked them in which part its required to present DL?

They told me they don't need DL but they need ID with my picture in it and my name should match as it is in the naturalization certificate.

  5. I recently became US citizen. I put my Spouse last name in my Naturalization certificate. My DL is still in my maiden name. Went to apply for passport at LOCAL USPS and the agent refuse to take my application. I was told my DL also need to be in my current legal name. I thought I will be able to apply for US passport with just Naturalization certificate but thats not true. I guess I need to wait for my new updated SS card in the mail so that I can get real ID and then apply for passport after that...

As said, one can go either way however just note that the traditional marriage in Nepal carries a lot of weight in terms of bonafide marital relationship in the eyes of CO there. So if you are doing online utah marriage, it is still fine but make sure you have other good evidences of bonafide relationship.

Plan is to just do Legal marriage in order to start the process with USCIS and then later in US do Nepali style traditional marriage. because of Limited time I think Utah marriage will be quick and easy.

The marriage certificate will be the legal document certifying your marriage. However immigration wise, it's considered legal marriage only when you two consummate, that is only after you two meet in person after online marriage. You can only file for i130 after you two meet in person post marriage. No need to worry about the legitimacy of the marriage.

However you do need to provide evidences of bonafide relationship. Look into the guidelines in this forum and you will see a bunch of recommendations.

Getting married in Nepal and getting marriage certificate from CDO takes almost a month. so do you think US citizen can visit Nepal and do online UTAH marriage while in nepal and get the marriage certificate. or do online utah marriage when in US and then visit Nepal to meet and spend some time and then later file I130.
