Or is it usually forgiven in consular settings? Seems like a grey area

Is this for a spouse visa? Please fill in your timeline, thx.

How did you get the job, did you provide any fraudulent papers? If so, what?

This is for CR1. How can I fill out my timeline, is it on my profile page? No it’s all cash. Does the details matter to the officers?

Yes, on your profile page.

And yes, details absolutely matter, if you just worked cash in hand with the employer not doing any checks then no problem (forgiven for spouses of USC’s). But if you provided fraudulent documents to get the job then it could be very different.

Did you declare and pay taxes on the money? How much unauthorised work are we talking about?

Generally it's not a problem. Unauthorized work isn't normally something that triggers inadmissibility all in itself, it normally is just a bar to adjustment of status and only adjustment of status, so you generally can still leave and undergo consular processing. Of note is that it's not a bar for AOS for immediate relatives of US Citizens (spouses, parents, unmarried children under 21).

Only related things that trigger inadmissibilities are:

Fraud in somewhere in the immigration process, like you lie to the DOS during a consular interview, lie at port of entry to the CBP, or lie to USCIS while seeking something in US (which triggers a misrepresentation bar that can be waived with an I-601).

Falsely claiming to be a US Citizen in any context, even in a private casual conversation (which triggers a false claim of citizenship bar at point of which you are utterly screwed).

Lying otherwise (e.g. falsely claiming to be an LPR on an I-9, or using a wholly made up SSN) do not trigger anything here. So you know, in your case since you just worked under the table, own up to it, file and pay off the back taxes, and you'll be fine.

This is literally what you have been told here.

Sounds like you need a lawyer. Better make sure they know what they're doing, as you have avoided providing key info here regarding fraudulent documents. VJ can't help you if you don't provide the full story.

Speaking solely about my personal experience:

I was employed for 7 years without work authorization before marrying my husband who is a US citizen. I have always used my SSN / filed my taxes but never lied about my legal status on paper (I worked in places that didn't thoroughly check legal documents to be frank).

I consulted an immigration lawyer about this when I started preparing my AOS paperwork. And, following his advice, wrote in "odd jobs" in the form from back in the day when it asked to list your employment history (it probably changed since 2016 so not sure about wording now). I was never asked about this during my AOS interview, and it was never brought up by any USCIS agent during my journey to become a citizen.

There are so many conflicting sayings on this website I just want some clarity!

You won't get clarity without giving us the details asked for. But presumably you've provided all of that info to your lawyer, and if s/he says it will be forgiven, then they should know. Don't ever use ChatGPT for immigration advice!
