One of the requirements of the K-1 Visa is that you have met in person within the last 2 years.

So, if you have not met in person, you cannot get an approval. You will have to meet, then submit your I-129F.

Dec. 10/04... AOS Interview - APPROVED!!!!! (Passport stamped)

Sept. 9/06... I-751 sent to NSC

May 15/07... 10-Yr. PR Card arrives in the mail

Sept. 13/07... N-400 sent to NSC

Aug. 21/08... Interview - PASSED!!!!

Sept. 2/08... Oath Ceremony

Sept. 5/08... Sent in Voter Registration Card

Sept. 9/08... SSA office to change status to "U.S. citizen"

Oct. 8/08... Applied in person for U.S. Passport

Oct. 22/08... U.S. Passport received

It is a requirement to meet in person before filing. You will be denied.

I suggest meeting then re-filing. Do you want to spend your life with someone you've never met?

$355 now (if I remember the new fee correctly!) - though that does depend on when it was sent in.

Unfortunately and according to the instructions, your chances are none in a million of being approved, but am sure stranger things have happened.

Am curious though, your answer/response to question 18 on the I-129f was:

18. Has your fiancé(e) met and seen you within the two-year period immediately receding the filing of this petition?

[]Yes []No

Describe the circumstances under which you met. If you have not personally met each other, explain how the relationship was established. Explain also in detail any reasons you may have for requesting that the requirement that you and your fiancé(e) must have met should not apply to you.

Was there a reason why you filed without having met first? The instructions on the I-129F clearly state the following:

You and your fiancé(e) intend to marry within 90 days ofyour fiancé(e) entering the United States, and are both freeto marry, and have met in person within two years before your filing of this petition unless:

A. The requirement to meet your fiancé(e) inperson would violate strict and long-establishedcustoms of your or your fiancé(e)'s foreignculture or social practice; or

B. It is established that the requirement topersonally meet your fiancé(e) would result inextreme hardship to you.

The new fee is $455 by the way.

like said above, you will be denied. you must have met in the last 2 years physically. webcams and chat logs and phone are not evidence of meeting, only evidence of a relationship. two entirely different things. And you have lost your filing fee. You will have to meet first, then file your I-129f. when did you file? they will probably send you a RFE right away which you cant respond to. So you should wait until you get the request for evidence. then cancel this petition so its not pending and messing up your next one with all the correct requirements met including meeting. you will pay the newly increased fee as well of $455. but you havent met yet so thats a moot point. but your current petition is doomed to be denied.

Just out of curiosity, if USCIS did approve this petition (lets assume the Adjudicator overlooked the fact they did not meet in person) would the Embassy allow the visa to be granted if they were aware that the petitioner and applicant did not meet in in person?

:no:

Highly unlikely that the service center will miss it, but even more unlikely that both the service center and consulate would miss it.

It has been said that the ConOff's job is not to readjudicate the petition... So they may in fact not refuse to issue the visa on that particular issue but may refuse to issue based on lack of a bonafide relationship and therefore return the petition to the states for review. In the end the same result and it is possible......

Its now $455 for the I-129f!

Stanley, I'm sorry but you don't have a prayer for being approved without having met. Even people who have cited religious reasons have been denied. Its extremely rare to be approved without having met in the previous 2 years.

Could we ask WHY or what are the reasons you havent met and to why you went ahead and filed when it was very clear as a requirement to meet with 2 yr period. Talk of marriage over the computer will not replace the actual knowing someone for a lifetime marriage
