In Spanish culture you dont call nobody "fiance" the said my husband or wife... Marry or Not. Thats culture.... you said that I'm "SILLY" like I said something about me calling my Fiance husband? , I said that was Stupid for the USCIS to go in base of that... so Calm Down.

Hey All,
So this is probably more of a rant than anything else, but I'm seriously disheartened by my situation! I started my K1 journey Jan 2012...approved Jan 13, married April 5th YAAAYYYYY. I moved to the US in March 13 after a long and stressful wait (as well all know!!). I'm currently waiting for my AOS, AP and EAD to be approved.
Now I have read on another members thread that said person came to the US on a holiday visa and 'decided to marry' there and then, and is merrily AOS-ing now...without any prior planning, paperwork etc...I mean no disrespect to this couple, but I'm dismayed at the struggle me and my husband have gone through and still are, to find out that this is allowed?
I may sound selfish or childish here, but there isn't any equality here is there?
Sorry if this comes across as bitchy or negative, just finding it hard not being allowed to work yet or visit my family

I doubt you will have any problem with the USCIS portion of your petition. Their real requirement is that you be legally able to marry at the time the petition is filed, and have you met in the last two years.
I would advise you to prep your future bride however about potential questions during the interview. Things like:
Did you know he was still married when your relationship began?
When was his divorce finalized?
If children, how many and what happened to them, (custody).
The interview is where the decision will be made to grant or deny the visa.

You have muttiple denials, answers that don't match, a husband who you "didn't really live together with, and notice two years ago that deportation was started.

Then, tell he to get on a plane to the US as soon as possible and let the immigration court deal with it.
With an unexpired green card, there is no way for the airline to determine if she has abandoned it or not. The airline will let her fly on the unexpired green card.
If CBP gives her no trouble, then she enters without any problems.
If CBP thinks she has abandoned her status, then she would be paroled into the US and she would be referred to an immigration judge to determine if she had in fact band ones her status. Only the judge can end her LPR status. With a US husband and minor children , it's unlikely that she would lose her status IMHO.

I would not go to the US Embassy to ask. The US Embassy could determine she abandoned her status and put a note in her file. She would have no meaningful way to fight for her LPR status in Bangladesh.
If she shows up at a POE, she will get her day in court if necessary.
I would buy a ticket, show up at the POE, and take my chances in the US.

Your friend's best chance of living in the US with her children is to try to return with the current green card. The card is still good until an immigration judge decides otherwise. There is no such thing as automatic loss of LPR status.
If she has problems entering after being out more than a year, CBP will still let her in and refer her to an Immigration judge. There she can fight to keep her LPR status.
If she is allowed in with no problem, then her problem goes away. She goes back to living with her children.

Do not be alone with her even for 30 seconds you could find yourself facing a domestic violence charge, ISTRONGLY URGE you to never speak with this woman again. DO NOT HAVE ANY CONTACT WITH THIS WOMAN ACCEPT IN A PUBLIC PLACE OR WITH A WITNESS PRESENT.

That is 100% incorrect. A GC is not automatically awarded when marriage is performed. As I said, you must have a viable marriage at both the time of submission and the time of approval.

That, good sir, is called immigration fraud. You won't get any help on this forum to help you worm your way out of immigration fraud. Deliberate immigration fraud at its worst.
Others are right, it's because of people like you that genuine couples like us have to jump through hoops. It is very possible you will be caught out and may (and should) spend time in prison.

On another ANGRIER note. Its because of people like you doing like this that honest, real couples who are in love (aka me and my husband) have had to live in near poverty because the government makes such tight guidelines.

Lots of un-insured USC in every state, but I don't think the US should foot the
medical bills of undocumented ppl however gunshots, stroke, heart attacks,&
wrecks administer critical care, contact the embassy of that person with a bill &
info on when & how they will land in their own countries after emergency treatment.
Boatload of Haitians landed in Jamaica last month, 36 were caught , all want to file
for asylum, they were given medical care, baskets of food for each & a few clothe items
and taken back to Haiti in 12 days. Things have become very hard worldwide but we
have to treat each other as humans

As far as I know, very poor people do it - regardless of their citizenship or immigration status. What I'm saying includes them all. Personally, I am for providing healthcare to everyone - for both ethical AND sanitary reasons.

Uh - really not sure illegal aliens only hang out with other illegal aliens. It's about a costs/benefits rationale, not necessarily about pity. In the case of infectious diseases, timing is crucial for effective containment. Early diagnosis can save all kinds of problems to the whole community. Following your example, it would also save the CDC or whoever involved in the containment a lot of money (= taxpayers' money!).
Seriously, there have to be smarter ways to counteract illegal immigration rather than turning hospitals in detention and deportation centers. I think it's in everyone's best interest.

if he was legal paid SS & tax then fell on hard times and discarded like garbage by a hospital, if
he was unconscious how could they have talked to him...wow

Things change when said child holds an immigrant visa
and when said child holds a green card.
The 'travel visa' basis is not anything like the 'immigrant visa' basis or even 'green card' basis
so
it sounds to me, like there should be a re-evaluation by the mother and father, to come to agreement for a new 'term' of living and/or visitation based on the new basis that will be popping up later.

If the child goes to school in the home country and dad register him at his address, then the child could be deemed to have abandoned his US residency because a custodial parent claimed home country residency for him to go to school.
This plan doesn't doesn't seem workable. What kind of education will this child have if every 6 months, he has to change school? Furthermore, school in the US is only 9 months. So 4.5 months here and 4.5 months there?

Yikes. But back to your original question about the email is that normal. Ummm I wouldn't think so. But what I have read of most lawyers is they don't like or do they deal with NVC.
Wat information did you need. And may i say I am sorry but at least you have us now so you can be on top of your lawyers okay.
In the end it will be money you will forget aout because you will have your family here.

K1 is a non-immigrant visa. She doesn't start being an immigrant until she's done AOS.

Hang on. Some cases took a little longer from the service center to NVC. Ours took 1 month and 7 days. We were approved last April 22 and got our case number by May 29. Just keep sending them emails and calling them. God bless.
