Can my pregnant wife who entered on a B2 visa stay in the US while I-485 processing?

Hi all,

As the title reads, my wife is a Canadian citizen who spent 6 months in the US recently as a B2 visitor. Towards the end of her visit, we ended up getting married and she returned home to Canada. We soon found out we were expecting our first child together and she just returned on a B2 visa expiring in mid-may 2022, and we decided to file an I-130 and I-485. In normal circumstances, she'd probably return to Canada for a few months however since she's pregnant, it's really important for her to be in one place for consistent prenatal care. There's some conflicting advice online about "the authorization" to stay in the US while the 485 is pending. We've already filed the I-130 and are preparing the I-485 packet to send off this week.

Some sites state that she would be allowed to stay while the application is pending and while her B2 visitor visa would be marked as "overstayed", it would be retroactively rectified pending approval of our applications. Other sites state that what we're doing is immigration fraud as she's here on a B2 visitor visa which implies intent to return.

Additional info: She managed to come back, despite already spending ~7 months here in the past 12 months, due to a kind US customs agent, who let her in and gave her a one month entry to "figure things out" which we're hurrying to do.

Please help. Any advice is much appreciated!

Receiving I-797 NOA via mail in Canada

Hey Canadians!

I have a big favour to ask of those who applied for I-130 through Consular Processing with your Canadian address as your mailing/physical address.

When you got your I-797 notices via mail in Canada, did USCIS list your "State/Province" on the letter itself as "City, XX" (mine said Toronto, XX) instead of "City, Province" (Toronto, ON)?

I wrote Ask Emma, and they said they've seen it sometimes before, but wanted to know if any Canadians specifically had the same as me, where it said "Toronto, XX" on the printed/downloaded I-797 notices...

The USCIS website said "Ontario" under "Province" in my profile, but it's just the letters that are wrong.

Would be a massive help if any of you had the letters handy to check!

Late for Naturalization Interview

Hello, I was late for Naturalization today. I was traveling from Bellingham Wa, to Seattle WA, according to google map it should take me an hour an 45 mins. I got there late because of collision on highway, though the security guy told me to proceed, however, the interviewer told me I am free to go home. once home, I looked into my USCIS account, and there was already a letter with summary below:
You were scheduled to appear for an interview on your application for Naturalization on at 12:00PM. Our records
indicate you failed to appear for this interview. You have thirty (30) days from the date of this notice to explain why you did not appear. Failure to respond
to this notice will result in your application being administratively closed without further action.

So, I quickly prepared a letter letter:

re:Lateness for appointment letter

Dear USCIS Officer,

Attached below my reasons for being late for the appointment on. As noted below I left home in Bellingham on 10:00 AM. I was able to make COSTCO gas station at 16616 Twin Lakes Ave, Marysville, WA 98271 to get gas at 10:55 AM. Please see receipt attached. Image of receipt with time stamp here.

According to Google Map this should get me to your office at 11:45 AM. Please see below - Google direction attached here.


However, there was collision on Higway-5 which I ran into after purchasing gas. Please see below:

Also, I actually made it to your office, after going through security I went straight to the SECOND FLOOR as was BOLDLY written in the mail sent to me. I was on the SECOND FLOOR for a while together with others waiting for interview. However, I felt concerned that my name was not called, hence I asked someone beside me, and he said I had to check-in downstairs first and obtained a number.

I went downstairs again, and this time the officer asked took my fingerprints, and picture, and she noticed that I was late for my appointment. She suggested to wait in the interview room while she contacted the interviewing officer. She came back shortly, that the interviewing officer said, "I am free to go home because I was an hour late, and I should be expecting a letter in the mail."

ASK: is the response above reasonable, or should I look to get a lawyer to respond accordingly? Notice, I applied for citizenship on WAVA because of spousal abuse. Note also, that the pictures above might not be accurate, but I DEFIENETELY saw notice on the highway traffic board that "Collision on left lane southbound I-5 and interstate 259" at Everette that explained the gridlock. If anyone knows where to get accurate traffic report. I will be grateful. Also,

AOS coming up in Houston

Hubby ( applicant) and I (primary sponsor) are both 20. I've been working on and off and our interview is coming up (AOS in Houston) in a few weeks. Hubby has been finishing associates degree. We have some savings but I don't think we qualify on our own. My mother in law, who we live with, and pays most of the bills, had submitted the 864 as a co-sponsor a year ago when we applied. She earns well above the threshold.

Do we ( me and and mother in law) need to update our financial statements and each bring with us an updated 864? (bank records, pay checks, mother-in law paychecks) since our bank accounts have fluctuated and MOL earns more?

Also- what documents, other than financials, do we need to bring?
