    I had my kids very young. I've been on my own since 17 and had them both by then. Now I'm blessed with the amazing success of both of my kids in school....they have really beat the odds and not allowed our struggles to turn them into statistics. Other than this problem right now, we are truly blessed. I guessed we are even more blessed that he's gone.

    A lot of people make the mistake. I have too. I was taken for a ride once worse but when the light was shed upon them, I moved out and got distance from them and cut them off. The problem with the OP is she still cares for him. That is dysfunctional and dangerous.

    First let's get the 4th Amendment correct, it's "Life, liberty and the pursuit of happiness". Life & Liberty are protected as is your pursuit of but not successful obtaining "happiness", this difference means simply that you have the right to try to be happy. Immigration is a privilege not a right. In the pursuit of happiness you can marry whom ever you please regardless of where they live and you can even attempt to immigrate them to the US or you can choose to live in their country.
    As for enjoying the same benefits as an illegal alien, that's a crock... Any program that takes money from me and my fellow Americans should require Legal presence in the US before any benefit is given.

    There are far too many variables at play here, and I think anyone who takes a black-and-white view fails to see the whole picture. I, for one, am grateful that the USCIS understands the great variation among its petitioners and tries to accommodate these differences.
    I have lived abroad for five years, and would now like to return home to the USA to enter into a PhD program. As a PhD student, I will barely meet the poverty guidelines. I met my husband abroad, and while there are arguments floating around here stating "You could have found your love in the USA," this was not the path my life took. Should I have stopped myself from falling in love with him, because I somehow should have known that I would struggle to meet the poverty guidelines if and when we wanted to move the USA?
    My husband's earning potential is high (fingers crossed he will find a job quickly), but is it possible for the two of us to survive on 125% of the poverty line? Absolutely. I have lived on less. However, if the USCIS did not allow me the option to have a co-sponsor, I would probably not be approved and my husband and I would look elsewhere to move.
    I think it's fair to say that no two cases are the same. Are there people getting married who can't even support themselves? Sure, but I don't think povery requirements will stop that.
    Anyway, I'm just grateful that the USCIS sees each case as individual, and does not apply a one-size-fits-all policy. I would likely fall through the cracks that way.

    At least 50,000 greencard lottery winners come to the US every year without showing proof of how they will be supported financially. The only thing you are required to have after winning the green card lottery is not how you are going to survive, but what address you are going to. It makes no sense that 50,000 people are allowed every year to come to the US without showing how they will survive but husbands and wives who try to join them later have to prove how they will survive on their spouses incomes.
    My now friend won the greencard lottery in 2005. She did not know anyone in the US, but friends of friends found someone who she could use their address when she arrived at POE. Now she is trying to bring her husband she married in 2008 and her minimum wage is not good enough to bring her husband. Yet zero dollars was good for the US when she came in 2005.

    I disagree with you on the doing away with the k1. I make 200% abouve the poverty level and can provide for my fiance until he is able to gain employment. All cases are not the same.

    Anyone trying to support themselves or another on 125% of the poverty level is kidding themselves. The line has nothing to do with "having enough" to live on, it has ONLY to do with having enough income for the government to confiscate if your fiancee becomes a public charge.
    That said, provided it costs ME nothing, I could not possibly care less if someone else is prepared for their wife or husband. Make your bed, lay down and STFU! Not my business. I make no judgement. I do not care. I have enough to do to keep my own @ss afloat.
    If you ask me they should do away with the Affidavits of Support altogether and simply make it impossible for a family based immigrant to collect ANY means tested benefits until they are citizens. Job done.

    I never really paid attention to how low some of the guidelines were, as I knew I was over the amount enough to be comfortable, but reading this - family of 3 - $23, 163 - that is absurd!!!! I also cannot see how in the world anyone can get by on that...it's a struggle waiting to happen.
    I don't know about doubling it but raising it, absolutely.
