Immigrant Visa Case Number:  ACC2016xxxxxxxxxx ACC
    Case Created: 28-Jan-2016
    Case Last Updated: 03-Dec-2017

Section 203(g) of the Immigration and Nationality Act requires that your registration be canceled and any petition approved on your behalf canceled, if you do not apply for your immigrant visa within one year of being advised to do so.

You were advised of this requirement over 1 year ago, but we have not received a response from you since then. As a result, your application for a visa has been canceled and any petition approved on your behalf has also been canceled.

Your application may be reinstated and any petition revalidated if, within one year, you can establish that your failure to pursue your immigrant visa application was due to circumstances beyond your control. Please provide a written statement to the Embassy or Consulate outlining the circumstances beyond your control and noting that you still wish to pursue this visa petition.

On 11-29-2017 my husband went in for our long awaited reaffirmed petition interview. We arrived at about 7:45 for an 8:30 appointment. They finally allowed him entry at 8:00. He waited about two hours before submitting his documents and taking bios.

While submitting documents the person taking the docs asked how long ee have been married, commented on a picture we submitted of us with a cheetah in South Africa on one of our vacarions. My husband said he was filling a form similar to a matrix of the documents and information.

He then sat down and waited approximately 30 minutes before called to window 9. His officer was a white young gentleman, and my husband said he was kind, respectful and my husband felt very at ease. Here is the conversation:
The CO called him to window 9 and said Mr...your visa has been approved.

    NO QUESTIONS!!! ASK
Gave him a white slip with highlighted instructions  to register online and to pick up his visa. we notice its different from the normal blue slip guess they change that.
Mr...i will give you your passport so you may re enter the embassy at 1:00 to pick up the documents from your case , please be sure to return today at 1:00pm
We returned at 1:00pm had a bit of a delay , picked up the documents from our original interview, noir and what we brought with us. He left his passport to be given to the officer for processing.
My husband was asked no questions at his interview. Was only given instructions to pick up docs, he is approved and instructions to pick up his visa.
As frustrating as this process has been and the long journey , it was worth it. Now for the life journey we fought so hard for to begin.
Peayers for those still in the process, God willing your day will be upon you to reunite with your loved ones.

On 11-30-17, our status changed to issued.

now we would like to know what the next step will be ? will it change to ready or delivered  to dhl ?

and what is the best route to travel to the us without a transit visa .?

and whats the best Point of entry?

congratulations!!...I can see this is a new profile..can you give me your old username so I can add to the reaffirm spreadsheet? Congrats once again!

The I-864 Affidavit of Support is a contract between a sponsor and the applicant that is required for some immigrant visas. In this contract the sponsor agrees to provide financial support for the applicant until he/she becomes an American citizen or can be credited with 40 quarters of work (usually ten years).

I think she has found her answer but didnt like that answer.

Wow, so much judgement and hate in your response. I am a taxpayer, and I see it pains you that you will have to pay for people in need.

we all are taxpayers, honey. you said you have means to get insurance but what to use the medicaid as a secondary option. That says to me that, I will keep my money and mooch off the govt even though I can afford my own..

    Unfortunately no.

    The USCIS Policy manual states:

"An applicant may overcome the presumption of loss of his or her continuity of residence by providing evidence to establish that the applicant did not disrupt his or her residence. The evidence may include, but is not limited to, documentation that during the absence: [12]

The applicant did not terminate his or her employment in the United States or obtain employment while abroad.

•The applicant’s immediate family remained in the United States.

•The applicant retained full access to his or her United States abode."

So dont you think the proof is as follows:

The applicant did not terminate his or her employment in the United States or obtain employment while abroad.

    1) no employment abroad (left my job as soon as i got residency)

    4) job applications in US (i was applying online even when i was abroad)- So you terminated your job in the U.S.?

The applicant retained full access to his or her United States abode.

    3) letter from relative that i was residing at their house and had full access in my absence- i think this may be weak. Anyone can get their relative to say say for them. if you were still paying rent or still on the rental contract then that would have been helpful.

