We are still in the waiting game with you all for the EAD/AP.  We did receive my husbands green card interview appointment set for December 14 in which we are very grateful for but we realized how important the EAD/AP is this week as his grandmother passed away and he is stuck here with no way to travel home for the funeral.   We have looked into ways to expedite the AP but the soonest infopass appointment we can get is December 12 which is pointless considering his interview is the 14th.  Really wishing that we would have received the AP by now but unfortunately the wait continues.  It's hard when you have to wait on someone else to approve your "freedom".

Congrats to those who have received their approval and good luck to those still waiting.  Fingers crossed that everyone hears something soon!

Ashley Scott got a reaction from Diane and Chris in British female visiting boyfriend in US with VWP
Every situation is different but our experience was not bad.  My (now) husband visited me twice on the VWP while we were dating.  The first time he was not asked anything and had no issues.  The second visit he was asked who he was visiting, to which he told them the truth and said his girlfriend.  He was detained in a small office and questioned further about how long he was staying, if we planned to get married, when he was returning to the UK, etc.  The officer then called me and questioned me about his stay and our intentions as well.  I told the officer that he was visiting for 2 and a half weeks and staying with me.  That we did plan to get married but not any time soon (we got engaged while he was here during that trip).  I explained that we were spending the holidays together and that he would be returning to England on the scheduled return ticket.  We were just completely honest with all of our answers and he accepted that and let him through.  It was a little extra hassle but ultimately nothing too bad.

I know its up to each officer individually but I would suggest just telling them the truth and bringing any ties that you can to prove that you plan to return.  Good luck!

We filled out the DS-160 while we were waiting for the embassy to receive our case.  We did not submit it until we had confirmation that they received it.  Here is my initial checklist of things that were needed after the NOA2 (some that I compiled and sent to my Fiancé for the interview).  Hope it helps a bit.   I know every embassy is different.  These were the things he brought for the medical/embassy in London.  Congrats on your NOA2!

    For his medical--
Police Certificate confirmation of interview appointment letter from embassy with approved I-129f 4 passport photos Drivers license or passport Vaccination Record (if any additional vaccines are obtained by a GP) Medical summary from GP For his interview --
Letter from the embassy with approved I-129f Copy of NOA2 (I sent to fiancé) Confirmation of appointment date and time (printed from embassy website after we booked) Updated letter of intent (sent to fiancé) Copy of ds-160 confirmation page (printed after we submitted it) I-134 affidavit of support (I sent to fiancé) Tax records and w2s (I sent to fiancé) copies of I-129f packet with photos/evidence of relationship (photos, ring receipt, wedding plans, etc)

My (now) husband's POE was JFK when he came on his K1.  He was never asked anything about money.  He travelled over with about 50 pounds in his wallet and nothing in his bank as we had already transferred his funds to my account in the US to prepare for "closing" his UK account.  He wasn't even asked about our wedding date or anything.  They took his packet, put him in the system, and told him "welcome to America" then sent him on his way.  I would say be prepared to answer anything but don't stress it too much.  From what I have read, JFK seems to be a fairly easy and pleasant POE.  Good luck on your move!

My (now) husband has a daughter still in the UK.  We listed her on the applications to acknowledge he has a daughter, but not on any of the affidavits due to her not being counted in our household here.  The child will not be required to attend the interview since he is not planning to immigrate with your fiancé.  I also, just for peace of mind, sent a letter with him to his interview acknowledging that I am fully aware of his daughter and that she would not be immigrating with him.  They never asked anything about it during any of his processes though and the letter was not needed.

My husband is from the UK as well.  When we submitted our I129f packet I simply wrote that we "met on social media".  I didn't give any specifics on which site or any details about our original contact.  We didn't receive any RFE's or questions about it.  They didn't question it further at the interview or anything.  I think you all will be fine.

Good morning everyone!  Just wanted to give you our update on my husband's AOS timeline.  We received an update last night that his interview for his green card is scheduled for December 14!  Our timeline is as follows:
    August 4 - Marriage
    August 15- sent AOS packet
    August 17- Packet received
    Late August- NOA1s received
    September 12 - Biometrics appointment
October 17- updated to "ready to be scheduled for interview"
November 9- updated to "interview scheduled" for December 14

So I am not sure if his EAD/AP will get approved in the meantime but looks like he will be an official green card holder by mid December.   I hope everyone else starts hearing some updates on your cases soon!  Maybe they are getting a little pep in their step trying to get stuff done before the holidays!

Good morning all.  We got our "case is ready to be scheduled for an interview" status update this morning for the I-485.  We filed on August 15th so it was just over 2 months.  Still no word on the EAD or AP yet though.

Then you need to learn to read and understand intent. I thought it was obvious, but since it was not, I will spell it out. I asked because I was concerned that there might be real risks associated with this phase of the process, that I was missing, like getting deported. The frown emoticons, etc, lead me here, with this question. This is a family based immigration thread which means that the primary intent is being united with a loved one. I am in no way trying to discredit a person wanting to go to school, work, etc. I am simply trying to determine if I am missing something critical that would result in us being separated. If you took what I said to mean something else then you are wrong.

If money's tight, you may want to look at getting married first and then applying for a CR-1 visa - the process is a little slower, but costs less than K-1. And with K-1, there will be a period of around 3-4 months after arriving in the US that you are not able to work and will be entirely dependent on your fiancee/wife/in-laws - with the CR-1 you're entitled to work from the moment you enter the country.

Drink driving and disorderly conduct wouldn't be a problem by themselves..but the possession of a class A is.
It can't have been a vast amount or possession with intent, given it was community service, but nonetheless, it is a controlled substance conviction.

    How long ago was this?
If it was some time ago, the chances of being issued with a single entry B2 are better than if it was recently.

Apply ASAP - as noted above, a waiver is taking on average 6 months.
He will need an ACRO certificate - link HERE (which will more than likely come back with 'no live trace' ), a subject access report - link HERE, and any court paperwork that he can get hold of.

Applicants for visitor visas should generally apply the U.S. Embassy or Consulate with jurisdiction over their place of permanent residence. Although visa applicants may apply at any U.S. consular office abroad, it may be more difficult to qualify for the visa outside the country of permanent residence. Visa applications are now subject to a greater degree of review than in the past so it is important to apply for your visa well in advance of your travel departure date.

As part of the visa application process, an interview at the embassy consular section is required for visa applicants from age 14 through 79, with few exceptions. Persons age 13 and younger, and age 80 and older, generally do not require an interview, unless requested by embassy or consulate. Making your appointment for an interview is the first step in the visa application process. The waiting time for an interview appointment for applicants can vary, so early visa application is strongly encouraged. Visa wait times for interview appointments and visa processing time information for each U.S. Embassy or Consulate worldwide is available on the internet at Visa Wait Times , and on most embassy websites. Learn how to schedule an appointment for an interview, pay the application processing fee, review embassy specific instructions, and much more by visiting the U.S. Embassy or Consulate website where you will apply.

During the visa application process, usually at the interview, an ink-free, digital fingerprint scan will be quickly taken. Some visa applications require further administrative processing, which takes additional time after the visa applicant’s interview by a Consular Officer.

You can learn more about the process here: http://www.visajourney.com/content/visitor-visa-guide

It doesn't look good to get a B2 visa with a drug conviction.  The US is very hard nose about anything other than a minor amount of weed.
