Thank you all  And if it comes up, we will tell the CO the truth of not wanting to feel the bad energy/judging from some people online. We are still really young and sharing this with everyone at this moment is not a good idea. It doesnt change the fact that we are happy to get married and finally live our lives together.

If you guys sent in a request for the I-485 to be withdrawn because you guys were going through divorce and it was withdrawn because of that reason then yes the AP/EAD also became automatically void as well since it’s tied to the I-485. If you attempt to re enter the U.S. using it you will certainly be denied entry.

Did they mention or do you know why they canceled it? Did you by chance leave the country without AP first and your petition was deemed abandoned? Some other information could be helpful.

mkr1990 reacted to SkruDe in Applied for AOS considered overstay on K1 visa? *URGENT*
Your K1 Visa expired the moment you arrived in the USA and went thru immigration at the airport.  You got married within 90 days.  At the time of that marriage your K1 Visa requirement was met and now no longer applies to any time frame or deadline.

If you go back before AP it is not considered overstay on Visa.  Because you are legal with status while your AOS is being processed.  That status is a "Pending" status.  Going back and leaving the USA before AP simply means you abandon your AOS process.  So, you'd have to start from step one again, which would be the I-129F.  No overstay accrued.

Just seconding what was stated above. K-1 visa expires as soon as you enter the US. If you are in process for AOS that is your legal status -- your legal status is not a K-1 visa holder, it is that your are adjusting status. If you want to go back and live in your home country you can and your AOS application will be abandoned, and you would not have violated any immigration laws (no overstay or anything). So you shouldn't have trouble if you want to come visit the US in the future (on VWP or tourist or whatever).

I was thinking about something interesting.. do you think the officer interviewing you already reviewed your case and is close to approving you but needs to verify some things with the questions he/she is asking? (This goes for Western European countries)

i think it is true of all countries
recently mother in law applied for tourist visa
the letter writter in engish on one side and arabic on other (for a denial) was typed and dated the day before
the case packet arrives and is at embassy over a month before an interview and CO can read thru packet at any time to preare what questions to ask

The officer will almost certainly be familiar with your case before you are called to the 'window' for interview. By this point background checks have been done, the relationship has been proven to be legitimate and they are happy that you have the intent to marry. The questions are most likely just to assess your reactions in person. They are going to be questions that would be easy for anyone in a good relationship to answer.
I personally think the only reason anyone wouldnt be approved at interview is if they acted suspiciously/strangely (as long as all documents and medical are fine). So yes, they probably already know if they want to approve you before the questions are asked.

every interview you will ever have with an immigration officer is going to be a verification interview, it's to make sure your not being fraudulent. It's to check the facts that have been prevented and possible find new evidence that can determine whether an initial yes or no is valid.

Based on my experience for a F-1 visa;  the interview was to verify information I already submitted.

There will be no update on your DS-160 until the embassy starts processing your K-1 visa application. Once you've done the interview, you'll see statuses like "administrative processing" and "issued". I have no idea if there are any other ones because my last DS-160 was a couple of years ago for my B2

Amsterdam does not require it to be certified. Don't be surprised if they don't even ask for these documents. They will ask for the tax returns. They really prefer tax returns over the other allowed documents.

Today was root canal day for me. I had a run in with a crappy dentist three weeks ago, who sent me to the ER after drilling into my sinus and pouring bleach into it. Today I had a specialist go in and fix all that damage, so I was extremely nervous and scared about today. However, I woke up and checked the informed delivery and there it was. The golden Wonka wrapper, the USCIS letter.

I didn't tell my fiancee because 1) until I opened that letter it could have been and RFE and 2) I wanted to record a video of me opening the letter so that she and I could get the good news at the same time.

I sat through the 1.5-hour root canal cleanup job, staggered out of there and headed toward home toward that mailbox. About 5 minutes from the house I started recording a video and talking like nothing was up. Then as I pulled into home, I changed my tone to be much more excited and told her that I hope to have a surprise for her. I walked to the mailbox, pulled out the letter so that the camera could see it, walked to the car and got in, took a deep breath and NOA2!!!!

    Received: Jan 31
    NOA1: Feb 2
    NOA2: June 7

Please hang in there everyone who is still waiting. I know how hard it is, but the good news is on the way. I have said it before, and I will say it again, you all are the strongest and greatest people I know.

Hello everyone, does the USCIS case checker work again since a few days ago? I have read that people are getting approval notifications again. Normally we could only see RFE's since the case checker was broken. Can anyone confirm this with a case scan of February or March?

    Thanks
