    Even though no one has read this as of yet, I wanted to give an update...
    My fiancé called DX again because when he called them yesterday, we found that we hadn't received info from them on how he'd be notified. Upon speaking with someone today, they said that the visa is scheduled to be delivered tomorrow, November 30. We were shocked, but the lady said it had literally been updated as of an hour ago.
    Also because some others on VJ had said that they had to select "rebook for delivery" on the DX website in order to schedule an actual delivery date, I expected to see that on their site, but it just said delivery was set for tomorrow. And we received no email from the embassy about his visa being issued to the courier. Everything in this process has gone differently than expected for us it seems, but at least we're almost there now.

    It's midnight here. My fiance just picked up his passport at his hometown location in India. The CEAC status STILL says "administrative processing", but the passport had the visa in it. AHHHHHHHHHH THANK GOD!!!! I am in tears.. in a good way this time. Thank you all for your good wishes. I am shaking!! Now just to get him here asap! I am BEYOND relieved and happy.

    OK, I understand your frustration. The fact is now you have a RFE, whether it was a mistake or whatever it must be resolved. Everyone can bark on the requirements but A simple letter stating:
    Statement of Fact
    I ____________ have never acquired or presumed another name other that what was given at birth and is currently in use

    ___________
    It may also be helpful to attach supporting document such as a copy of the birth certificate and current passport.

    Yesterday ceac website went to administrative processing, today early on the morning it's showing VISA ISSUED, 2 visas, my fiance K1 and his baby K2, we are waiting for it to be sent to dhl place to pick it up.
    I am not in this world now, still can't believe it, surprised and confused, it was a very hard bumpy road going toward each other, I need time to process it or better him here and shaking me at the airport, wake up Tasha, we are here

    Best of luck to you and your family, I hope it goes well. While this is more than some people get, as some get to the interview and have a straight up denial, this could be a way for you to prove you not "addicted" or currently smoking weed and won't in the future.

    Trump hasn't done anything of the sort. If you choose to believe all the nonsense the media regurgitates, so be it. That is no ones fault but your own. Racism has been going on for the last 8 years, and longer than that ...who did that? Not Trump.

    Totally surreal. Alex said they moved him through so fast he didn't wait for anything. He walked straight into the embassy through security, they called his number the first time about the minute he sat down, then he woke me up and we chatted for like 30 minutes before he was called up for the interview. He was approved, but he has to send in his birth certificate because he accidentally brought a copy instead. But he's already gotten the email with instructions to send it in so we're hopefully still on track for a flight the first week of December. I'm so excited!!! And so happy!!! What a journey lol

    I was allowed in the interview! My name was on the list even though we never received an email confirmation. I left my large suitcase at Excessive Baggage in Charing Cross station. I was allowed to take my backpack into the embassy. Everyone was super nice! (Ceisenbruch, I tried to look for Alex but there were so many guys who looked tall but no one really stood out to me.) Robert was approved... Sort of. They have to call ACRO to confirm the info about the No Live Trace on his UK police certificate ( something that happened when he was 15, that never went to court and was filed as a reprimand). I asked the lady when we could expect the visa even with them having to make that call. She said that we could expect it in 1 to 2 weeks. Oh, and I was asked questions as well haha!! So yes aside from the fingerprint scanner malfunctioning which made us have to stand there for about half an hour at the first window, it all went very smoothly!! Yay!!

    Tomorrow is the day!
    In a few hours I hop on a plane and head to England! Robert is already asleep so he can wake up at 2am. I arrive at 7:15am (supposedly... we'll see how many times the pilot is forced to circle Heathrow), then it's a mad dash to the embassy! Well, it may not be a mad dash... a nice leisurely dash haha!
    I'm so nervous but mostly excited!
    And Ceisenbruch, if I see Alex (I believe that's your fiance's name...), and everyone has time, etc, then yes, we will get a selfie, BUT they don't allow photography inside the Embassy, so it'll have to happen outside somewhere... maybe next to the Ronald Reagan statue which is outside apparently. Ha! If I even remember. It's going to be one crazy day.
    I'll post an update Friday most likely. But omg, our interview date is finally here! Yay!

    OP, I think your best bet is to go for a K-1 visa, unless your fiance would like to come down to Mexico and marry you and you instead try for a CR-1. The overstay should not be a problem since you didn't stay long enough to incur a ban, but you will have to declare it when asked. You would have the opportunity to explain at the interview.

    I'm just pointing out the rudeness of your message. You didn't come here to help, but to try to make me feel bad about mistakenly breaking an immigration law, which I already clearly do, I never said I didn't know or that I didn't care that what I did was wrong.

    why do people feel free to attack strangers?
    my overstay was honest, as I completely ###### up the dates, for a FEW days. It was the first time, and it wasn't a malicious, intentional overstay. I am not making excuses for myself, I fully recognize I broke the law. That still doesn't give you the right to be that condescending and downright mean.
    Also, doing things legally is NOT the convenient way, it's the right way. It's going to take a lot of time, effort, money, and me not being able to be with my fiancé. I didn't just fly there, got married on a tourist VISA and commited fraud, which is the ''convenient'' way.
    I heard they were being taken away, didn't know it already happened. Thank you! we will see if that one is a better option than the K1 for us.

