So hello everyone, after posting in this group and learning so much things have gone to a bad turn. Things aren’t going well at all and we both are considering a divorce. So here is the run down, she has never been in the United States and we had gotten Married in October (7months)of last year in Nigeria. I already filed the I-130 and still waiting. Regarding the divorce, how do I seek a divorce from my wife so she doesn’t retain my last name. I could just leave but I do not think that’s the right thing to do. Is it possible for me to file for a divorce without having to return to Nigeria? And I was reading about the 2 year rule of divorce in Nigeria and I was wondering if that applied to me since I’m not a resident of Nigeria? I need help please!!!!

Where are you residing? You can file for divorce in that state.  Not sure if you have any power in deciding which name she will use in the future.

Might be a good idea to consult with an attorney to make sure you don't forget anything; might or might not be able to file on your own, depending on the situation, and how comfortable you are with paperwork.
