PSA: If entering the USA 2 years after marriage, kindly remind the immigration officer of this

When we last entered the US, our immigration officer said "Oh, hmm I wonder if I could go ahead and change you an IR-1." The agent right next to him said "Yes, you can do that" and he acted surprised. His comments made it pretty clear he was going to erroneously issue us a CR-1 and he seemed to not even know he could change the visa status until his coworker advised him (THANK GOODNESS she overheard!). I don't know how onerous the process is to correct such an oversight but I'm glad we didn't have to find out!
Just wanted to pass this along in the hopes it saves someone from any problems with the wrong stamp being placed in the passport, as I've read about here before.... I would kindly remind the officer "We married >2 years ago. We can enter with an IR-1 visa now right?"- 20 replies

I entered the U.S. on a K-1 visa on June 1st and left for Canada on June 2nd, remaining here for 20 days. I am now attempting to return to the U.S. through Toronto Pearson Airport (YYZ) using Automatic Visa Revalidation (AVR). My K-1 visa is expired, but my I-94 is still valid. Am I ok?-

Wrong USCIS application form filed by my lawyer!

Hello, so my wife came in k-1 visa to USA and we got married and all. We filled for work permit and green card together but while doing that my lawyer filed for I-130 no idea why. Will that application make my process for work permit and green card slow? If so how do I withdrawal that application? My lawyer isn’t helpful at all. I need some help…-

Seeking advice for Thai/US couple - What US visa path to take?

My gf and I live in Thailand but spend 2-4months in the US per year. Once/if we have children age 5+, the time split would become vice versa. We have no plans to live full-time in the United States in the next 5 years, but I visit my family and friends 2-3x per year for 2-3 weeks at a time. I would love it if she can join me for those trips and experience that part of my life. What options do we have -- US visa wise, maybe a tourist or fiance visa later? Other?

Please be nice, I know I made a mistake... But got my K1 approved and arrived in the US June 25, 2024 and applied for AOS February 25, 2025 -- then left the US (abandoned my AOS). Will I be banned for re-entry to the US -- even under a spouse visa?-

I'm currently living and working in the United States. My fiancé currently lives in Japan. We have been dating for about 6 months, and we have met in person several times, but we are not yet married.
My fiancé will be visiting me in the United States on a tourist visa some time in March or April and staying for about 3 months. I want to file for a fiance/spouse visa asap -- what's next?-

I m hoping to get some advice on what would be the next best steps regarding my husband's (LPR) N400 application/his process to naturalization.
My husband (LPR) recently submitted his N400 application (October 2025). We have separated (same household but officially no longer together) and started divorce discussions. Technically, he will hit the LPR 5 year mark in April 2026 as (received his conditional green card in April 2021; conditions removed in 2023).
He has not received an official interview date yet.
From all I have read so far, right now it seems like he should wait until his interview and answer everything truthfully. So I guess my question is - should I wait to file divorce until after his interview? Does it even matter since he will need to answer truthfully about the separation?
I recognize he may get declined during his interview (depending when it is) and have to reapply as a 5 year applicant. I also read there is a potential his naturalization could move forward if he s at 5 years+ when the interview happens.
Any advice on would be greatly appreciated. For the record, my husband and I are still on good terms but our relationship is irreconcilable so an urgent divorce filing is not needed, although I would prefer to not delay longer than I might need to.

1 RepliesHello so I am a Canadian citizen and my wife is a US citizen. We are currently living in Canada and working in Canada. Our I-130 was approved from USCIS and now we are at the NVC stage. Problem is since she has Canadian income and not a US based income I don't think it will count for the affidavit of support.
We have tried looking for a joint sponsor with no luck. From my understanding the only way we are going to be approved is if she can provide sufficient US income which means she either has to move back to the US and find a job, or find a remote job in the US. Is there any other way around this or are these our only options? We don't want to be split apart and the chance of her finding a remote job seems impossible so we're just kinda defeated and ready to give up on this whole process.

6 RepliesMy consular interview is in 5 days and my petitioner husband just got laid off (if you don't laugh, you'll cry...), so we're scrambling to sort out a last minute joint sponsor. Thankfully, my husband's mostly-retired parents (the dad the primary joint sponsor, the mum as household income) have agreed to step up to the plate, and they have very good annual income. I'm doing my best to help them with the paperwork.
Their initial pass at filling in the I-864 included SSA deposits and part-time work as the calculation for "current income". That alone brings us decently over the threshold for a household of three. But, looking now at their prior tax returns, they clearly are withdrawing a LOT from an IRA, so I can only imagine this is something that also needs to be included in current income also.
Honestly, I'm CLUELESS about what an IRA may look like, how it's deposited, how frequently, etc. What can I ask from my in-laws to prove they are withdrawing from their IRA, to the point where it can be evidenced as Current Income?

2 RepliesWe got F3 visa stamped at the airport (Parent sponsor a child s family). 2 weeks later, we got a letter for biometrics appointment for greencard. Based on others cases, F3 visa do not get another biometrics appointment because they already collect it at the consulate. Does anyone know about this situation? Did USCIS make a mistake?

9 RepliesHello. We re getting increasingly concerned about our experience with them. We paid the firm in full twice, and our case was denied the first time. After that, we waited 1 2 years with no meaningful updates on an issue that was supposed to be handled after the denial.
We contacted them again in August of this year, but it has now been three months with no response. There s nothing urgent we need to submit to USCIS right now, our case is still pending, but the lack of communication from the firm is really worrying.
If anyone has worked with this firm before, could you share your experience? Are long delays or unresponsiveness common with them? Thanks in advance.
