Way to go!  Our package was also 5 pounds, and we included tons of evidence.

The affidavits are not necessary.  We did not send any.  They are listed in the instructions as a type of evidence you can include, but that does not mean they are absolutely required.

Congratulations on meeting someone else, but you have not moved on.
Your thinking is flawed. I mean theoretically it sounds good, and from what you pay your high-priced high-profile lawyer, it will be made to sound just as good. But the reality of it is, you will pay tons of money for nothing. You will never ever know what happens to her, whether your thinking of what will happen to her will actually happen or not. You are basically paying for the thought in your head that she will be screwed out of ever having a decent man in her life, and of course you will never know what happens.
If a relationship doesn't work out, it's best to move on. Your relationship didn't work, so just move on.
A few years ago I spent a lot of money on 4 separate trips to Colombia. The first 2 were to meet and spend time with my ex, the 3rd was to go with her to her K-1 visa interview, and the 4th was to go pick her up and bring her to the US. I was crazy in love with her. We got to the US no problem, married a month later and filed AOS. 3 months after that, she walked out on me. I may never know the answer to why, but my belief is that she only dated me and agreed to marry just so she could come to the US and get her green card. Her sister had even coached her on how to do it! It seemed her plan was flawless.
One day we had a huge argument, she called the police claiming I abused her, went to a women's shelter, and probably tried filing for VAWA. But there was no evidence of abuse...because it never happened. It took me a month to withdraw the I-864 for her AOS application, because I hoped and prayed she would come back. She didn't. Filed for divorce from her, which should have been a quick simple thing. It wasn't. She wanted spousal support! As in! I settled with her out of court just to get her out of my life and move on.
Don't you think I really wanted to sue this girl too?? I wanted to sue her for every cent I ever spent on her, I wanted to have her charged with immigration fraud, I wanted to screw her life over so much...that's how angry and vengeful I was about my ex. But I moved on, and slowly over time I have gotten over what happened to me. You can too.
    Just let it go.

Nothing is returned to you. The entire 129f packet will be sent to the NVC after approval, and the NVC will forward it to the consulate.
You will need a new, updated I-134 for the interview stage.

This is false. What trouble? Know of any cases where someone had filed for a K-1 and then ended up changing their minds, getting married, filing for AOS and then running into 'trouble'?
He entered without intent to stay, and was not questioned by the CBP officer upon entry about his intent. AND, none of that even matters because intent alone is not a reason to deny AOS.
OP> Harpa is dead on. It is legal. No need to separate now.

You can AOS now. It is perfectly legal. People will try to convince you otherwise because they don't like or don't understand the laws. No need to rip a family apart with a baby because it makes you feel better.
Intent, even if it had been established, is irrelevant/forgiven for spouses of USCs as long as they did not lie to obtain entry. Marry now, abandon the K-1, file a concurrent I-130/I-485 AOS (slightly different from the K-1 AOS), if you want. You'd lose the I-129F fee is all.

Zedayn got a reaction from lmihler in NOA1 - NOA2 current wait-time is 3 MONTHS?!
The average processing times for I-129F petitions at the CSC is actually FIVE months. https://egov.uscis.gov/cris/processingTimesDisplay.do
Your attorney was being optimistic when he said not to expect anything before the end of July. In reality, if your case follows what is average, you may be waiting until September. This is normal and within normal processing time frames.
Expect it to take at least 5 months from your NOA1 date. Be surprised if you are approved much earlier than that.

You had a previous I-129F petition approved within 2 years of this new submission. You should have included a waiver statement.
    From the I-129F instructions > http://www.uscis.gov...i-129finstr.pdf
    2. What Filing Limitations Does IMBRA Place on K-1 Nonimmigrant Petitioners?
You must apply for a filing limitations waiver if any of the following apply:
    a. You have previously filed K-1 petitions for two or more beneficiaries; or
    b. You previously had a K-1 petition approved and less than 2 years have passed since the filing date of such previously
    approved petition.
To request a waiver, submit a written request with this petition accompanied by documentation supporting your claim
    to the waiver.

Zedayn got a reaction from mjoyceb in Vaccination?
Vaccinations are not required for a K-1 visa. They are required for the adjustment of status once in the US. If she needs any vaccinations, they will give them to her at the medical. For Philippines, the vaccinations are already included in the cost of the medical exam, so you won't pay extra.
The vaccination requirements for AOS only require at least one shot in a series.
For most adults, the required vaccinations for AOS are typically MMR, Tdap, and Varicella. The flu shot is also required if it is during flu season. Here is a link to vaccination requirements by age according to the CDC: http://www.cdc.gov/immigrantrefugeehealth/exams/ti/civil/vaccination-civil-technical-instructions.html#tbl1

No, you should not work illegally. Do you really need to ask? You just got to the US and want to start breaking the laws already? No one on this forum is going to advise you to go against the US laws. Wait for the EAD like everyone else. If you wanted to start working right away, then you should not have gone through the K-1 visa process. You should have married first and then entered with a spousal visa instead. This is how it works with a K-1 non-immigrant visa entry.

I think it's a waste of your time to send in information that is not even required. Simply wait for your NOA1, and then wait a bit longer for the NOA2 approval notice. You will not receive an RFE for something that is not required, and your petition will not be denied because you didn't include it.

You can write a random date and length, or you can print out the form and handwrite UNKNOWN in the space.
The I-485 is asking about your current status in the US, and when that status will expire. You need to write the expiry date on the I-94.
In order to change your name at the SS office, you will likely need to update your name with immigration first. The best way to do this, is apply for the AOS/EAD/AP in your married name. Your marriage certificate is a legal name change document which allows you to legally change your name, even if only the maiden names are shown on the marriage certificate.
When you file your AOS/EAD/AP in your married name, you will receive your EAD/AP and green card in your married name. You can bring the EAD/AP card OR green card to the SS office and change the name on your SSN to your married name.

I think you are in for a ride if you think you have the upper hand. Prenup is meaningless in regards to the I-864. Not trying to sound like a downer, but why are you making this like a game (especially with the daughter's petition). What's your end game if you already know it's not going to work out between your wife? Divorce and move on with your life.

Zedayn reacted to Caryh in What makes a pre-nuptial agreement enforceable
A prenuptial agreement in a second language where a lawyer was not consulted is generally easy to get around. But that takes paying a lawyer and at 4 years of marriage, the odds of her getting much in a divorce isn't that good.
Lets look at some of the things she's unhappy with with alternative possible view points
he hasn't allowed her to return to Colombia to visit her mother. - They don't have the money for a trip at this time.
He pays her some small amount to clean their house, which seems a bit strange to me. - she cleans the house while he works. This money is her person spending money.
She is taking the initiative to improve her situation by attending nursing school. - He is paying her education expenses, so they can have a better financial situation in the future.
When you look at this from another perspective, it doesn't sound that bad to me. Just shows how your phrase things can have a huge effect on the perception of a situation, in this case from quite a negative view, to a very typical that's how life works view. It would not be surprising to me with all the costs involved in immigration and sending someone to school while they're not working, money is going to be tight. That's real life in America, and not the Hollywood inspired view that we all have money falling out of our pockets all day because we have more money than we can keep track of. Possibly she needs to take a more active part in seeing how much money comes in and how much goes out. It could be a lack of understanding has lead her to think things that are not really as she perceives them. Could be the guy is being jerk and is over controlling too. But just because someone can't have everything they want, doesn't mean someone else is over controlling.
