  1. My personal experience says an attorney can cause issues. Anyway, my point is that we did wife's N-400 (5 year rule) in about an hour online. Uploaded the following: 5 years Tax transcripts Proof of my 1st marriage Termination Proof of Wife's 1st Marriage Termination Wife's Green Card Our Marriage Certificate Good luck.   3. Unless it was an expedited case, immigrant visas are normally scheduled by NVC. Has NVC told you that the case is Documentarily Qualified?

  7. As proposed, it is not possible. The petitioner (Son) must have domicile and reside in the US. He does not and does not have a plan to do so.
  8. If the case has been received by USCIS, you are stuck until they get around to processing it. My wife's case took 44 months before it was approved (in a combo N-400/I-751 interview). I suggest filing an N-400 as soon as eligible. Nothing more you can do.
  9. Enter the name you want on the new Green Card. Attach a legal name change document such as marriage certificate.
  10. Since it is a spousal visa case, yes, the NOID will explain. You will have an option to appeal.

  12. In what country do you currently reside? When were you denied? Evidence of strong ties to your home country is the only solution. Being a remote worker does not help your case. Why must you be physically present vs video conferencing for the meeting?

  15. Bottom line is that you cannot live in the US without first obtaining a proper visa. You cannot live in the US during the spousal visa process, although you can make short visits at the discretion of CBP.

  21. It appears the I-130 contained some ambiguous information which led USCIS to question whether this was an Adjustment of Status case or a Consular Processing case. I suggest you submit the I-824 as directed by USCIS. Your attorney should know that, imo.
