I mean irrespective of who to blame, but there is a backlog and we are the lucky ones to apply in the time where there was one

I wish atleast tracking case had some extra info that would say that your case is stuck for xyz reason, there are x no. of cases ahead of you and your status would most likely to be changed in y days

That would have been nice. But I think most of the process is automated and none really knows the big picture of your case until it is handed to a particular IO.

Joe&LuMa reacted to JFH in Apply for us citizenship.
To become a USC she must first be a permanent resident (green card holder) for five years or 3 years if married to a USC for the whole of that time. She will need to be married for 3 years before she can apply or a resident for 5 years if not applying based on marriage (that will probably happen first so she may want to pursue that route).

USCIS is a black hole where logic and all the laws of physics cease to exist.

Hey buddy, i did call them in the begging of last week before i joined this forum and basically they was only be able to tell me the same as USCIS status check page says... No details, no nothing... And they held me for about 15 minutes on a line...
Worth to call only if you have a special number of the right person i guess...

That article states last year 98% of immigrants were under the top priority guidelines. So thats 2%. I wouldnt call that significant, but yes, it is more then 0%.

What is the rush? I personally set my anticipated date of becoming a citizen to the end of October just to be realistic. I was hoping for august. I then modified and added 2 more months given the current chaos.
I calmed down a bit after that. If it comes out earlier, fine, but I am not planning anything that would require citizenship before the end of October.

You seem to be a bit lost about what is going on.
The court day Thursday is for her DV arrest right? You need to go to that. When you go they will most likely ask you (repeatedly) if you want to continue prosecuting the case or not. I say most likely because every jurisdiction is different. In some, they dont need the cooperation of the victim. In others they must have the cooperation of the victim to proceed or the case gets dropped. Be prepared to tell your story about what happened that night. Remember its not up to you to decide "punishment". Your only responsibility is to tell the truth. Let the chips fall where they may...
You seem to have gotten a temp order of protection for 10 days. These are given on an emergency basis. Basically that means a Judge can issue you one with out hearing the other side. This is a temp order ONLY until both people are able to appear in court. Your court date is Monday. On Monday you both show up and you go "first" and tell your reasons why you need the order to continue (how long they remain intact for again depends on jurisdiction. You seem to be under the impression its going to be for 1 year, it could be longer). So you tell your side and then she tells her version. The judge can ask questions. Both of you are entitled to an attny. Either you or she can ask at that temp hearing for more time to get an attny IF one side shows up with one and the other side doesnt. You can probably even ask for more time to get an attny if neither of you show up with one. In those cases the temp order will be extended another week or so to give you the time you need.
You can get an attny most likely from your local pro-bono legal aid group. Restraining order proceedings are given priority when you contact a legal aid group and I believe in most states you can get an attny at no cost for the process of obtaining one regardless of your income. The reason is they (the attnys) can be paid from a court fund... You know how when someone commits a crime they pay a variety of fees and court costs? One of the fines goes to a money pool for victims of crime to use for attny costs for restraining orders.
You should also look into (google) crime compensation funds. They can reimburse you for time lost from work, damaged property etc. Again, region specific.
Anyway, in answer to your above question which I simply answered "No", you seem to be thinking this is a bigger deal to the court then it actually is. To the courts these DV offenses are almost as mundane as processing traffic fines sadly. There is NO big investigation. There is no CSI! lol. Perhaps if she gets a high paid attny they can file motions for things like computer drives- but if something like that was to happen her attny would have to file a motion. The prosecutor would be able to respond as to why they shouldnt be able to have your hard drive. The judge would have to approve the request for you to give over your harddrive. Nothing would be "deleted" from it. It would be an inconvenience of not having it while the court does. But the court is not going to order your hard drive examined for a minor DV case.
The above is my honest opinion. If it makes you feel better- get an external drive and back things up, but its not going to be needed.

That's a dangerous strategy when it comes to immigration.

