sensitivemuse got a reaction from Q2018 in K1 Visa & AOS Medical Exam
Do you not have a copy of the vaccination report?
I emailed my doctor's office where I took the exam and asked them about a form I needed to submit and they happily gave me a copy of the vaccines. It's worth a try to contact them if you can.
About the RFE for health exam...I'm going for my interview in May with a copy of my vaccines, and an email from my medical office saying those documents should suffice AND the section of the i-485 to fight this (haha sounds like a losing battle right?) worth a shot because medical exams are expensive and I think I shelled out enough money as it is... they practically own whatever soul I have left....

sensitivemuse got a reaction from Hamilton in Did you bring updated financial proof to your AOS interview?
Yes. I brought an updated bank statement from the previous month that showed our names on it, also my husband filed taxes and added my name to it as well even though I had no income to declare. But at least to show we were joint filing.
And yes. He did ask at the interview. When in doubt, just bring the papers with you even though you think you don't need them. Better to be safe.
I also brought a record of employment from my husband's work. I did this as he changed jobs and I figured they might need it as it's updated info.
Hope this helps!

sensitivemuse reacted to Nich-Nick in Immunizations. DS-3025 or I-693?
This is a revision of my post that is often quoted as good information on the I-693 and DS-3025 question. The DS-3025 form has changed, so this update matches the new form that looks like this http://photos.state.gov/libraries/thailand/591452/iv/ds3025.pdf
If your DS-3025 from your visa medical is sufficient to prove you have completed all required immunizations, then use it instead of seeing a Civil Surgeon. Read all this for information I have compiled.
Do I need a medical exam?
What if I am a K nonimmigrant visa holder and already had a medical exam overseas?
Source: I-693 instructions page 6 &7, Part 3 FAQ, #3
If you were admitted as a:
A. K-1 fiancé(e) or a K-2 child of a K-1 fiancé(e); or
B. K-3 spouse of a U.S. citizen or a K-4 child of a K-3 spouse of a U.S. citizen; and
C. You received a medical examination prior to admission, then:
1) You are not required to have another medical examination as long as you file your Form I-485 within one year of an overseas medical examination, and:
(a) The panel physician did not find a class A medical condition during your overseas examination; or
(b) The panel physician did find a class A medical condition, you received a waiver of inadmissibility, and you have complied with the terms and conditions of the waiver.
(2) Even if a new medical examination is not required, you must still show proof that you complied with the vaccination requirements. If the vaccination record (DS 3025) was not properly completed and included as part of the original overseas medical examination report, you will have to have the Part 7. Vaccination Record completed by a designated civil surgeon. In this case, you must submit Parts 1., 2., 4., and 7. of Form I-693.
Do you need an I-693 immunization sheet? Is my DS-3025 filled out properly?
Look at your DS-3025. If it has the ALL of the following items, you don't need an I-693 (Adults 19-49 yrs old).
1. Shots marked with a date (at least one of a series)
MMR (two are required but if you have "insufficient time interval" Code B in the last column, then you get a waiver) Td or Tdap or DT or DTP or DtaP (One date must be no longer than 10 years ago) Varicella (Either a check by "Vaccine" with a date, OR a check by "Varicella History" if you had chickenpox. History gets you a waiver) Influenza (during flu season)** see note below because you may be okay without it. If it is not flu season, the waiver in the last column is Code F. Everything else marked "not age appropriate" Code A, insufficient time interval B, not flu season F, contraindicated C...things that allow a waiver. NOTE: If you have shots missing and no waiver for them, stop here and see a Civil Surgeon. "Most of the shots" isn't complete. A note from your home country doctor won't count. All shots must be recorded on the DS-3025 or waived. You will have to take your doctor note to a Civil Surgeon and get him to record it on an official form.
2. The new form has a summary section. It may be marked:
"US vaccination requirements COMPLETE (Requesting a Blanket Waiver)"
But instructions I have seen says it is only marked for immigrant visas. I know In London they leave section 2 unmarked at K1 medicals.
3. Signed and dated by the doctor
The unknown with this new form is--will every adjudicator across the US know how to interpret the summary section? Their policy manual says:
"The officer should be aware that civil surgeons may improperly mark the boxes because they may misunderstand the meaning of these boxes. Therefore, the officer should determine, from the vaccination assessment completed by the civil surgeon, whether the applicant received all vaccines, which blanket waivers should be granted, and whether the applicant requires any other waivers. The officer should exercise discretion in reviewing the vaccination chart and when evaluating the results boxes at the bottom of the vaccination assessment chart. If the civil surgeon did not check any result boxes, the officer should only return the form for corrective action if he or she is unable to ascertain whether the applicant is admissible. "
While this is not directly addressing the new form that has a "Summary" instead of a "Results" section, I believe the intent is that the adjudicator should look and see if the four required shots (or waivers) are present and accept the form even if the doctor doesn't do the summary to their liking. No guarantees, but I would certainly use the DS-3025 if I knew I had all the required shots.
**Note on flu shot: Flu shots are required for adults of all ages if your visa exam was between (Oct 1 and March 31). But if the AOS adjudicator picks up your case when it is not flu season, you will be excused. And the reverse is true. The adjudicator picks up your case during flu season, but sees it was NOT flu season when you had your medical exam, you are also excused because the date they go by is the date of your visa exam to determine if you were current on that date. Keep in mind that if you go to a civil surgeon for an I-693, then you are resetting the medical exam date for immunizations and you may have to get second doses of shots or a flu shot to become current on your new immunization date of record.
See next post for more information.

