Hello All

We are filling I-130 and I have a quick question. I am a Canadian Citizen and my wife is a USA citizen with Canadian Permanent Residency. We got married in 2017 and then I filled for her to come over as to live in Canada. She was allowed to stay with me on a visitor pass while her Canadian Permanent residency was in process. She received her permanent residency late 2017. Since we live close to the US border and she has a big family there (parents, siblings etc). She always goes there for extended visits like a month or two each time. Now we decided to move and live in the USA. How do we go about filling that part about Last address at which you lived together and the time period of it. Do her extended visits to her family need to be excluded etc. I do not know If i am reading too much into it. Your feedback is appreciated

How to apply again for SSN after getting EAD

My husband arrived in the US on June 4th arriving on a K1 visa and we got married and filed for I-485, I-765, and I-131 the next week. He then applied for his SSN at his local SSA office on June 24th. Now the big mistake we did was not checking yes when the I-765 asked if he wanted to get issued a SSN with his EAD. The reason we did this was because we had thought he would ve gotten his SSN by now. Unfortunately, it s been 8 weeks now and his I-94 expires in 2 weeks so we doubt he ll be getting his SSN by then. We ve tried calling our local office multiple times who just say that they re waiting on DHS to authorize and verify his I-94 and there s nothing they can do.

We re now thinking about the worst case scenario, which is if he doesn t receive his SSN by his I-94 expiration date, what do we do? Would he just have to go back to our local office and reapply for a SSN, this time with his EAD? Does the local office still have to check with DHS to authorize since he now doesn t need his I-94 to get his SSN if he ll have his EAD? We don t want to have to end up waiting another 8 weeks for SSA to issue him a SSN after his EAD as it s already taking so long for a work permit.

AR-11 Updated a month ago online, no mail yet

Hi folks,

I had a question that I cannot seem to resolve myself. I tried searching on the forum already but all the responses are many years old.

I submitted an AR-11 almost a month ago online. I included the I-751 receipt number on it. I received an email confirmation with a date of August 3rd (when I'd expect to hear from USCIS by mail I'm guessing).

It's been a month and I haven't heard anything from them.

Here are the steps I took to try to dig into it:

1. I tried calling the USCIS number, but it was a maze. I kept asking to verify my CoA, but the automated prompt only kept sending me the link to submit the form online. There was no way to get to a human.

2. I went on the website and used the chatbot to talk with. The chatbot said that if it has been 15+ days and I haven't gotten confirmation, I can re-submit the form.

3. I tried to resubmit the form online, but it told me that this form is still pending and to submit IF there is yet another new address. Obviously, I don't have another new address, it is the same that I submitted on the AR-11.

Unsure on how to proceed here.

1. Should I re-submit the form online again? OR

2. Should I mail in the form instead? However, I heard that mailing it in does not "pull" my I-751 application to this new region that I live in (Texas). Not sure how I can do that.

3. Should I call them for it? Once again, not too sure how to even get to a human on the phone. It keeps throwing me in a maze.

Thankfully, I still have family at my old address, so I won't have lost mail. But I'd like to move my I-751 from California (old address) to Texas where the processing time is significantly less and get this going.

I'd appreciate any pointers.

Thanks!

edit:

I should note that we mailed in my wife's form i-865 (she's my sponsor), and she received her confirmation in the mail a few days ago, so that piece is taken care of already.

Pending Removal of Conditions, ready to sign divorce papers soon

Hi there,

I was wondering if anyone has any recent experience doing this? We applied for Removal of Conditions jointly about a month or so back and I have gotten the 1 and half year green card extension. I know I now will have to change it to a divorce waiver filing. Do I need to pay any additional fees? Do I need to use a lawyer? Should I only file it when I have the final divorce decree?

Thanks,

Veronica

Tourist to TD Transition

Hi all, my fiance and I are in a bit of a situation and I wanted to reach out here for some advice. The situation is:

  • I've relocated to the US from Canada on a TN status
  • She is eligible to petition for TD status but only if we're married (which we are not yet)
  • I don't have the ability to take a vacation long enough to go back to Canada, get married and return with her (especially with all the uncertainty with Covid)

What we'd like to do is to have her come to the US (as a visitor) for 2 months so we can at least see each other. Then either:

  1. Get married during that time in the US, fly back to Canada once we have the certificate, and return to the US, getting the TD on the way back in
  2. Just visit for a few months, fly back to Canada, get married in there, and return, getting the TD on the way back in

Option 1 is preferred so that we don't need to rush to get things sorted while on vacation (and since the wedding certificate can apparently take several weeks to be issued). However, I have some concerns about the viability of this plan. Option 2 seems more straight forward, but I still have some concerns about how that will look to the immigrations officer.

The question is, how likely are either of these plans to work? Any warning or potential pitfalls? Any suggestions?
