    Elle was simply adding that they do have first-hand knowledge of this specific situation which is what YOU requested in your initial post. They offered you advice and support in their previous post but obviously wanted to support you fully by making sure your very specific requests were being met.
    There is a LOT of support to be had on these forums. There is a LOT of first-hand knowledge floating around and being shared with those who are open to it.
    We also know that time and time again, lawyers have told clients that they know what they're doing but actually do not. They accept fees for immigration applications and often hold up the process for individuals who are working so hard to bring their loved ones to be with them. I believe Darnell suggested that you check with your lawyer again to be sure about the I-864 and I-864a situation. It would be unfortunate to cause a delay at the NVC stage due to the correct form being missing. We do not know your entire situation obviously but it's definitely worth a second-look.
    This is a very trying process. Be patient. Use the resources here if you can. But I'd also ask for you to be more receptive to those who are trying to give you an assist. Instead of criticizing their feedback or suggestions just accept it and move on. If you feel it is something useful, great. If you feel it is not going to help you, just carry on and wait for the next response that you can use. Everyone is trying to help.

    There are many individuals on this site whom are noble and respectable. Many with personal experience, and even law degrees offering free and accurate advice. Some are even immigration attorneys, and some work for the uscis. All walks of life exist here on vj. And I'm sure that you've already offended some of them. I'm not criticizing you. You do what you want. But I don't think you'll get the answers that you're looking for with your attitude.

    I should add that I do have first hand knowledge of this issue. You file an I-864 with nil income. Your mom files another I-864 with her income, indicating she is a joint sponsor.

    To lloydboybebop: people on this forum are trying to help you. Please do listen to NikiR and Ryan H. Do not use the I-864a, which is meant for a co-sponsoring household member combining their income with the primary sponsor. In your case, you want your mom to be a joint sponsor, not a co-sponsor. As joint sponsor, your mom will file an I-864 and tick the joint sponsor box in the form. The USCIS guidance on the I-864a is not clear on this issue but trust me, if you want your AOS package to be successful, get your mom to file the I-864 as joint sponsor. It also doesn't do you any favors to carry that attitude on this forum.

    For starters, you will not be applying for a CR-1 visa, your wife will do that. What you are preparing to do is file a petition that will allow her to apply for the visa.
    Answers
    1. Your mother has agreed to be a joint sponsor and she will need to complete an I-864, not an I-864A (you will also complete an I-864). Others are better suited to answer the other part of this question.
    2. An overstay of two days does not an incur a ban, so that in of itself is a non-issue. However, she should be prepared to answer any question surrounding it (i.e. explain the circumstances). Others are better suited to answer the other portions of this question.

    Actually you should be paying attention to what RyanH is saying.
    You do not apply for a visa. While you can help your wife with the preparation etc, what you do is petition for the right for your wife to apply for a visa. But what you said was:
    Regarding the I-864:
    Just because you live with your mother does not mean she fills out an I-864a. As you have no income you will not be combining income with your mother. Thus she is a joint sponsor and needs to fill out an I-864. The I-864a is for household members who are combining income. At VJ we understand that the USCIS website isn't very clear on this point.

    Consider emigrating to Mexico for a while.
    Current unemployment rate in Mexico is 4.51% which is much better than America. Have you considered emigrating to Mexico till the 5 year ban runs out. Yes, pay is low, but rising (~10,000 peso last year (~$8200) but living costs are low. At the end of the 5 year period move back.
    "Five years ago, 21 percent of Mexicans said they would be willing to move permanently to another country. Now the rate has dropped to 11 percent, the same percentage of Americans who said they would leave their country behind forever."
    So says a new Gallup poll released Monday, which indicates that things are getting better south of the border. There’s more work in Mexico now, and more reasons to stay put.

    Or in the meantime go to college. In 2002 I had a few single mom classmates going to college on grants who had assistance for daycare. All graduated as RN's and now make more than $50,000 a year. They essentially had a free ride to a great job.
    As for your child's asthma, Portland is not the worst place in America, but it's pretty bad. Talk about humid! And Portland has more than 6 distinct seasonal allergy seasons (pollen), maybe you might rethink that. Portland in not the worst city for childhood asthma but it's in the list (#96) of the 100 worst cities in America.

    uncle or aunts, maybe get a job taking care of the elderly that allows you to live in with your
    child and save, don't you have siblings? It cost a lot to petition a person , even if U got co-sponsor
    how will the other fees be paid?....sorry about your child hope U move around & make something
    happen.

    If you were a minor that is good, but they still may ask to see it as you are declaring a past criminal history.
    Just click here http://www.acro.police.uk/subject_access.aspx and scroll to the bottom for the relevant force- making sure you are filling in the form for subject access from the PNC, not from local systems (my local force had two different forms.)
    If it is on the PNC it will show up on the report - even down to the serial number of your DNA sample if you had one taken.
    For the sake of £10 & a stamp it could save you an awful lot of hassle and a denial pending more documentation

    We paid ours 2 days before our POE and you can see by my signature that the green cards arrived quite quickly thereafter. After you pay it online you will be sent an I-797 form (just the same as our NOA forms) and there will be a new receipt number on there that you can track on the USCIS site. The tracking on the site will include updates along the way showing that the payment is complete, when the request for the card to be created occurrs, when the card ships to you including a tracking number for USPS. Then you'll be able to track the card's progress in the mail using that number.

    I would think that the marriage that your petitionm was based on has been terinated , killing the petition, A new marrage needs a new petition. Just like a person that finds their marriage was invali have to start after they fix tha issue.