Interesting....
My wife (Canadian citizen) and I drove up to Vancouver over the weekend to use her AP/EAD combo card for the first time to visit her family. It had been about 6 months since she came to the US on K1 Visa.
We came prepared with all her NOAs regarding her AOS that is being processed, her completed biometrics appointment, a copy of our marriage certificate, and all pertinent paperwork regarding our marriage and AOS.
We drove back this past Sunday via the Blaine truck crossing. We handed the border agent my US passport, my wife's Canadian passport with K1 Visa in it, and her AP/EAD combo card. The officer asked about 3-4 questions: how long we stayed, who we visited, what my wife's status was in the US. The border agent was stern, yet, very friendly.
After a 3-4 minutes, he welcomed us back to the US and we were on our way. No secondary inspection. No request for additional papers or information.
With that being said, we will still bring our additional NOAs and adjustment of status paperwork when visiting Canada again. I think its all up to the discretion of the border agent. You could get a laid back agent, or an agent that is more stringent.

sensitivemuse reacted to Ksenia_O in Traveling with Advance Parole (I-131)
You are welcome
You need your International passport, AP and Marriage Certificate in case if you changed the last name. I also always had NOA1 of my I-485 with me, traveling.. Had never been asked to present it, but - just in case.
About air lines - I used Delta, KLM, Air France, Lufthansa, Air Canada - all of them are aware of what AP stands for. So many people now travel with EAD/AP, so I believe the most airlines are familiar already with this stuff. I was even told by Air France - they don't care how your document looks and what it is as long as it lets you get into the country and says "issued by USCIS".
Of course, my biggest concern was to get out of my home country with EAD/AP - I wasn't positive they had an idea how it works.. But I was surprised they knew
As long as your I-485 is pending and there are no issues with your application - you should be fine, traveling abroad.
Just again - remember you would need a longer layover between flights because, actually, you can be "double-checked" at any stop. I was "interviewed" in Munich. Yes, it happened just once, but there is always a chance of that, so I was glad I had more than an hour layover there

sensitivemuse reacted to Ebunoluwa in RE: EAD and Advance Parole
That is correct, no fee required if you file with AOS, did you submit a copy of the NOA1 from the AOS with the EAD and AP forms?
If not then that's why it says fee required so submit a NOA1 copy.
As far as it being an outdated form, check on the USCIS web site which form date they accept.

sensitivemuse reacted to kaylaKo in Interview Coming up ... help needed
my sponsoring spouse quit a few months ago and till the interview last week didn't have work. however, she never claimed for unemployment benefit. I'm on H1B too, and that could be use as part of the household income. we just brought an updated I-864, our 2016 tax returns, and proof that my job is full time and will continue after immigration. The officer never asked about an updated I-864. We got approved the next day.

sensitivemuse reacted to KULtoATL in AOS and I-94 Expiration
You're just out of status between your I-94 expiring and AOS filing. As long as you're married within 90 days, you can file at anytime. Not filing pretty much means you're technically deportable due to being present unlawfully.

sensitivemuse reacted to Loki_Go in Experiences? K1 working for foreign company while waiting AOS
Hi, I did it. I never stopped working for my Canadian company when I moved to the US on a K1. I'm now on a conditional 2 year green card. It's entirely possible and yes, it's a grey area, but understand it is a risk. My employment never came up in my K1 interview but it certainly did in my AOS interview. The CO seemed to know I was working and Didn't ask me anything about it, but instead turned to my husband and asked. My husband and I decided long ago that if it ever came up we were going to be honest about it and so he was. The CO didn't seem to care and moved on to other questioning.
If you want more info about my experiences I welcome you to look through my previous posts. There's a lot of info I've given over the time, too much to try to repeat here.
In a nutshell: Taxes are complicated and expensive. I get paid in CAD into my Canadian bank. You may have to cash out some investments and/or particular savings accounts (like tax free ones) because non-residents cannot hold them.
There's a lot that goes into this, and don't expect your company to cover your butt. YOU need to look out for YOURSELF.

sensitivemuse reacted to Transborderwife in working remotely at home in U.S. while waiting for EAD?
I believe it's a very grey area. Just be sure that the money is being deposited into a Canadian account.

I took about 3 months to wrap things up after I got my K1 visa too. No issue whatsoever, but you may want to send your AOS documents before your medical expires.
PS. Portland is a good place to be

The K-1 visa is generally valid for 6 months from the date of your medical. You should check the date on your visa when you receive it to make sure what date it expires. You need to enter the US before that date.
The 90 days start counting from the POE date, yes.
-
sensitivemuse reacted to KULtoATL in Preparations
K-1 is valid for 6 months. So staying one month is fine. Yes, the 90 days starts at the POE
-
sensitivemuse reacted to Ash.1101 in Preparations
As long as you enter by the expiration date on your visa (normally 6 months from the date of your medical), then you're fine.
And yes, the 90 days doesn't start until your POE.
It's absolutely possible to come in a day before your visa expiration, and then marry on day 89 of your 90 days if you chose too.
There won't be any punishment, just don't put it too close to the expiration date, you never know what could happen and you want to make sure to give yourself enough time incase something causes a delay in coming into the US.

sensitivemuse reacted to CécileMai in Question about K1 activation at POE Montreal
Dear VJers,
I'm flying to meet my fiancé next friday
I will activate my K1 visa at Montreal Trudeau Airport and I'm preparing for that.
So, correct me if I'm wrong, these are the documents I will need:
1- Passport with K1 inside
2- One big yellow sealed enveloppe that was sent with my visa.
What confusing me is something I read, browsing through the forum: some people bring with them a white sealed enveloppe from their medical exam. I just have the Chest Xray CD in a brown sealed enveloppe on which it's written "this should not be given to CBP at US POE". So ok, i will keep it for later but I wonder if I'm missing something. Should I have a third enveloppe, or am I good?
Thank you for your help or any tips
I also planned to take with me the copy of the vaccines I got at the medical exam. And crossing fingers that everyhting will go smoothly...
