I may be wrong, but I don't think the N400 requires this much "evidence" of a comingled marriage.

    Yes

Yes you can file the N400 online if you are eligible to do so.  See here for instructions on how to file online: https://my.uscis.gov/exploremyoptions/us_citizen_through_naturalization#benefit-related-content-2  I filed my N400 online, and for me it was beneficial and has so far been a very quick process from filing in July to getting an interview scheduled in September (you can see my timeline in my signature).  Whether it's better or not, I would suggest you do your own research on the possible pros and cons of filing online before making your decision---reading other threads here on VJ helped me decide to go with online filing.  Both ways are "safe", however.  The online filing does have a slight edge in "safety" when it comes to worrying about applications getting lost in the mail, however.

If you haven't even filed the application yet, might be a bit soon to begin cramming for the test   However it's good to become familiar with it for memory retention purposes.

It won't affect anything, no.  They won't ask about whether you've ever used it or not.

So long as trips outside the US are no longer than 6 months, and your total time spent in the US in any given year is longer than your time spent outside, it does not become an issue.

1 for each year in terms of ease of reading/viewing purposes.  Each transcript is only a couple of pages long, so it won't weigh down your postage or be long to upload (if filing online) if that is your concern.

No.  Intent is determined at POE when you crossed the border.  The only way they would question you about this, is if they began to determine that you received your GC fraudulently...considering you already passed your AOS, and proved your bonafide marriage/relationship you have very little to worry about in this aspect and the most you may get at the N400 interview is the question of "how did you meet your spouse/how did you obtain your initial greencard"? Don't worry about this part of your application too much.  The IO interviewing your for the N400 will have your entire immigration file infront of them so they will already know this information beforehand, anyway.

I'm not sure why you think this would affect your application for citizenship in any way....but, no, it doesn't affect anything.

In some cases, yes.  The i-765 and N400 are two different applications sent to two different departments, and should be treated as such.
You are required to submit evidence pertaining to the previous 3 years since you are applying under the 3-year marriage eligibility.  In terms of any arrest/convictions, you are required to submit anything covering your entire life no matter what country it occurred in.

    Quarterly is fine.

I know that if you have property there but it's not being rented, you don't need to pay taxes on it. If you're making money out of it, then you should be paying taxes.
if you haven't filed your taxes stating you were no longer a resident, you'll need to amend your past years taxes. Also, you could only be declared as a dependent if you were under the requisites listed, I put the link in your other thread.
seems like you don't really know much and the lawyer you have is not helping much, so I urge you to find professional help who is versed on not only taxes, but taxes for expats

any government Id will be fine. you only need to show the noa1 when entering the us so domestic travel does not need it. however legally speaking you must carry it at all times for proof of status and can be changed with a misdemeanor if you don't have it, minors are exempted from being required to have proof of status with them.

The website of the U.S. embassy in Brazil, where I think you got the above, also says this:
"If you are an LPR with an expired Green Card, you may not need to file Form I-131A. We encourage you to check with your airline or vessel before filing Form I-131A." (https://br.usembassy.gov/visas/green-card-holders/)

I have no personal experience with this -- but -- might it be the case that some airlines allow the expired card + extension letter, while others as a matter of policy require you to file a I-131A? Check with the airline you intend to fly with?

All best to you, your father, and your family at this time.

You can visit US embassy in Brazil before returning to the US. You don't need a re-entry permit. Your GC is valid and you have the extension letter. Contact the US embassy in Brazil again when you're there if you're still concerned. The embassy can issue whatever documents you may need in order to return to the US (as they do for those who lose their physical GC abroad). So don't worry.

In absolutely worst case scenario, if the airlines are acting irrationally and against the guidelines from the US, you can fly back from another country or with a more sane airline.

Please relax and focus on the time you spend with your father.

You are ok to go on the trip. Your expired green card is valid for a year after the expiration date. Make sure to bring it and the extension letter (DO NOT LOSE IT). Upon re-entry, it gets a bit tricky because you cannot use the automated scanner at entry - you have to go to a physical border agent who will ask you questions and manually verify the information is correct.