    2) active bank account (not many transactions)- Did you pay bills through your bank account while you were gone or it was dormant?

yes thats what its looking like i feel like just subbmitting the waiver with them since they are not charging me to submit the waitver only the waiver fee. I feel like they owe me that since we have already paid them $6k.

You might be able to sue them for your money or some of it..But if i were you, i wouldn't trust them with waiver.

They might not have done waivers before.

That's a tough one...approval rates for PH are pretty poor, tbh. Sorry. :( No job, US-based daughter (although not being a USC yet is a benefit), and presumably not much in terms of financial assets (since your sisters provide for them) all put them at pretty high risk, IMHO, of overstaying.

Do they have property? They can bring evidence of that. Beyond that, I'm not really sure what they would even consider (if they even ask to see documentation).

I don't mean to get your hopes up or exaggerate their chances...really the only way to know is to apply and find out.

When did that it become poor?? manila is a visa-mill and US immigration is very kind to Filipinos. Or it changed

Yes that was my point. After my husband's first interview we had 2.5 years of waiting. That is the time we used to make sure to create more evidence. The thing most people don't really know when going to their first interview is exactly what they are looking for. But you have a pretty good idea later. So i'm saying, keep up with your conversations, make note of any changes you make to name, documents, things like that need to be kept so you can have a history of your relationship to take to the next interview. And don't wait for last minute to put it all together. It's unlikely social media apps like whatsapp and Messenger, etc will allow for you to print out 2.5 years of conversations. But you can if you do it every 6 months, so you have info from the interview all the way up to the next one. Even stuff you have close to the interview. Add it as well. Trips you took, emails you have, whatever it is from beginning up to the day of interview if you have it.

That's so right especially about whatsapp... my last phone lasted a year and wont turn on  ( a problem with LG V10) phones..so i lost some of our messages there.

In the meantime you may want to figure out what proof you DO have for that timeframe they denied you for. You can always send it to them before they send you the NOIR. It will become a part of your case file and at least they will have it by the time they finally decide to look at it and you can try to avoid the extended time of the NOIR. It can be phone calls, text messages, etc. If you spoke on social media, things like facebook messenger, Whatsapp, Skype etc. They usually have in their settings a way for you to download your conversation history and email it to yourself. You could try that. Or if you spoke by phone, go online and check your old bills, or ask the carrier to send them to you and highlight those phone calls and the time spent on the phone. We had this same issue, we originally had our appointment in June 2015 but we were missing the proof from the very beginning of the relationship because we no longer had those accounts that we met on. But they told us we needed more and set up a new interview for July, well i found everything i could, my husband went there armed with 800 pages of conversations (this is when i first found i could download the conversations) and guess what. They didn't even look at them. He walked up to the window and they gave him the 221G with no explanation, just told him to contact the USCIS after 60 days. When he told me this i really wanted to punch someone in the throat, like we paid for all of that paper, AND the cost to ship it only for them not to look at it. Was crazy. But yeah good luck to you. I think you can relax a little right now since you probably have some time to go. Just use this time to create more proof of your relationship. I've yet to see anyone's reaffirmed case, on either this forum or any others i belong to, be denied so that's hope i guess :)

See the thing is that evidence after the interview or very close to the interview hold little weight cos they believe, it is a set up. So i think people should just live their lives like they normally do (through social media or whatever communication system) and have it ready but focus on the past paperwork.

  11. It is not hopeless.. Wait for the notice.. it will tell you exactly why they made that decision. It could be something as simple as you having an active petition in the system or something as complicated as your husband not been eligible to be granted visa to enter the US (like been banned or his name appearing on a watchlist).

i find it interesting that you didn't get a NOIR. it could be that it came but you probably never received it or maybe the other reasons stated above.

Stay calm....Organize your evidence and wait for the letter. You should receive it within 3 to 7 days.

keep us posted on your case. Wait till you get the notice before speaking to a lawyer since doing so before it will not be as useful.

    Good luck!
