  1. I didn't file 864A, only 864. Part 6, line 7 "My current individual income is = 36,601" Part 6, line 24.a. Most Recent Tax Year 2021 Total Income = $39,673" (AGI 5107 + SSI 34,566) Part 7, line 1 N/A Part 7, line 2 Net cash value of real-estate holdings = 600,000 Part 7, line 3 Net cash value of IRA (stocks bonds) = 300,000 Total value of Assets = 900,000 Household size of 3= 28,787 RFE says Acceptable evidence of assets would be "Evidence of ownership, any mortgage/lien of any real estate and dates acquired" and "Assets must equal 3 times the difference for a spouse or child of a United States citizen" if USCIS is set on accepting their 2021 AGI of 5,107, then the remaining difference is 23,680 x 3 = 71,040 in assets. Documentation included: 1040 Federal income tax return (1099s and Tax Return Transcripts from 2019, 2020, 2021) Social Security Benefits for 2022 showing 125% of the federal poverty guideline for household size of 3 2022 Real Property Notice of Assessment Mortgage statement showing current balance IRA statement with these documents, this sponsor has more than enough evidence to qualify, wouldn't you agree?

I put the amount for 2021 $39,673 and wrote on Page 10 in the notes "Non taxable social security amount is added to adjusted gross income for 2021" also in Part 7, 2. other supporting documents for net cash value of real-estate holdings (Net value means current assessed value minus mortgage debt) is $600,000. and including the Joint sponsor's Social Security Benefits for 2022 and evidence of real property ownership 2022 Real Property Notice of Assessment, Mortgage statement with current balance with date acquired and current balance.
  3. I'm sure this co-sponsor qualifies. The qualifying amount for a household size of 3 is $28,787. This co-sponsor makes $34,566 as shown in their Social Security Benefits. He also has evidence of real property ownership, the 2022 Real Property Notice of Assessment shows an equity value of $600,000 and IRA (stocks, bonds) with a balance of $300,000. Can you explain in further detail how this co-sponsor does not qualify for the $28,787 amount based on these figures?

On Form I-864, Part 6. application, it says "My total income (adjusted gross income on Internal Revenue Service (IRS) Form 1040EZ) as reported on my Federal income tax returns for the most recent three years was: " For 2021, the "adjusted gross income" is $5,107. Where can I show the "Social Security Benefits" income on Form I-864, which is $34,566?

I got an RFE for my joint sponsor which says "we could not determine that the joint sponsor is qualified" we think because in the most recent tax year of 2021, his IRS Transcripts shows collected $34,566 of "Total Social Security Benefits", but this is not taxable, so it' s not included on the "Total Income" so on the "Total Income" line on IRS Form 1040 it shows only $5,107 of taxable income. His total annual income total was $39,673, which is more than enough to qualify a household size of 3. Does USCIS not consider Social Security Income as qualifiable evidence of 125% of the federal poverty guideline compared to Taxable Employment Income because according to the RFE, only the "Total Income" line is used to determine a qualifying sponsor? In this case, it would be "5,107" My joint sponsor is retired, but makes more than enough income with Social Security Benefits to qualify. He doesn't want to provide 12 months of bank statements because the amount of money is moved in and out throughout the year. So we think the only other way to get approval is showing Evidence of ownership, mortgage documentation showing the value of his real estate property which is $600,000 and use this as evidence. Would this be enough evidence?
  6. She currently already has a temporary drivers license based on M1 visa, however, for some reason, the temp license expiration date is August when she graduates. Then she starts OPT for 60 days from August - October. So I am not sure why they only offered a valid license that expires before OPT starts when her M1 visa is valid until ending of October. Right now she has her old address/name on her temp license which expires in August, so I will go to the DMV with marriage certificate and see if we can get a new license. Do you think I need to wait until she gets her EAD card as well as proof to extend the temporary license expiration date from August to October? Maybe the reason it expires in August was because she didn't apply for OPT yet. If all else fails, at least I can have her get a new license showing new name/address to use as proof of new name even if the expiration date is August (hopefully I can get it with an October expiration date though), that gives me some time to submit applications and wait for I-797A from USCIS to take to the DMV and then renew her license again before it expires.
  7. So I wouldn't be able to get a license with new last name until after AOS applications are submitted? I am curious. On the applications. I put Beneficiary's new last name, but now all of her ID shows old last name and passport has old last name. That's why I wanted to get new ID showing new last name to match application name. Will USCIS still accept her copies of passport/ID showing old last name?
  8. Wife has M1 Visa which expires in October and a Temporary State drivers license based on visa which expires in August, before OPT starts. Now I want to change her state drivers license last name and address by providing marriage certificate. Will the state only issue the drivers license that expires in August? Or is there a way to get a drivers license that is longer than 2 months based on marriage certificate? Do they need to see receipt of AOS or will they only provide a drivers license with expiration date based on current M1 Visa which expires in October?
  9. I most likely wont be able to travel after I start OPT because I wont have enough time. When I graduate on August 4, I have almost 2 weeks until I start OPT, so i start on August 15 so I have time to travel. My M1 Visa is valid until October. I also have my I-20 documents for OPT employment with Sevis number. I didn't receive my OPT card yet but I mailed my application and check for it last month, so since it might take 3 months i may or may not have received it by August. Would this be a problem if I didn't receive the card yet?
  10. Is it possible to travel internationally before I start my OPT. I will graduate in August and have 2 weeks free before I start my OPT on August 15. I want to travel internationally and was wondering what do I need to do before I travel to be sure that I am able to re-enter on my same M1 visa. Do I need to apply for a re-entry permit online or do it at the airport before I travel and is there anything else I need to know before doing this?

  12. This is from a cover letter showing all the supporting documents needed when submitting the application to USCIS. So far I have Two recent passport style photos, Form I-94 and Entry/Exit History, Copy of Passport with Visa Entry Stamp, Copy of I-20 Certificate of Eligibility for Nonimmigrant Student Status, and also the EAD card which is only valid from July - September only. This application is concurrent filing with Adjustment of Status for a new EAD card to be able to work after September when the first one expires. Is the I-797 Notice of Action also required when submitting this application since this will be filled while having a valid OPT EAD card?

Hello, I am just curious if anyone knows what the "Supporting Letter" is for Form I-765 and also does anyone know if the F1-OPT EAD card with I-797 Notice of Action is just a photo copy of the EAD card and then a printed application of Form I-797 Notice of Action filled out? What does the Notice of Action do?

I am having a Joint Sponsor sign Form I-864 and I have a copy of his Passport biographical page showing proof of US citizenship and 3 Years of tax return transcripts from 2021, 2020, and 2019 showing proof of 125% FPG income. He is currently retired. Is there any other documentation that I need to include besides these or is this all that is required? Thanks in advance.
