Not much a lawyer would, or could do really in this type of case as they have no power over another countries laws or what the embassy decides. I assume also Tunisia, like a lot of African countries, is not the easiest embassy to go through. The petition itself, the I-129F, will not be denied at USCIS because of this because they only care that you both met the requirements to file, meeting within two years and both free to marry.

The embassy is different, as they view the validity of your relationship and also can take into account cultural norms. That being said, again with you being a same sex couple, as we are too, they may be understanding as to why you don't have family approval; but if family approval is a very big factor there in your country it may be looked at negatively... it is hard to say again. I haven't personally read about any other same sex couples from Tunisia here on VJ. In the Philippines, having family approval is not necessarily a big factor or any factor at all as my partner did not even tell his family anything.... each country is totally unique really as to how the embassy views the cases.

All you can do really is make sure you and your partner have a lot of evidence to show a strong relationship. Like other African countries, it usually helps to have 2-3 visits in person, this shows really good proof of bonafide relationship.

Also, same applies to hetero couples, always reference your fiance as your fiance or fiancee, not husband/wife. Just commenting on that.

    Welcome to VJ.

First off, start here with the guides for the K-1 visa and I-129F petition : http://www.visajourney.com/content/k1guide

You both need to fill out the required forms, sign and date(you the beneficiary can print, sign and scan him a copy, his needs to be all original wet signatures). Then once the packet is completed mail it to the Lockbox in Lewisville, Texas.

The passport shouldn't be any issue as long as you are a legal resident in Italy, you can process through that embassy. If not, then you would need to return and process through the Moroccan embassy, and it is probably a lot better/easier to go through the embassy in Italy I would think.

I don't think thst would qualify for expedite honestly. Sorry to say. USCIS does not really care about family issues....

As to issues at the embassy, it's hard to say. I assume in Tunisia, like a lot of African countries, that family approval  is a huge cultural thing, and not having your family approval could cause issues as it "out of the norm" for your country; but that being said, with you being a same sex couple, the embassy might also be very understanding of your situation and understand why you wouldn't have family approval... It is hard to say exactly how the embassy will view this to me honestly.

You're probably have a ban so no visa for you. You also lied on the government application and that might mean no more US for you. Also it kind of sounds like your parents didn't really explain you the whole story.

The "the father needs to see his son" means nothing to the USCIS. He can visit you.
edit: nevermind, just saw that he can't get the passport. Well, tell him to sort his life.

First, be patient as best as possible. The averages here always are going to fluctuate a bit; but they are fairly reliable.. I never really paid attention to the time line when we were waiting on our NOA2, and it came pretty fast; but I also set myself up for the 3-5 months waiting period before thinking we would get it.

I think average now is still 2-4 months.

Think most would say be patient. Can be anywhere honestly from 2-4 months depending on how backed up they are. How fast they process other petitions, ect..

Probably will get caught in the middle of that. Even if processed through Australia, the Iranian ties probably would cause an issue. Not entirely sure on that; but possible.

Agreed with above. While some pay an agency with attorney backing (which is a lot cheaper still than hiring a lawyer by themselves), if you're case is simple with no major flags or anything then you might as well save the money and do it yourself.

Does your sister have you as a dependent on her Federal Tax returns? or are you a part of her household? Otherwise, she doesn't have to count you. Only her, her son and the two intended immigrants.

Yes, as with you, should would need to be able to cover financially herself and her household as well as your wife and step son.

She would need to supply the I-864 form with all supporting documentation. Same as you are doing.

Again she also would need to be able to show 125% for a household of 4 then. Herself, her child, your wife, and step son.

It does not get 'divided' between dependents or incomes added together. It is kept separately.

Everyone entering on a visa type, whether IR, CR, K-1, all go through their own type of questioning. The order hadn't been signed so even if that order didn't exist, seems you would have gone through same thing regardless because that is how immigrations works. My partner, didn't get grilled or anything; but waiting and took him 2-3 hours in Dallas, was one of the last people from his flight that got through finally. Glad you made it through though.

Ben&Zian got a reaction from LorRie in Have not yet met the parents, will this effect the k1 process?
Agreed with above. Also depending on what country the beneficiary is from, this might not even matter... If the country of the beneficiary has a strong culture where family approval is needed, definately meeting of parents is huge; but for a lot of countries this is not even an issue. My partner and I never met either one's parents.

what about the person's life that was changed when they did not get the spot that you had gotten. there is only one way to fix this. invent a time machine and go back and tell your past self not to cheat.
you are marked from this point on as a person whose credibility is tarnished and only many many years of honorable actions can allow you to gain back some of your credibility.

Ben&Zian got a reaction from Lexi and Shay in K1 Interview Scheduled But Still Concerned!
CO's generally make decisions on things before the interviews themselves, so as for the denied tourist visa, that shouldn't hold anything against you. A lot of people on here get denied one. Long as you were honest on the application you're fine.

Make sure you both resubmit "updated" letters of intent to marry. You can definately add in letters from others and even a tentative wedding date with a court; but this in itself can always be canceled/changed so I don;t know how much weight that actually holds.

If she makes above the poverty line, she should be fine on her own as long as she is going to retain that employment of course. Your mother you said? Is she a USC? I believe only USC's can count as supporters for the I-186 since it is a legal binding document (i may be wrong; but if she is then that is fine)

You have an approved K-1? Why would you cancel it and switch to a CR-1?

Do you mean approved K-1 as in the NOA2 for the I-129F?

What "complications" with the embassy do you mean?

And just going from a K-1 to a CR-1 does not change these "complications" or make them go away. You must correct/fix whatever these are.
