Your plan doesn't make sense. With the k-1 visa you have to enter the us, get married, and then file for adjustment of status. When you apply for adjustment of status you will need to apply for ead and ap to allow you to work and leave and reenter the us while you wait for the green card. It will likely take 3-4 months for your ead/ap to be approved.

From what I understand your other visas may actually be cancelled when they issue your k-1 visa.

Seems that you did not completely understand the process before you started and picked the wrong visa or at least the wrong timing for your situation.

The part that you still don't understand is that once you enter on the k-1 you can not leave until you have ap (which will take 3-4 months after you file for aos), even if they didn't cancel the other visas.

Also, you can not leagally work during that time, until you have the ead (also 3-4 months after you file for aos).

This is why you plan won't work. It has nothing to do with cancelling of your other visas.

In thin case it is not just a curtosey to the airline. Not cancelling can cause some serious headaches when you try to go through adjustment of status and they think that you actually took that return flight and left the country. It shouldn't happen, but it has on several occasions.

Correct, if it is not allowed then don't try to sneak it in by wrapping it up and not declaring it. He must answer the questions honestly regardig ALL of his belongings (including checked bags).

EG&XY got a reaction from geowrian in If there is a RFE, in i130 filling how long they notify?
If they accept it and issue the noa1 then it will go into a pile. No one will look at it for about 5-6 months. Then once it gets to the top of the pile someone will loook at it and either approve it (issue noa2) or they will send an rfe requesting the missing information. Once you submit the reply to the rfe it will take about 30 days for them to review it and either approve it (noa2) or again ask for more evidence.

However, as I said before, if it is a big enough issue they may just not accept the petition to begin with and just return it. What do you think you forgot? Have they cashed the paynebt check?

In this immigration process, they likely know you better than your family does! They know or want to know (almost) EVERYTHING  Being a really private person, I cringe each time I think of the stuff that we need to send in every step of the way. But hey, at least I'll get to be with my fiance

Yeah, I thought my W-2 would be sufficient, since it clearly is enough and covers the majority of the income. However, now I need to pull up all of my other documents to hand over to them, it is like getting my taxes done all over again.

Actually, if you filed as single (weren't married that year) or opted for married filing separately, then this should be true.

However, it seems that if you filed as married filing jointly it can be a little more tricky. Here is my case:

We were married last year and so we filed as married filing jointly. ~90% of the reported income was on my W-2, but the remaining reported income was a mixture of 1099's for me (interest and dividends) and my spouse's income (no W-2 or 1099's since this was all earned in China). When I submitted documents to NVC I sent my W-2 which covered the majority of the reported income and was well over the threshold. However, we did get a checklist with a request to bring "all" W-2's to the interview. The NVC did not request that I submit the additional documents to them, only that they be taken to the interview.

So from my experience I think that if you file as single, or there is no chance that your spouse had income on the return (married filing separately) then just send the tax transcript and be done with it. However, it you filed taxes as married filing jointly it seems that they want a full break-down of the income sources even if you individual W-2 shows that your income was over the threshold.

I was in a similar situation. I only sent my documents (petitioner) and the sent a checklist asking for my spouse to bring "all" w-2's to the interview. They didn't require me to submit additional documents to the nvc. I'm not sure why they sent the checklist since I did send all of my w-2's, but just in case I am preparing a letter to explain all of the income on my tax return along with my 1099's, etc. But my w-2 that was sent covers like 90% of the reported income and is well above the thresholds.

We were eligible for email processing. Not all consulates allow that. If you have to do mail it can take up to 11 weeks, but some have been closer to 6-8 weeks.
