I mailed my i129f on Monday of this week and just realized that I forgot my print out for an ongoing relationship. Is there any way to get this information to them? Everything else in the packet is there including pictures plane tickets and proof of seeing each other in the last two years. Please help David

Don't worry, the proof of a bonafide relationship is only required at the time of the interview with the consular office.

As far as USCIS goes, they only care that you prove you have met in person within the last 2 years.

Just be sure to have that relationship proof with the beneficiary when s/he has his/her interview and you will be fine!

It's unlikely USCIS will issue an RFE for this, but in case they do, you'll have that opportunity to present your evidence. Otherwise, no way of getting that to them.

Not needed for the petition, only for the interview.

Phil (Lockport, near Chicago) and Alla (Lobnya, near Moscow)

As of Dec 7, 2009, now Zero miles apart (literally)!

Give it for the fiancee for the interview, none of that is reviewed at uscis or nvc anyway......Putting in there doesn't really do anything, especially for the Phils.

The relationship evidence is not required for the I-129F petition. As long as you have included the required information you should be ok.

Send the relationship evidence directly to your fiancée so she can take it with her to the visa interview.

Here is a recount to the information I got by using the ask-a-lawyer function of the site, what do you guys think?

Q: I mailed my i129f in on Monday of this week 4 / 4 and I forgot to put my proof of ongoing relationship into the package. Is there anything I can do?

08 April 2016 09:39

A: Immigration Lawyer

Hello! My name is Gu****** Sen****** and I am a licensed attorney with more than 13 years of experience. I am here to assist you with your questions. Please understand that if I ask you for additional information, you are NOT charged again and our communications are NOT timed. So please see this as a relaxed conversation between friends. I am here to help.

Have you gotten the receipt back?

Q: 08 April 2016 09:40 No I have not gotten anything back, I sent it certified and signature

A: Ok. You have two choices other than refiling, of course:

1) Wait for the receipt to come back and then put a package together with the supporting evidence and send a copy of the receipt with the package to the same address and ask that the supporting evidence be added to the I-129F.

2) Wait for USCIS to send a Request For Evidence (RFE) asking for evidence that supports that the relationship is real, etc.

Option #1 would probably be the better option to keep the case from being delayed for too long.

Q: 08 April 2016 09:49 How long does the receipt usually take to arrive? Do I need to send an entire copy of the original package or just the receipt a letter explaining and the proof of ongoing?

A: 2 to 6 weeks for the receipt and I would just send a copy of the receipt, the supporting evidence and a cover letter explaining what happened and asking to merge the I-129F and the supporting evidence.

Q: Thank you for all your help, one last question before I let you go. How long do I have once I get the receipt back to make sure that they can merge the two documents? I'm just trying to think of any faster way to do it. Should I wait till they cash the check and then send a copy of the check with it? I'm worried that they will send it off to a processing center before I get them the documents. I want to make sure that I don't have to wait for an RFE because I've been told that can delay things up to 2 months

A: Unfortunately, there is no way to know how long you have to send in the evidence before the RFE is issued. I would estimate 2 months or so, but there is no way to guarantee it. Just sent the evidence in as soon as you get the receipt from USCIS.

Q: Can I use the deposited check rather than wait for the receipt?

A: Use the receipt. Be patient.

I have to say don't complicate things by sending more documents when you are not asked as of yet, that is if they do!!

I don't think the ongoing relationship is needed with the petition...Most people including myself just included in the petition, but is it needed, not according to USCIS guidelines on their website.

Yes, the CO at the embassy might and might not ask for it either, but your fiance should have all the supporting documents for the ongoing relationship between both of you. So keep and make copies of any communications you make, any mail receipts, gift receipts etc...

You should be fine.

I think it's a waste of your time to send in information that is not even required. Simply wait for your NOA1, and then wait a bit longer for the NOA2 approval notice. You will not receive an RFE for something that is not required, and your petition will not be denied because you didn't include it.

I agree with everybody else. You should wait and see what happens. My partner and I panicked about this too because we only sent two documents as proof of having met (tenancy agreements) but it turned out to be more than enough.

Great information, though, for others that might forget something actually required. Thanks for sharing the advice from the attorney.

Went through K-1 (I-129F) AOS (I-485) EAD (I-765) AP (I-131) processes. Thanks to the Visa Journey community for their help and support!

Love is a great treasure, it would be amazing to me if it helped one person. It is hard when you realize your other half is on the other side of the planet, so finding a community in the same boat is a blessing. As love struck as we are we had our first sleepless night last night but are feeling better now.

I am trying not to scoff too much at the VJ 'chat up a lawyer' thing, but it is hard not to.

There would not be an RFE for proof of ongoing relationship. That is not a requirement of the I-129F petition. You must provide proof of meeting within the previous 2 years, which you did. The USCIS does not vet your relationship with the I-129F petition. The Dept of State does that via the K-1 visa interview. The CO will decide if your relationship is real and not just for immigration purposes.

So yes, definitely wait. If everything that was required was sent, then you will discover that you will not need to send anything else. Take relationship evidence to the K-1 visa interview.