You and millions of others, including us here on VJ, are experiencing the same thing. The angst of being separated from loved ones during the process.
We've all been through it and have come out fine.
Don't break the law.

Harmonia-
Personally I feel what happened would have happened differently under Obama. Under Obama people who did not have violent offenses were allowed to be 'deported' by a Judge (deported simply meaning the Judges puts in an order of deportation for them)- so they would have an active 'youve been deported' on them, but they didnt have to actually leave! They would just check in every 6 months like the OP stated above. Obama was looking the other way so to speak.
I cant remember the exact number but it was shocking high of how many people have active 'youve been deported' orders against them and havent left and have been checking in with the government. Many of them have gotten stopped when going in to check in. Others have taken 'sanctuary' in churches and other locations and not checking in. This is because of Trumps orders. He says if you have a deportation order then you must go. Doesnt matter if you are violent criminal or not.
I understand your position of priority to violent criminals going- and I totally agree they should come first. But on the other side of the coin theres space between having a policy of: everyone who was deported by a judge MUST leave and - not being deported AT ALL. Obama was not at all. Trump is every single one.
What I find horrible about the whole situation (and this has happened to hundreds of families besides the OP) Sometimes the 'mothers' who were deported stay. And the longer you stay, the harder it gets to leave. So when they are now forced to leave its devastating to everyone. In that way- I prefer Trumps policy. Its like pulling a band aid off quickly.
To the OP=
Im pretty sure you guys have a daughter together right? Im not sure about sending the girl to the PI. Your ex might be bitter about everything that has happened and may attempt to keep your daughter in the PI when she comes to visit. The girl would be a dual citizen. Often in those cases when the child citizen is in a country of citizenship THAT country takes priority.
The PI government will consider her a PI citizen basically and may not honor your US custody paperwork. Speak to an attny if you do travel (before). But its more likely your ex will soon fall in love again and find a K or CR visa back before you can blink.

What she needs isn't your problem now. Refuse to take her calls. No contact, means no contact.
Focus on you and your children, the courts will determine her destiny.

Joe&LuMa reacted to EmilyW in Wife Been Arrested
Can't edit my post above, but just wanted to add...
OP, this woman has abused your children to the point that they will not be alone with her. She has abused your children. She has physically attacked you. Divorce her. Move on with your life. What she does now should be irrelevant. It's her problem. Not yours, beyond divorcing her.
Focus on rebuilding your life and stop putting her front and center. Focus on those kids. Pick her over them and continue to obsess about her, and you will lose them. And that is something you will regret.

You see harshness, OP, because you have been consistently given good advice on this forum, which you consistently ignore. There are good people on VJ who support everyone: but it gets monotonous when someone asks for advice, ignores it and then comes back asking for advice when it all goes wrong.
Please cut your ties with this woman. Why will you fall apart when you see her? Do you often fall apart when you see people who have abused your young children?

I also moved after receiving temporary card and change address TWICE on the website just to make sure it went through and guess what... The letter regarding removing conditions was sent to the old address, why? I called USCIS and spoke to tier 2 officer and she told me that since my case was closed update wasn't recored on my case.

LET HER GO AND MOVE ON!!!

They want to know that you:
(1) can understand basic English; which is the "most commonly used" language in the USA (I put double quotes on it because commonly used language depends on which area you live in)
(2) know US history, politics, and culture; which makes sense because why would you want to be a citizen of a foreign country you know nothing about? (Pretty similar to choosing a spouse or business partner - you don't want a binding contract with someone you don't really know)

I don't meant to be rude but nothing is going to change. Every few weeks / months, the OP comes onto the board with another story of woe about his wife. He gets good advice, ignores it, disappears. Wash. Rinse. Repeat.
I'm glad the ex-wife has her wits about her and is prepared to protect the children. Cos, while he initially thought of them first, his mind quickly turned back to the wife and her situation.
