    First of all your assuming. Secondly, there is NO INTREST in defrauding the govt! Thirdly my man may wish to divulge what he likes I on the other hand choose to be more conservative and not throw him under the bus! What I will say is that we are in the right tract!     OP's wife for the info from NVC. So y'all should quit with the meanness.
    I would be confused too if I was told my case was not denied even though I was told I had been denied.
    Pursuing it may be futile at this point since OP has since married. But it should be something for us to learn from.
    If an applicant is denied, doesn't the record get entered into DOS system? Does the case has to be physically here for USCIS and NVC to know it wasn't issued?

    Please stay in your lane he is my man and I am his woman and according to the Islamic faith I AM his possession and I have no argument or issue with the protection and maintenance from him. Don't ever confuse who your speaking with. We are finances and you have no idea what we are comfortable with so do not overstep your boundaries. I have been quiet in this whole thing but now people are going to far.

    OP has married. I posted the link to his other thread. K1 is null and void.
    I call my husband 'my man' too. He is my man. I am his woman, I don't see it as a possession and it's very acceptable
    as a lovey dovey term in different cultures.

    First of all Shisu is the least harmful person I know, I don't appreciate your negativity on our post. And our case passed through every facet of the process in the attempt. Her personal opinion of us and her unwarranted speculation has no BASIS in approving or denying anything.

    The reason NVC and USCIS don't see a returned case is because it has not been returned YET.

    Ghana will sit on it for about 6 months before they return it to USCIS and once there it will die the death of expiration.

    You are married now and the whole K1 is mute.

    File a I-30 to start over.

    I do not think it is that complicated, he was seeking to adjust in country and no longer is, will have to go through the Consulate.
    Consulate will interview him eventually and Ghana is not an easy Consulate but I assume in this case the usual issues will not apply.
    He will be found inadmissible on by the sound of it it 2 counts, misrep and the overstay.
    Files an I 601 to the lockbox, plenty of time to update it.
    Wait for approval.
    Obviously not a quick process..

    So technically your husbands friend is the one that entered the country not your husband, The original AOS was doomed over that detail ( I have a Nigerian friend of my spouse that has been fighting this very issue for decades and thousand of dollars later the ruling is the same . He wasn't inspected as the inspector was under the assumption that the were clearing the party who's ID was presented ) Beware of immigration lawyers who will give you hope in the cause of fattening their wallet.
    The collective experience here is that you must be denied to be eligible to file the waiver. You have been told otherwise , and there are always exceptions to every rule ( I know a Nigerian that voted for president and still got his citizenship approved , which is also a "it won't happen" situation ) If you are correct you are looking at a year or so before he can return. IF the case follows the timeline we are used to here it will be closer to 2 years. The entry as someone else is a material misrepresentation on top of his overstay so your case is more complex already. ( At least the friend wasn't a USC ) The entry posing as someone else is probably your more serious issue. You may be dealing with a non waiverable ban over that stunt,

    Speak to an atty you need one badly, no more DIY, Please understand the IO in field offices
    often gives incorrect info as they have not studied immigration laws they just implement
    the jobs discription they get posted at. An I 601 is sent after an interview & denial with an
    approval to file such waiver. you can google & call atty Lizz Cannon for free phone consult

    i think our age gap is probably one of the biggest and he is from high fraud country also
    you will need to do much more than normal applicaiton to prove the relationship
    we went thru 3 (K1 and 2 CR 1 interviews)
    Eventually after 6 years we finally got the visa
    What i had to do was what most do for the AOS
    i had to do quick claim deed adding his name to deed of house
    i had to apply for ITIN when filing my tax returns and then add him to bank account
    i added him to life insurance, will, 1 utility billl
    So, in 2015 at last interview, he had been on tax returns since 2010
    this will be a struggle for you and i wish you best of luck but remember
    Do not take the frustration of immigration out on each other
    Do not quit
    Stay faithful to each other
    And prepare yourself by good face time ( i made 5 visits of 2 of 1 month, 2 months, 2 three months), photos of not only you and spouse but with family in Ghana
    lawyer is not much of a help (had 1 for 1st CR1 and he was worthless)
    If denied, appeal is waste of time and money, just reapply
    all this is only my opinion but been there / done that

    So here's my update. On Saturday, I got the 2nd NOIR and all they want is my divorce decree from my first marriage which has been sent today to the attorney and he will send in ASAP. My attorney says, he believes that's the only thing standing in the way of our reaffirmation He said if they had other issues, they would have stated them in the NOIR and that's the only thing they requested!!!! Yippee .... still praying

    Greetings to everyone...... I want to encourage ya all who are still waiting for USCIS on NOIR to hold onto ur faith and trust in God Almighty. Don't ever give up. Reaffirming of all ya cases is on its way. One thing I understand with USCIS is that cases are different. My wife received our NOIR on September 13 and we sent out our rebuttal on on September 30th and uscis received it on October 4th on October 24th our case was reaffirmed and returned to DOS. We re now waiting for NVC to return it to the embassy... I know a lot of people who be been waiting for some months now I bring u good news soon you will hear a good news from USCIS... Thank God for Skype at list we see each other everyday it helps a lot on this long waiting game.... 18months from when uscis got our case from the embassy to when it was reaffirmed. is been a long journey.... Cheers...

