  2. Ein Update zum Staatsangehoerigkeitsrecht:

    Die Bundesregierung hat sich endlich auf einen Gesetzentwurf geeinigt.  Der wird dann jetzt wohl zur Kommentierung an die Bundesländer und interessierte Verbände und Organisationen gegeben und danach im Bundestag behandelt.  Das Update koennte dann irgendwann im Herbst in Kraft treten. 

     

    Doppelte Staatsburgerschaft wird zugelassen, Beibehaltungsgenehmigungen werden abgeschafft.

    Mal sehen, ob es wirklich so schnell gehen wird, aber es klingt schon gut.  Habe jedenfalls schonmal angefangen, die Unterlagen fuer das N-400 zusammenzutragen.

My wife and a friend both moved their cats from Germany to the US in 2017.  Both made sure to take direct flights.  Both flew Lufthansa or United.  My wife's kitty is tiny and her carrier fit comfortably under the seat.  My wife did spring for business class to make sure there would be enough space.  The friend's cat is a very tall Maine ####### and so had to travel in the storage section.  Both cats endured their flights without problems.

     

    Regarding paperwork and medical stuff -- my wife's vet in Germany had experience with this and prepared all the paperwork.  There were no problems -- neither with the airline nor with the authorities.

    That's been the case for me for the last 2 years, ever since my 2-year Green Card expired.  Going through secondary every single time I arrived at IAD.  I've gotten used to it.

Thanks for adding some backstory to your question, @KhailTowers.  As others in this thread have already said — don't worry too much about the I-864.  If your marriage fails in the U.S., it will be messy and expensive anyway.  The I-864 won't add that much cost and hassle.  And in any case, the I-864 only creates an obligation towards the U.S. government, not your wife.  Her brother can't make her sue you based on the I-864.

     

    If you feel like going ahead with your marriage and with moving to the U.S. I would recommend two things to mitigate the risk I: 

     

    (1) Talk with your wife and develop a joint vision of your life together that includes all the important points — kids, living situation, domestic work split, finances, retirement.  That's the best way to prevent your marriage from breaking apart.

     

    But also:

     

    (2) Once your wife is here, support her in finding employment, developing a career, etc.  The I-864 is moot if she makes her own money.

     

    Does your wife work?  Does she want to keep working in the U.S.?  If you keep moving around for jobs — are you expecting her to follow you and put her own career on the backburner?  If you two want kids — is she going to stop working and take care of them?

    Hatte bisher nie Probleme damit (Lufthansa und United).  Ich würde immer das Original mitbringen, jedenfalls wollten die bei der Passkontrolle in den USA bei mir immer das Original sehen.

    Es kann im Einzelfall triftige Gründe geben, aber die treffen bei dir wahrscheinlich nicht zu, sonst wüsstest du sie schon.  Mein Standpunkt: Ich will die Möglichkeit behalten, irgendwann wieder nach Deutschland zu zurück zu ziehen, und werde darum an meinem deutschen Pass festhalten.

    Depends on who you mean by "they".  The airlines and the TSA don't ask for a visa when you travel domestically.  They only want to see an ID.  Your passport should do.  The CBP and/or ICE, on the other hand, do spot checks at domestic air travel, and they will absolutely want to see documentation of your visa / immigration status.

    Ich habe das 2018 mal versucht.  Mein Expedite Request wurde ins System aufgenommen und ich bekam ein paar Tage spaeter eine Email mit einer Faxnummer, wohin ich meine Nachweise schicken sollte.  Ich wuerde die Bibliothek um ein formelles Jobangebot bitten und das dann beim USCIS einreichen.  Viel Glueck!

  10. Europe does US-approved vaccines, but their systems are usually not meant for tourists.  Best I could find is Denmark where temporary residents become eligible if their stay is longer than 30 days:

    You could also try a web search for something like "travel medicine" and then contact doctors individually and ask them if they are willing to vaccinate self-paying tourists.

    No issue for your I751.  There's no fixed list of documents you need to provide as evidence.  USCIS will judge the totality of whatever documents you provide.  Your list looks decent, so I would not expect any problems.  That being said — the more and better evidence you provide the lower the risk of getting RFEs or even getting denied.

    If they are legally her children then you need to list them.  Did she adopt them back then?  Just marrying a man with children does not make her a legal parent in most countries.

    Gotcha.  If you bring the marriage certificate to the DMV you should be able to get a new driver's license in her new last name.  The marriage certificate is the evidence for the name change.   However — until you have the AOS application receipt (I-797A) you only have the M1 visa as evidence for her legal presence in the U.S.  If that expires in October the new, M1-based driver's license would most likely also only be valid until October.

     

    If you want the new driver's license as quickly as possible and don't mind going to the DMV twice, you could get her a new license now with the M1, and then go again once you have the I-797A.

    Yes, they will.  It's very common that people hang on to their existing passports for a while after a name change.

    I don't know any state where a marriage certificate would help you getting a drivers license.  In CA you have the option to get a drivers license for people lacking the usual documents.

    He should go to the DMV again and bring his I-797A NOA (+ passport etc.)  The I-797A is his proof of lawful status.  Be aware that he also needs a SSN or an official denial from the SSA.  Might have to try more than one DMV office(r) and/or ask for a supervisor.
