When we last entered the US, our immigration officer said "Oh, hmm I wonder if I could go ahead and change you an IR-1." The agent right next to him said "Yes, you can do that" and he acted surprised. His comments made it pretty clear he was going to erroneously issue us a CR-1 and he seemed to not even know he could change the visa status until his coworker advised him (THANK GOODNESS she overheard!). I don't know how onerous the process is to correct such an oversight but I'm glad we didn't have to find out!
Just wanted to pass this along in the hopes it saves someone from any problems with the wrong stamp being placed in the passport, as I've read about here before.... I would kindly remind the officer "We married >2 years ago. We can enter with an IR-1 visa now right?"- 19 replies

I entered the U.S. on a K-1 visa on June 1st and left for Canada on June 2nd, remaining here for 20 days. I am now attempting to return to the U.S. through Toronto Pearson Airport (YYZ) using Automatic Visa Revalidation (AVR). My K-1 visa is expired, but my I-94 is still valid. Am I ok?-

Wrong USCIS application form filed by my lawyer!

Hello, so my wife came in k-1 visa to USA and we got married and all. We filled for work permit and green card together but while doing that my lawyer filed for I-130 no idea why. Will that application make my process for work permit and green card slow? If so how do I withdrawal that application? My lawyer isn’t helpful at all. I need some help…-

Seeking advice for Thai/US couple - What US visa path to take?

My gf and I live in Thailand but spend 2-4months in the US per year. Once/if we have children age 5+, the time split would become vice versa. We have no plans to live full-time in the United States in the next 5 years, but I visit my family and friends 2-3x per year for 2-3 weeks at a time. I would love it if she can join me for those trips and experience that part of my life. What options do we have -- US visa wise, maybe a tourist or fiance visa later? Other?

Abandoned AOS and now regret it

Please be nice, I know I made a mistake... But got my K1 approved and arrived in the US June 25, 2024 and applied for AOS February 25, 2025 -- then left the US (abandoned my AOS). Will I be banned for re-entry to the US -- even under a spouse visa?-

I'm currently living and working in the United States. My fiancé currently lives in Japan. We have been dating for about 6 months, and we have met in person several times, but we are not yet married.
My fiancé will be visiting me in the United States on a tourist visa some time in March or April and staying for about 3 months. I want to file for a fiance/spouse visa asap -- what's next?-

I am a USC, my parents are LPR. One of them petitioned their son under 21. His interview at the embassy is coming up soon.
The petitioner has been in their home country for about 5 months now. Since May 2025. Taking care of some family business. Planning to come back soon.
Will the list below provide a good proof of US domicile for the petitioner at their son's interview at the embassy:
- Last 2 years tax returns (Petitioner)
- W2 and Pay stubs (Petitioner)
- Active US bank accounts (Petitioner)
- Valid state ID/driving license (Petitioner)
- Electricity and internet/phone bills in their name from the address they live at here till May 2025. (Petitioner - no longer living there. Ended their rental in April/May 2025)
- Active PO box in their name to continue receiving their mail (Petitioner)
- Affidavit from the petitioner that they didn't abandon their residency here. Stating they are in their home country to represent me in property purchase acting as an agent through POA from me. Explaining that their job here was closed for the summer, hence they were able to go instead of me due to my employment commitments. (not currently employed)
- Affidavit from me (i am a joint sponsor as well) stating that I granted them POA to act as my agent in our home country to purchase a property in my name. As I was not able to take time off from work. Stating that upon their return, they will be staying with me at my home until they decide their next housing plans.
- A copy of the said POA and the property sale contract
- Bills, insurance and other mail showing that I currently live in that address.
How does these look? Do you think they are sufficient to prove on going ties to the US and proof of domicile upon their return?

3 RepliesI applied for citizenship on August 6th, 2025, I received an interview date for November 3rd,2025. I did not get a biometrics appointment. Is this normal and will they send the booklet for the civic text?
What advice do you have to prepare for this interview? I have been reading the booklet though I need to read more.
Anyone facing issues with re-entry into USA with a GC 1:33 pm today

2 RepliesI am about to leave USA for 3 months and I have been a GC holder for the last 3 years. I have worked for only 1 of the 3 years. Politically I am center left (not an activist) but I have made political contributions to the Dems while on GC and I was wondering if I will face any issues while re-entering the country. I was wondering if on re-entry if the CBP can use any hidden violation that I am not aware of right now to prevent my re-entry. The only thing I can remember as coming close it that in 2016 I mistakenly made a political contribution to presidential campaign unaware that without a GC I was not allowed to do that. When I realized my error I called up the political campaign number and asked for a reimbursement. Can small issues like this lead to any problem? Should I contact an immigraton attorney just for safety or am I being paranoid?
Do we need the US citizen spouse's Birth Certificate for the Naturalization interview or will valid Passport suffice? 12:51 pm today

2 RepliesI have my naturalization interview tomorrow, and we just realized we are unable to locate my husband's birth certificate. It is probably misplaced in the house somewhere, but we can't find it.
The interview letter says I need to bring it. Would my husband's US passport suffice?

5 RepliesHi all, we have not had an interview or received any communication about scheduling one at this point (485 sent Aug 5/Biometrics Sep 2/Work permit/EAD received 2 weeks ago). Does this current status bar mean that we aren't likely to need an interview?
