Hello Me And My Spouse Trying To Fill I-130 Form For CR1/IR1 Visa But We Just Kinda Need Help

 

I Am Beneficiary And My Spouse Petitioner Is Girl After We Get Married Her Surname Is Changed On Marriage Certificate We Married On My Country In Turkey But She Still Have Her Old Passport With Her Maiden Name Still Have 3 Years Time With That Passport We Going To Fill I-130 Form For Me

What We Need To Do For Current Legal Name? Because In Passport Still Her Old Surname She Still Appearing Her Maiden Name On Passport But Legally It Is Changed On Turkish Marriage Certificate

We Add U.S. Passport And Birth Certificate To Citizenship Evidience Section. Thanks For Helps From Now On.

Are you asking how a US citizen updates their name after marriage?

 

If so, they will need to make the change via local probate court and then update their name on their SSN, passport, etc. They will need to provide copies of the Turkish marriage certificate and any required translations to all of the relevant government agencies.

 

I could be wrong, but I don't think, unlike non-USCs marrying in the US, a USC can start using their married name legally until it's updated in the US.

Yeah actually We married on Foreign country Not In USA Her Passport and other information everything with her old surname still not changed name on documents in this situtation what i need to say on USCIS Form I-130 That's what I Wonder tbh

If her name is changed due to marriage then just start using it everywhere for everything.  A marriage certificate is a legal name change document.  Use her married name on the I-130 and put her maiden name as "other names used".

 

The visa, green card, social security card and all the other new US document that are derived from those documents will be in the name that appears in her foreign passport she brings to the embassy the day of her interview.  If she wants to changes her name, and if it is at all possible, it will save her untold hassle if she changes her foreign passport BEFORE her interview.  It costs $415 and can take a year to change the name on a green card once it has been issued.  I'm guessing(?) it is much cheaper and easier to update a Turkish passport.

Thanks For Reply It Is Really Helpful To Be Honestly Turkish Passport Expensive Than U.S. Passport Even It Is Useless But Good News Yeah It Is Produced More Early You Can Take It Early ^-^ Okay Then We Use Marriage Name Of Her In I-130 And Change Her Passport With New One Before Interview It Is Good Line As You Said! I think OP is asking about how a USC updates their name after marriage.

I understood that you married in Turkey. As I said, I believe a USC updates their name in the US. If the USC starts to use their married name before updating things like their passport and SSN, it may confuse the process when providing those details to USCIS. 

 

It seems to me that best approach would be to continue using the maiden name, until they are able to return to the US and make the legal changes.

Opps. I did read that incorrectly and confused the petitioner with the beneficiary.  Nonetheless, if someone intends to change their name due to marriage, they are legally entitled to, and in my opinion should go all in, immediately for everything sooner rather than later.  Using different names in different situations or putting a name change when you intend to change it is more confusing.  Name usage kind of has momentum and the longer one continues to use a name the more hassle it is.  IF she want to change it,  I would change Social Security, State DL/ID and everything else as soon as is convenient. 

 

USCIS even addresses it in their question with, "Your current legal name is the name on your birth certificate unless it is changed after birth by a legal action such as marriage..............."

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

Hello I Have Some Question Kinda Emergency We Almost Finished To Filling Form I-130A But We Not Signed It Beneficiary Outside Of USA We Living Together We Sent I-130A With I-130 Online Filling If We Sent Without Signing It Will Be Cause Any Problems? Because Instructions Said We Not Need To Sign It If We're Overseas Reply ASAP Thx

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

You are right there to do it, so sign the form and provide the passport style photo.

 

To be perfectly clear, your wife, the petitioner, should file using the married name.  She can complete the change and get new ID and Passport later, in the USA.

Facts are cheap...knowing how to use them is precious...