    Wrong. A K-1 visa is not to see if you want to get married (despite what TLC will tell you). It is for two people who have already decided to marry and who are ready to marry to organise a legal wedding. The 90 days is not a "try before you buy" period. It's there to give the couple enough time to organise all the aspects of their wedding - find a venue, buy a dress, order food, etc. No one should be applying for a K-1 before they are ready in their minds to marry. Some people are ready after one visit. Others require more. It's an individual thing.

    Good morning! Thank you all so so much for your support and kind words. It really means a lot to me. It's comforting to know that I'm not just overreacting, being dramatic, or crazy, as he claims that I am.
    When I got home last night, we sat down and talked for nearly 2 hours. I explained to him why I have been sad after the election, and that I wish I had had support from him. It took a while for him to sympathize a little with what is happening in this country right now, but he said that he couldn't really relate because it doesn't really affect him. He found it hard to believe how some immigrants, women and minorities are suffering due to this election, and thinks that it's just the media exaggerating, despite me telling him stories happening in real life around me. He said that white people founded this country, and black people were transported here as slaves, and immigrants should be grateful to be here. A lot of his racist and sexist comments really pissed me off but we were able to keep the conversation peaceful. We went back and forth with our different opinions and values, and just could not agree with each other. I told him that I'm not upset just because we hold different opinions regarding political issues, I'm upset because we apparently have very different fundamental moral values.
    We were able to make peace. He said that until we are apart, he won't give up. Being in the middle of AOS definitely does not help with the situation. We agreed that we will wait till after the interview that's coming up. And if we are still not happy, we will end the marriage on good terms. I feel like that we have both been in denial that we've just become very different people, and the arguments back and forth are exhausting for both of us due to our different goals and values.

    I guess you have to decide if this guy is worth any more of your life. Seems like we have forever when we're young...but we don't. Your life clock is ticking, and I imagine if you go on from here, in a few years you won't be pained anymore by your decision.
    You can start assembling your paperwork now, quietly, and then divorce and Remove Conditions on your own. That's probably what I would do in your position. In fact, just making a decision ("I stay" or "I go") can help you feel stronger.
    Best of luck to you, and sorry you had to hear and read stuff like that from someone you wanted to depend on.

    Get an attorney asap. When my childrens father found out that I was dating someone outside of the US, we went to court and he had it put in the court orders that I can not move my children 50 miles away without going back to court, and having an approval of a judge. Also, I disagree with whoever said it sounds like you're trying to force her to stay. You didn't ask how you can make her stay, you are asking about your child. I get that the child needs her mother, but you are the father and you do have rights to that child as well. But before you jump the gun, make sure this is her plan 100% and that she's not just going through postpartum depression. That this isn't just a threat, or a way of trying to get your attention.

    Honestly, your case was denied based on lack of evidence. Just from what your fiance says, it seems like they don't believe him, it also seems like he may have stumbled through answering them, which makes him more suspect that he's not telling the truth. If she was pressuring that hard on finding a mutual friend on Facebook, she most likely already had her doubts of the relationship, him not being able to provide the answers just sealed the deal.

    I agree with Lioness, evidence needs to be strengthened. More visits, etc. The more face time you have, the more legitimate you look, face time is one of the strongest evidences to have, quality evidence vs quantity of evidence.

    I know you feel that the FB issue is the only reason for denial. However, that was just a factor in them not believing the relationship is real. No IO can list "no mutual FB friends" as a reason for denial to USCIS. The true reason will be listed as not enough bonafide relationship evidence.
    So...before refiling please take steps to strengthen your evidence. As one poster suggested...more visits or marry, and file CR1. No, simply just refiling will not guarantee success. Please be proactive.

    When did he say he was going to stop green cards for one or two years? In March, he said he would like to see H1B paused for a year or two because there are Americans looking for work who could do the jobs the people on H1B are doing. These people don't have green cards. They are temporary workers.
    Remrmber he was just saying what his supporters wanted to hear. Many of them don't actually realise that he alone does not have the power to do any of this. He won't even be in office until January and even if he decides to change immigration policies it will take years. Nothing will change overnight.

    I hope everything goes well! Fingers crossed!
    My fiancé was super nervous but from what he says, they totally understand it. And it makes sense. As someone said before, it's a third person, with who knows what kind of governmental and personally subjective parameters - of course you will be nervous. I think nerves shows emotional investment and won't count against you either. Focus on what an incredible relationship you are fortunate to have! Your story, like everyone here is unique and special because it endured distance at a time where people in the same city have difficulty connecting. This isn't going to get in the way of it, no matter what!
    All the best to you and anyone getting nervous.