    I'm the beneficiary and I've sent thousands of dollars to my husband over the years because when you're in a relationship, you support each other financially and emotionally. With that said, we did not included money transfer receipts as evidence as we were afraid it would look like I was buying a green card. I would not recommend sending money transfer receipts because it's too much up to interpretation of the CO, whether he'll see it as support or money for green card.
    OP, once you get the letter from USCIS, you'll hopefully know better why you were denied and how to overcome it.

    See, you are from Germany or your beneficiary is from Germany. So it wouldn't make sense to a CO that a German citizen would want to pay someone in other to come to America.
    Europeans are given the benefit of doubt. You have to really mess up to get denied.
    But when it comes to Africa, we are all demonized due to the action of a few.
    It took my over a decade to get us together here. Ultimately, DNA was our saving grace. None of the letters, money transfers (probably caused most of our denials), family photos made a difference.
    Exchange of money is a red flag for those of us dealing with African beneficiaries.

    Come on guys, why can`t you give your wife/husband money if he/she is making much less? It would be fraud in my eyes if you would NOT sent money. During the times my wife was a student, I always supported her as well, total normal, total legit, and to the contrary, If you don't support it looks and most properly is fraud.

    I know that you cite your personal experience of having to refile as the reason you keep advising this but it really is poor advice to others. Refiling without even knowing or addressing the reasons for denial in the first place is terrible advice.

    Who said adding Money Transfer receipts is classify as being used for money ? and who also said spouse can not send money out of Ghana .. Spouse can send money out of Ghana by using bank wire transfer. Adding money transfer receipts shows financial support . In my case, My wife sent more than 15 money gram receipts indicating on it what was the money sent for and i also went to the interview with more than 15 money gram receipts. those my wife sent shows as sent and those i went to my interview shown as received.. So correct yourself in your statement please .

    The process for a returned CR/IR petition is :
    1. Embassy sends petition to USCIS with recommendation to review or revoke.
    2. USCIS sends a NOID/NOIR letter to petitioner listing the reason(s) why the visa was refused.
    3. Petitioner has 30 days for a response rebuttal.
    4. USCIS if satisfied with the response rebuttal and relevant evidence, re affirms petition and sends it again to the embassy with recommendation to approve the visa.
    5. Embassy interviews beneficiary a second time.
    The bad news is this entire process can take 12-18 months, some less some more.
    Filing another petition with the previous one being still very much alive will cause more problems, you pay again and probably end up
    with the same result of refusal and return.
    Wait out the process, visit more, gather more relationship evidence, ask your spouse for the exact and detailed questions
    and answers during the interview.

    As someone else said, they can manipulate their results by rejecting cases that they feel won't be successful. As a commercial enterprise, they are within their rights to turn potential clients away if they do not wish to do business with them.
    The official approval rates are probably higher than we think. We are all naturally nervous that we could be denied. I am worried that I might be denied at the embassy in London, even though London denials are almost unheard of. I did Google 'London CR-1 denials' and found a thread on another forum where people were posting about their denials but they weren't flat-out denials - they were 221(g)s for missing documents or financial requirements.
    Take a look at '90 Day Fiance' on TLC and what kind of crazy cases are approved for K-1s. I shake my head in disbelief that COs around the world have deemed these to be valid relationships not for immigration benefit. And CR-1s have the advantage that they are already married and have (usually) been in a longer relationship than K-1s. On this very site I have seen K-1s being applied for after the grand total of 6 days together and a few months of online contact. Not criticising those relationships but I think we have a tendency as applicants to assume that the criteria for approval are stricter than they really are.

    hey guys, I wanted to share great news today, NVC sent our reaffirmed case to embassy on 30 of september, embassy received it on 6th of october, they called us the same day to give us appointment for 18th of october, we came at 11:30, since our denial to reaffirmation was very fast process in comparison to others there was even same CO- you can imagine our faces when we saw her, but she just explained when we can apply for citizenship and congratulations, she said if we can wait in the city for few more hours, they will issue us visas same day! they called us on 4 pm same day to come pick up packet with passports, we are flying back home tomorrow!!! thank you all for help and wish everybody who is waiting luck!

    We can't help you with fraud on this site it's against the TOS.
    Canada has nothing to do with this it's the laws of USA, the country you want to live in so you should follow them.
    Also No it's the way you do it. USA is very friendly and open to immigrants, just follow the rules like others in here.
