PSA: If entering the USA 2 years after marriage, kindly remind the immigration officer of this

When we last entered the US, our immigration officer said "Oh, hmm I wonder if I could go ahead and change you an IR-1." The agent right next to him said "Yes, you can do that" and he acted surprised. His comments made it pretty clear he was going to erroneously issue us a CR-1 and he seemed to not even know he could change the visa status until his coworker advised him (THANK GOODNESS she overheard!). I don't know how onerous the process is to correct such an oversight but I'm glad we didn't have to find out!
Just wanted to pass this along in the hopes it saves someone from any problems with the wrong stamp being placed in the passport, as I've read about here before.... I would kindly remind the officer "We married >2 years ago. We can enter with an IR-1 visa now right?"- 20 replies

I entered the U.S. on a K-1 visa on June 1st and left for Canada on June 2nd, remaining here for 20 days. I am now attempting to return to the U.S. through Toronto Pearson Airport (YYZ) using Automatic Visa Revalidation (AVR). My K-1 visa is expired, but my I-94 is still valid. Am I ok?-

Wrong USCIS application form filed by my lawyer!

Hello, so my wife came in k-1 visa to USA and we got married and all. We filled for work permit and green card together but while doing that my lawyer filed for I-130 no idea why. Will that application make my process for work permit and green card slow? If so how do I withdrawal that application? My lawyer isn’t helpful at all. I need some help…-

Seeking advice for Thai/US couple - What US visa path to take?

My gf and I live in Thailand but spend 2-4months in the US per year. Once/if we have children age 5+, the time split would become vice versa. We have no plans to live full-time in the United States in the next 5 years, but I visit my family and friends 2-3x per year for 2-3 weeks at a time. I would love it if she can join me for those trips and experience that part of my life. What options do we have -- US visa wise, maybe a tourist or fiance visa later? Other?

Abandoned AOS and now regret it

Please be nice, I know I made a mistake... But got my K1 approved and arrived in the US June 25, 2024 and applied for AOS February 25, 2025 -- then left the US (abandoned my AOS). Will I be banned for re-entry to the US -- even under a spouse visa?-

I'm currently living and working in the United States. My fiancé currently lives in Japan. We have been dating for about 6 months, and we have met in person several times, but we are not yet married.
My fiancé will be visiting me in the United States on a tourist visa some time in March or April and staying for about 3 months. I want to file for a fiance/spouse visa asap -- what's next?-

6 RepliesWe are thinking of paper filing my spouse's N-400 89 days early based on the 3 year rule. Two weeks before that, we have a foreign trip planned that is a 2 months long. We don't want to wait for our return to file. We're eager to get her citizenship for several reasons including filing for parent. We know our exact departure and return dates so we can fill in those dates in Part 8 of the form. But, the return date would obviously be in the future (after the date of signing the paper N-400). We expect biometrics to be reused because they were just collected less than a year ago for I-751, which was already approved. Does anyone see any issues with this?

I lived with my child s father for almost 9 years, but we were never legally married. We have one son, who is now 8 years old. In my K-1 visa process, I didn t include anything about this previous relationship, except for my son s documentation, since he is applying as a K-2.Our petition was received by USCIS on August 29, and my fianc received the NOA1 in paper form on September 10. So, we are now waiting for the NOA2.
At the moment, I m officially filing for shared custody with my child s father, so I can have a court-approved document before the interview. I m a bit worried about what kind of questions they might ask, since my son will still have an active father in his life, even if he moves to another country with me.
My question is: once I have this custody document in hand, should I send it right away to USCIS (even before receiving the NOA2), or should I wait until they ask for it (RFE)?
So far, our custody arrangement was only verbal, and that s been making me feel insecure.
Thank you for any advice!

My wife and I got married in January, filed our AOS packet at the end of March, and have our AOS interview scheduled for Nov 12. Our final AOS packet, as prepared by our lawyer, was nearly 300 pages (including all forms and evidence we submitted). We've had an interview prep session with our lawyer, as well as with another lawyer at the immigration law firm where my wife now works, and they've both stated that we should have an easy interview because we submitted so much proof with our initial case. Despite this, I still want to be very prepared, of course.
While I took all the steps I could think of to have proof with our initial filing (adding her as an authorized user to all my credit cards, screenshots of all accounts where she's a family member, lots of photos, etc.) we have plenty of additional proof from the last ~7 months. This includes new photos, WhatsApp communication, remittances to her family, utility bills, and pay stubs from both of us.
My current concern is the number of pages we'd be bringing to the interview with the recommended 6 months of financial statements for all institutions. I have five different credit cards (I use them for rewards and never carry a balance) and two bank accounts. Even with cutting out the extraneous informational pages from the statements, the last 6 months' of our primary bank statements alone are about 20 pages. If I print those statements for all credit cards and accounts, we're going to have over 100 pages just of statements. This seems excessive when our lawyer recommended 30-60 pages of new evidence.
I'm worried about not having something we need, but I also don't want to be overkill. I also don't want to struggle to quickly find a particular document or set of documents the officer may ask for during the interview. Would you recommend I print it all and do my best to keep it split up, or focus only on the accounts we use the most?
Also, does the 6 month recommended period also apply to utility bills? The only ones of those I can add a spouse to are our internet and electricity bills, and I was going to do two statements for each of them to cut down on paper.

I and my fianc e got married within 90 days after she arrived in the US. We are not able to submit AOS package within 90 days of her i-94. We watched videos on Youtube about the AOS package with expired K1 visa. We are aware that we have to put out of status in question 14 part 1 page 3 and answer yes in question 76 part 9 page 21. Additionally, we have to clarify that she overstayed between date and date in part 14. Is that all that we have to do or we have to submit I-130 with our AOS package? Thank you so much!

I just received a notification that USCIS issued me a letter stating that due to my I-131 and that "Aliens seeking parole at a POE must now pay the Immigration Parole Fee or establish that an exception to the fee applies, effective immediately."
Now I'm wondering, I already have my greencard and would use this as my travel document as well as my passport and marriage certificate. Will I still have to pay the 1000$?