I'm sorry your father and family is going through this. I'm wishing you all the best.

bahamamama234 got a reaction from Michelle13 in Fees were waived
Hey guys. Regarding the ''fees waived'' that we think is a technical issue, apparently that's not. I called them today and got clarification

Read the last posts in my topic to understand

bahamamama234 got a reaction from Michelle13 in Once filling for removal of conditions is it recommended to call USCIS since online status is not working? How long should you wait to call USCIS?
    So check it out (lol)

I just filled in an E-request (Online request) Regarding the ''fees were waived issue'' and stating I never requested for a waiver and I want to make sure all is in order because I've done biometrics and I have extension letter already so I just want to make sure it's a technical issue.

Once I've submitted it online, they called me. I guess it was a Tier 2 because he didn't just read what it said online, he asked for all my receipt numbers...

Then he said ''The first receipt number you have for I751 once you paid the fee it generated your second receipt number for CR189. You go by and use the CR8 receipt number, that's the number that says fees were waived. The reason it says that is because you already paid for I765 so once it generated the CR8 your fees are waived, all that it means is you paid for all. Once you receive your green card you will see it

So I guess that kinda clarifies why so many people have the same ''fees waived'' issue online....

I like that he said ''once you receive your green card (have I been approved? Jk I know probably not yet but funny how he said that.)
and he said ''you have your extension that's all you need to work and travel, it takes 9-12 months to approve application if you don't have it approved by then we give you another extension letter..

bahamamama234 reacted to menina in Can I apply for citizenship while awaiting ROC? Can brazilians have dual citizenship with USA?
Yes, you will need both passports. Before you board the flight in the US to go to Brazil, they will require your passport as proof of being able to enter the country. Once you arrive at immigration in Brazil, they will also require it. If it is going to expire before your trip, you can renew it here at the Brazilian consulate. It looks like your local office is in Los Angeles. I believe there is a consulate there. If  you go to their website, there should be instructions on what you need to do to renew the passport and if it can be done by mail or only in person. I don't remember exactly, but in our case, we just went to the consulate with all the necessary documents and had the new passport in a couple of weeks. It was pretty easy. I saw  your other post about waiting until you have citizenship to travel (once the green card is expired). Even though it is possible to go with the GC and extension letter, my husband and I decided to just wait for the new green card so that we could travel worry free. You never know with those Brazilian airlines how much they understand US immigration stuff. In our case the ROC was  not that long, so the new green card was in hand before citizenship was an option. Hope that helps!

    Here are my two cents:
Yes it is safe to travel with an expired green card and the extension letter.
Yes you should get a new ID before going. Keep in mind that some states have restrictions on license renewals for people with expired or soon to expire greencards, so I'd recommend renewing that sooner rather than later. You can do a little digging in the forums here for info from your state.
Regarding letters from USCIS while you are away, I would make sure you have someone checking your mail so they can let you if anything comes. That way you will know if you need to return home sooner than planned.
As for the Trump Administration being in control when you return, I don't think you have to worry about that.
Good luck and have fun in Brasil!

The original (expired) green card and the original extension letter are the two things required.

On top of that, the airline will most likely want to see your valid foreign passport.

You can maintain your Brazilian citizenship and obtain US citizenship. I believe you can apply for citizenship while ROC is pending as long as you are eligible. If you search for that topic here on VJ, you should be able to find some members that have done that. Hopefully it won't take that long!

Thank you! before your reply I called them and went through putting in my application receipt number so I was transferred to a guy that read the whole sentence that shows in my USCIS online case check status ''Your fees were waived bla bla bla'' I told him no I did not request for a waived and they cashed out my check I have already done biometrics I just wanna make sure all is in order.

He said ''Oh if you did not request a waiver that's a technical issue I have to transfer you to Tie 2 but I can't transfer in evenings (are they scared of vampire calls? lmfao) So he said I have to call tomorrow as close to 8 am as possible

If you don't usually have issues with mail going missing then you should be alright on the RFE front. Keep an eye on the processing times on USCIS' website and if yours goes over, give them a call and see what's up.
