For worst case planning, let's say we don't withdraw the K1 and continue on to the interview. The K1 will be denied at the interview because they think we are already married. Once K1 is denied due to that reason, can we instantly after the interview apply for the CR1?

June and July had a big update of case statuses yesterday.
They updated backdated approvals too.

We still have lots of cases (dates) that are not updated in the first part of June.

DISCLAIMER: Here on are my personal educated opinion.
Now my thoughts on this from watching how it flowed in the past is that hopefully they are going to change processing times to July 1 as of November 31. in order to let the June filers be able to officially start inquiries (I am really hoping of this even though I know it is not correct)
July is definitely going stronger than how April, May and June did. by having this much ahead with this many approvals in only 1 week didn't happen for a long time.
Please continue watching around carefully. For those in the September, please still do not put money on anything and watch for when and how August will start.
For everyone else, If I were you, before making firm plans I would watch for how things are going on 3 months ahead of you.
Even though there is improvement (looks like it) the improvement is not from a perfect place, this improvement still makes lots of July filers get to 200 days. And June filers are already 200+ days. NVC right now is taking about 40 days (although not for everyone). So when you are planning ahead keep all these in mind and calculate as if K1 will finish in 10-12 months.
Basically calculate the worst but hope for the best!! Because your positivity will keep you and your relationship healthy and happy!! But being realistic will save your sanity!

I have not had the ceremony but you should take the passport photos just in case. Get them from Costco for cheap.

With L visas going to the Texas service center, they hopefully can bring down K-1 processing times.

I see you are from Canada, same as my fiancee. I am not sure if Canada is considered a high fraud country but the plan would be for me to go to Canada (on my passport as I am a USC) and get married to her within a week or two of my arrival. Then I wish to come back and file the I-130. I have known my fiancee since July of last year.

Questions: How long do you have to be in a foreign country before you can get legally married in that country , come back to the US, and file the I-130?
Does the USCIS look down upon marriages that happen a few days of entry to a foreign country even though you have known your significant other longer that that ?

however to check your own case I'd say use uscis website - the case tracker there is where all these apps and we as the scanner gets our information. Because that's the only legit one and everyone should check their case status there, if it doesn't show anything there we don't have it.
As for analysis and statistics, it is really hard to do anything right now even though we are trying our best. They are not updating the information, we have a lot of (tons of) rfe and approvals that are not updated in the system. So we cannot actually analyze if it's getting better or not at the moment. Hoping things will pick up soon!
Question: Does the historical VJ K1 processing Timeline take into consideration those who also got rfes? if so, Wouldn't that inflate (extend) time lines?

Who here thinks the Trump administration is what is causing such Hugh delays in K1 processing?
It is interesting to note how after his election, processing times have sky rocketed. All we can do is hope it gets faster.

We are waiting for NOA2 now since December. Yes, she will not adjust status here (which is fraud). We would get married here, she would go back to Canada, and wait for the i130. Follow up question would be :Can she visit while i130/cr1 is being processed?

I am still planning the best option (marriage either here or the US). I want to make sure if it is here, we don't trigger some 90 day rule even though in the K1 packet we said we have a religious ceremony planned for July (just a ceremony and not a legal marriage). When we legally get married it would be through the court and registered.

Yes, if we go down this route of marrying here and then doing the i130, we would drop the K1 as it is taking forever for approval. Would that impact anything?

Hello VJ Community. I have known my Candia fiancee for over a year now. I myself am a USC. We do have a pending K1 but being process times are taking longer than usual, we want to get married. The goal is to have the marriage here in the US and then file I130. If the Canadian-born fiancee comes and gets married here (enters via passport) within a short period of time (within a month of arrival), will that trigger the 90 day rule that the USCIS looks at for fraud?
If I go to Canada and get married then file i130 when I get back to America, does the 90 day rule still apply?

Hello VJ Community! So currently, I have a k-1 pending (waiting for NOA2). We have a religious ceremony set for August. My Finace is from Canada and is able to come to America with his passport. Knowing how crazy long the wait times for K-1 approval have become, I have been thinking the following
1) If the K-1 is not approved by the time the religious ceremony is held, my canadian fiancee will come to the states to attend the religious ceremony (it will not be registered with the county/state)
2) After the religious ceremony, he would return back to Canada to finish the steps for the K-1.
3) If he is denied for the k-1 based on the religious ceremony (most likely), can I go to Canada and do the legal court marriage there and file for cr1 based off that?
Would this cause any issues for cr1 approval?

Hello all, I have a Canadian fiance and we have a tentative religious ceremony here in the US in August. The K-1 is pending (no NOA2 yet). Is he allowed to come as a visitor and attend the relgious ceremony? After the religious ceremony, he can go back and finish steps required for the K-1. Once he gets here we can do the court marriage. Thoughts?

For us December 2017 filers, is setting a religious ceremony (in the US) date in Dec 2018, a good call? I doubt it will take 13 months for K1 to get approved. Thoughts?
