To clarify, your filing status on your IRS income tax return is determined by your marital status on Dec. 31 of the tax year.  If you were single on Dec. 30, 2017 but got married on Dec. 31, 2017, you would have to file as married (filing jointly or separately) for tax year 2017.

SAJourney got a reaction from NikLR in CR-1 Question : Request of Marriage License? What does this mean?
    Hi Angelica,

Just wanted to clarify one thing.  You keep writing 'license' and not 'certificate'.  USCIS needs the long form, large size, frame size 'certificate' (exact name of the document depends on the province in which you got married).

I know that in Ontario, you need to obtain a marriage license before you to get married.  And then after marriage, you can apply to get the certificate which proves you are married.

Nattie, congratulations!  Your updates helped me through the long wait as I'm sure it has helped many others.  Best of luck on the next leg of your journey!

It might be a language issue, but I would refrain from using the word 'lie' in describing any inaccuracy in the CO's report.

As others have suggested, your wife will need to put together a very clear rebuttal to each of the four points you listed in your initial post and send this to USCIS before the 30 day deadline to have USCIS reaffirm her petition.

A lawyer is definitely advisable.  Even more so, if her command of the English language is not strong.

Not sure why you are questioning this requirement.  It's a clear requirement for the AOS which in turn is a clear requirement for the IV application.  Certainly clearer than requirements like providing evidence that you have a bonafide marriage.

I mean, why have this whole I130 petition, IV application and the associated reams of forms?  Why not just show up at the POE with your marriage certificate and spouse?

Entering on a tourist visa with the intent to immigrate is grounds for deportation.

I'm sorry if I what I said earlier was misinterpreted.  I was just trying to say that the rules are what they are and that in an ideal world it should be as simple as having your spouse show up at the airport with a marriage certificate and you showing that you are a citizen and/or a resident.  But unfortunately, it is anything but simple.

If she doesn't need to work and has limited ties to Canada, why not do a K1 visa instead and get married here.  I believe K1's are processed much faster and she can stay with you after you're married.
