ROC for Husband & Stepdaughters - One does not live with us

Thank you all for your input and helping me realize that I actually *don’t* need to stress about this. I’m definitely way more stressed about this than she is or will ever be. So I can just… not file. Phew!

 

My husband does have to include ALL children on the I-751, right? So, SD #3 will still be listed as his child, but he’ll check NO to the question of if this application includes her. Do I have that right?

3/11/22 - Married

 

USCIS 

6/2/22 - Submitted I-130 online (4 petitions - CR1, CR2 x 3)

6/2/22 - NOA1 (Nebraska Service Center) 

6/13/22 - Sent K-3 Packet

6/22/22 - K-3 Receipt Notice

11/12/22 - Approved (NOA2 - Texas Service Center)

 

NVC

11/19/22 - Welcome Email

11/21/22 - Paid AOS & IV Fees

4/13/23 - Submitted DS-261 & Civil Documents

4/26/23 - Documentarily Qualified (CR1, CR2 x 2)

5/26/23 - Documentarily Qualified  (CR2)

7/13/23 - Interviews Scheduled (CR1, CR2 x 2); Expedite sent to NVC for 4th applicant

7/20/23 - Interview Scheduled (CR2)

 

Consulate

9/15/23 & 9/18/23 - Interviews at CDJ (Mexico)

9/18/23 - Approved! (CR1, CR2); Administrative Processing (CR2 x 2)

9/23/23 - Entry into U.S.! (CR1, by land at Hidalgo International Bridge)

10/5/23 - Administrative Processing appointment at CDJ (CR2 x 2)

11/13/23 - CR2 approved!

11/15/23 - CR2 approved!

11/22/23 - Entry into U.S.! (CR, by land at Hidalgo International Bridge)

11/23/23 - Entry into U.S.! (CR2 x 2, by land at Hidalgo International Bridge)

Exactly, definitely list the child. Just check box saying NO to "Is this child removing conditions with you" or similar question.

Correct

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

It is up to the Beneficiary to remove conditions, so I would leave it in her hands, she is an adult, her call.

That's also what I'd suggest.  

However, since most people know very little about immigration, I would also make it clear to her what it might be a now or never situation - even visiting will probably be off the table.

Agreed - I made it clear to her when she first gained residency that SHE needed to take responsibility of educating herself on what she needed to do to maintain her residency. I would be there to help, but she is an adult and needed to do her own research. That has not happened in the year and a half since, and frankly, after repeating to her so many times that she needed to DO something in order to keep her green card privileges, I'm done trying.

 

I completely agree with everyone that it's her decision, and she should be the one putting the effort into it. I know that there's no way she will be able to afford a $750 fee (lives in an impoverished area, but also - despite much encouragement to do so - does not have a job), but I also don't believe it then falls on us to pay it.

 

My husband and I have decided not to include her in his application to removal of conditions (her bio information yes, but he will indicate "no" on the ROC part).

 

Thank you all so much for your input! I'm sure I'll be back with many questions as we put together our package.
