    I would try if you had the time. Early walk-ins are highly successful in the west village office at least. I arrived about 30 min early for mine and was out before my appt. time

    Haven't you read about the aos requisites at all? What about what you had to do once getting to the USA? This is your new life and you should be on top of things so you can transition easier.
    You should order a new copy of the birth certificate, have it translated if not in English, get i94 online, go for the Ssn, get your docs ready for aos... so many things to do! Get to read the forums, guides, flow charts, etc. good luck

    No, I didn't say that at all. Re-read what I actually wrote.
    I said that they are requesting the proof from me (beneficiary) of intent to marry and that I had already sent it. I sent one for both of us.
    I never mentioned anything about the petitioner's letter of intent to marry, because it's irrelevant, since it was already sent and they are not asking for that in the RFE.

    I have no idea how one's sister witnesses the non-consummation of one's marriage. Perhaps she was in the bed with them every night making sure no hanky panky took place? This witness is bogus at best.
    Wanting immigration benefits (a GC or citizenship) that one is entitled to is never a matter of shame. If she divorced and filed with a divorce waiver and was granted a 10-yr GC and wanted to then try bring her whole family here, so what?
    It seems the ex husband thinks that divorce = no GC. Simply not true. I think the ex is suffering from "I thought I gave my spouse a green card and now I can take it back-itis". It is a serious brain infection whereby US citizen spouses believe they have some sort of immigration power.
    Treatment options include:
    - telling them to go away
    - laughing in their face
    - ignoring them
    - going on with your own life
    Apply treatment liberally.

    She has her 10 years green card.
    There is nothing he can do.
    She has nothing to worry about.
    If he wants to allege immigration fraud, he better have proof since no one will believe an angry ex-husband with flapping gums. Without proof, he's just an angry ex.

    Mine was received the day after I sent it and I saw my status update to AP. Received on a Friday and then Issued on the monday, received visa on tuesday. I'm sure you'll be fine, god know you guys deserve it

    Come on, you gotta agree that college isn't for everyone. And in the US, it's especially not for those who aren't blessed with money. While I agree that getting an education IS critical, I don't believe college is the only way to get one. There's plenty of avenues here in the USA, it's a matter of getting your foot in the door. Right now I think it's best he gets ANY kind of US work experience, whatever that may be. I don't even have my own career path figured out yet. I definitely agree with you on taking an English course. My question is should that come first before finding a job?

    Deserve to be caught? being caught for what, for a mutual agreement between her and her husband to stay married before her case final? for dated 5 years and decided to get married for love? for both of their effort to save the marriage but failed? for having a busy life in the way so not able to get a divorce right away? LOL why don't you save your daily dose of judgement to some other cases on the forum, it's really old.

    Not at all. The U.S has a population with over 320 million people, the vast majority are lower class borderline poverty. http://www.advisorperspectives.com/dshort/updates/Household-Incomes-by-State.php
    Median HOUSEHOLD income (i.e not one person's income) is $50k a year. Can't get far in NYC with a 50k salary unless you're by yourself.

    The why is unimportant; she is entitled to as a matter of law, if she can prove a bona fide marriage and abuse.
    I've seen the same question asked of widows and widowers of US citizens (myself being one of them). Frankly, it's no one else's damn business.

    File for AoS if you wish by following the guide linked above. The 30/60/90 day rule is a fallacy; it makes no difference how long you wait to file.

    And how do you think she does that without a car, money, or any resources whatsoever? This is a classic forced-dependency situation. He doesn't want her to be independent. If she wasn't interested in working at all, I might be singing the same tune as you. But when the husband actively prevents her from getting employed or otherwise bettering herself, alimony is warranted. That's partly why alimony exists. Her requests are totally reasonable. A little pocket money while he spends money going to a bachelor party? Give me a break. If money was tight, he wouldn't be traveling to a bachelor party and going to bars.
    If my future wife asked for something, and I told her we couldn't afford it right now - well that's one thing. If she asks for something and I say no, but I'll by myself a gift instead - well, that's another.
    It's a pretty negative outlook on marriage when the breadwinner gets to do as he pleases and the woman has to sit at home alone, with no friends, no transportation, and no means of caring for herself.

    It is perfectly legal. If she convinced the border control that she had no intentions of marrying and adjusting, then you guys having a K1 in process shouldn't stop you from canceling it and adjusting from a tourist visa. It may look suspicious to a interviewer, but it isn't illegal.
