My wife and I are filling out the I-864 and we're using our assets to meet the requirements. If we plan on selling our home (but it's not sold yet), do we include its net value under "real estate holdings" or under "savings and checking accounts"?

Hello, I am hoping someone can help me out. I am trying to figure out if I need to apply for an extension on my K1 Visa or if I need to seek a lawyer at this point. I received an approved I-129F petition on 10/29/2021. My fianc submitted his DS-160 on 11/11/2021 and then had his interview on 02/07/2022. After the interview, the Montreal Embassy temporarily refused the visa for "Administrative Processing" and requested a questionnaire be filled out. We promptly returned the questionnaire on the same date. Upon further research, it appears that this questionnaire was part of DS-5535, it's been 3 weeks and the Embassy is not replying to our emails. I have read online that these can take anywhere from 'several weeks' to over 8 months. The only information I've seen is on the CEAC site indicating a "Refused" as of 02/16/2022 and stating that "Please follow any instructions provided by the consular officer. If you were informed by the consular officer that your case was refused for administrative processing, your case will remain refused while undergoing such processing. You will receive another adjudication once such processing is complete" I am livid that the officer at the Embassy targeted my fianc , considering Canada is not a high risk country and given I have provided every form and document to them with more than sufficient information. I can't help but to feel this was due to some form of discrimination given my fianc 's ethnicity and orientation. Is it recommended I bring a lawyer in? I appreciate any insight anyone has on this and how to proceed. Thank you, Michael

I m curious if anyone has some insight on this hypothetical, but possibly realistic, scenario. I list my house to sell on April 10 I cross the border and activate my visa on April 15 and return to Canada April 16 to pack belongings. House sells April 20 and closes June 1. In this scenario, would I be considered a non-resident and be subject to the 25% withholding tax when selling the house (primary residence I ve lived in since it was purchased 7 years ago)?

Hi. Is there anyone else who filed an I751 in - or about - Feb/2021, who is stuck at the biometrics states point, and only received extension letters? I have 2 ... the first was for 18 months, and the 2nd was for 24 months. I would have thought that if there was any sort of problem, a RFE would have been issued. I start a new job on Monday, and hope and pray that a 2 year card that expired in May/2021, and a 24 month extension letter - matters. This is a dream job, 2nd only to my wife - who is also a dream come true.

My fiance and I have applied for the K1 Visa 2 years ago. We finally got the interview date (March 24), however, I'm a bit worried because he lost his job 1 year ago due to COVID and has just gotten a new job that is starting March 7th. It's a good salary (way above poverty line) but I'm worried that his statements from the bank will not show any deposits in the last year due to him being unemployed. He also went through his savings during this time. Will this cause a denial? Should we be looking for a co-sponsor? I am Canadian and am currently employed with an authorization to telework so I will continue to get paid throughout this process. My plan is to bring proof that I can support myself until the day I can work legally in the US but knowing that this isnt something they take into account, I'm worried that his proof of employement isn't enough since they are looking at his bank statements during the last year.
